Attorney General Gonzales Signs Order Adopting Revised Regulations Implementing Section 2257

J.D. Obenberger writes on XXXlaw.net:

The United States Justice Department announced Tuesday that Attorney General Alberto Gonzales has signed a final rule containing changes to the Justice Department regulations implementing 18 USC Section 2257 . These changes will become effective thirty days after their publication in the Federal Register unless their enforcement is enjoined by a federal court. Until they are published, we cannot know how closely they resemble the changes proposed last June by the Justice Department. A table comparing the existing regulations with the June 2004 proposal is found here. A detailed article highlighting the differences, published last Summer in AVN Online, is found here.

Contrary to at least one GFY-posted account, the sky may not actually be falling. The promulgation points however to a present intention on the part of DOJ to actually enforce Section 2257 for the first time. Indeed, there may be something falling on the heads of those who have not taken the law seriously, but it will not be the sky.

The press release does put quotation marks around the term "pornography producers", a term that does not exist in the present statute or regulations or the proposed regulation, and hints that the final version has been modified, probably in the direction of the so-called "secondary producer" requirements; Though at least one US Court of Appeals has found the provisions to work beyond the authority of the Justice Department, the existing regulations have always required web publishers who buy content made by others to obtain and retain and make available for inspection the original documents and alias information obtained by the original content producers.

Substantial parts of the proposal made last Summer were unconstitutional on their face - notably the inspection requirement that mandated availability for inspection of the records from 8am to 6pm. The burden this onerous requirement would place on part-time webmasters would eliminate substantial constitutionally protected expression. The proposal also required the long-term archiving of terabyte upon terabyte of live, streaming content for many years - and the expensive segregation of this data from the working servers of sites.

All of this was related to Justice by this firm during the comment period, and we will shortly know whether any of the hardship was taken into account in the final rule. To the extent that the regulations unreasonably burden Free Expression, they are unconstitutional and void. We believe that they are subject to the demanding constitutional test of "strict scrutiny" though one prior Court of Appeals decision applied the less demanding, but still vigorous "intermediate scrutiny". The Free Speech Coalition can be expected to take point at the forward edge of this battle by initiating litigation. This would be a really, really good time to join.

FSC is not only advancing the interests of the Webmasters (the most numerous class of "secondary producers", but it has made significant outreach to the web community by its recent hiring of Tom Hymes, formerly with AVN Online, as its communications director. It is my best hunch that Justice would not be promulgating the changes without plans to enforce in the immediate future.

Ernest Greene: 'Consumers Are Better Off Than Ever'

Ira writes on Nina.com:

I agree that they [distributors and major retailers] don't watch the products, but I don't really think they read the reviews either. Likewise with packaging. Everybody, consumers and retailers alike, has been burned on crap-in-a-fancy-box so many times, I don't think that scam works anymore. I think they buy based on prior sales experience, which is why companies like EA do so well. No retailer need worry that an EA title is going to sit on the shelf for long. The consumers have voted for EA products so often, the retailer has virtually zero risk from stocking practically any EA title. I discovered this myself in a bookstore in Denver where I saw a huge EA display in the front of the shop and suggested to the manager that those titles must sell pretty well. His reply: They're the only ones that do.

In other words, proven sales performance has more impact on wholesale than reviews or company promotion. Companies, directors and performers with established demand will always do better out the door, regardless of all other factors.

Therefore, in the end, consumers are the most important factor. If they buy products from a certain source, that source will sell more products. If not, not. It may take some time for consumers to catch on to hot, new stuff, but word does get around and I do believe that most top-notch porn will find a market. Junk that's shoved down the buyer's throat will get spit up in a hurry, as has been demonstrated by some heavily promoted lines that got fawning reviews because the producers were big advertisers and did nothing on the bottom line. I could name a few examples here, but I have enough enemies already.

For what it's worth, I think the porn consumer of today has it better than at any time in the history of the industry. There's more good product out there, and more variety, than ever before. And the ability to communicate with other consumers via the Internet has given an advantage to the customers they never had previously. At the same time, the influence of reviewing publications has declined in proportion, which is not a bad thing to my way of thinking.

Abusive Porn

OneOneZero writes on ADT:

The problem with abusive/humiliation porn for me is that it's REAL. I've seen/heard about documentaries showing behind the scenes in a Max Hardcore shoot, where the women are literally bullied into doing sexual acts. I've seen them cowering in the toilet, throwing up, tears streaming down their faces saying they "can't do it, I just can't do it, I'm sorry" and then the producer/director coming in and yelling at them, "Who the f--- do you think you are?! Get back in there and finish the f---ing scene!". She's totally shaken, crying. "I can't, I can't" she says, choking back tears, looking absolutely destroyed. Previously she had been up for anything, but she didn't realize how nasty it was going to be. "You're never going to work in this town again if you don't get back in there and finish the f---ing scene!" he yells back at her.

Director Quasarman writes:

I wouldn't have any problem with this type of material if both the actress and Director were "in on it" and by that I mean both are simply playing roles to fulfill the desires of a certain segment of the viewing audience. Unfortunately, it is my sincere belief that at least some of the people churning this stuff out truly hate women. There is no role playing going on here. What you then end up with is a director who is getting off on distilling his personal issues through the humiliation and abuse of a girl in front of his video camera and a girl waiting for it to end so she can get paid and go home. For me, that takes it out of the realm of fantasy altogether. Certainly it shouldn't be banned or censored but it should at least be acknowledged that there are some truly evil motherf---ers in this business.

Max Hardcore responds:

The documentary you're vaguely refer to, was done by a freelance outfit out of the UK, who then sold it to Channel 4. The piece was a complete 'hatchet job,' a total set-up, and those boys did a real fine job at making porn look bad. But the reality of the situation is much less shocking.

The girl in question, Felicity, was brought in by their crew, and was a 'ringer' in their effort to make hardcore porn look bad. That's what sells! They used this chick in ways I would never imagine doing, basically ruining her life at home in England. Felicity came packing some pretty heavy emotional baggage, which I didn't know about before hand, but when she snapped on the set only a few minutes into the scene, I knew that she wasn't mentally fit for this business. I talked to her after she walked off the set without explanation, and had a calm chat with her up in the dressing room. At NO TIME did I yell at, or berate her. But I could see that there was no way we were going to finish the scene. I simply said okay, and that's that.

The documentary crew scrambled up the timeline to make it look as bad as possible for me. But I don't really care except that they keep reserecting the damn report, then I have to explain it all over again. I'll leave you with this: There's no way anyone can speak with authority on what's really happening on a set, or how a girl feels, unless they are there the whole time. As has been pointed out numerous times in this thread, some girls like it rough, and have no problems on the set. Other girls aren't so comfortable with it, and that's why I go out of my way to explain things to them before hand, using video, pictures, and exit interviews with girls who've previously worked for me.

If they're not down with the program, they're free to leave anytime, and I tell them that before we roll a single frame.

Porn star Kelly Wells responds:

Well Max, in my opinion, every whore needs to take a turn with you. To get broken in. I still remember when I did my first scene with you...afterwards I said I will not do this porn thing again. Turns out that after that scene I found out that to work for anybody else in porn is a f---ing cakewalk. A lot of whores won't work for you because you will actually make them WORK for their money. But good whores like me understand, that taking an occassional ass wrecking is good for them. So, in the meantime take in mind that nobody knows what they are talking about, unless they have personally sat in on a set and documented "unusual" behavior. In my opinion, you are one of the most professional people that I have worked for ON and OFF camera. By the way, taking rounds with you on camera has convinced me that it is not so bad after all, to be a piss guzzling whore.

CyberNet Expo's Legal Panels

Faye Sharp, Cybernet's director, writes me back:

After a week and a royal screwup by Time Warner on my internet - I am finally back on line.

I appreciate that you came to me with these questions. To answer them quickly, no we did not require anybody to pay to speak on any panel, and yes, Eric Bernstein is a corporate sponsor [of the legal panel], so of course he's getting a lot of exposure at the show. We always try to take care of show sponsors since they contribute and make Cybernet Expo possible. None of the speakers on our panel discussions have ever paid to be on the panel.. I have had many legal panels, consisting of a dozen attornies. We do give our Sponsors and Exhibitors the first crack at spots. This IS a business, and they expect marketing opportunities. But, take a look at our seminars again...... there are many on them who are NOT sponsors.

I am not sure who the FALA [First Amendment Lawyers Association] attorneys are? But, no one was asked to pay to be on a panel. We have NO openings on any of the panels & have not had any for some time. Those who were interested in being on a panel had since last January to contact Jay. We have had to turn down several people in the last 10 days - they just waited too long. There is no story here.....This is Cybernet's 8th year & people who have been around, know that I never cave in to political pressures.

I find it hard to believe that any prominent businessman in the industry, including Fay, has never caved in to political pressures. I remember when the Cybernet Expo used to have an awards show, but this was cancelled after the Montreal show in May 1999 because Ron Levi and other prominent business leaders denounced it.

Faye Sharp responds: "Your comment just proved my point. The first People's Choice awards were fun for everyone, even those who did not win! The second year was hell, because to some in the business, it became an ego problem. Because it was way too much work, to have to deal with threats & political pressures - I chose not to continue the awards. Life is just too short. This is our 8th year - most have not lasted that long. To have to deal with things like this is draining to me. If it can't be fun, beneficial, entertaining and educational, I won't do it anymore."

I reply: "What connection does YNOT have to the Cybernet Expo? Do they own it? Because when I emailed you, I got an email reply back from Jay Kopita."

Faye responds:

I am semi-retired. Jay is assisting me in sales. Info@Cybertnet mail goes to both of us. Most of my duties are with registration, the hotel, rooms & the 'nuts & bolts things. I work pretty much in the background. I hate politics, so this suits me just fine. I was in the process of moving when you wrote, and without internet. Jay called me about any emails that I needed to take care of. What couldn't wait I called & he replied to the others for me.

When I announced my retirement 2 years ago, I was contacted by several who had offers or plans. Most not in the best interests of the show as a whole. I met with Bob and Jay [at YNOT] and found that we could have a good working relationship. It worked well last year, and yes, Jay is a godsend!

Gram Ponante Telling The Truth?

James from Harvard writes:

i just read his interview and i've gotta question his educational background of tranferring to harvard, to williams, taking a MAJOR step down to emerson, then somehow getting into columbia school of journalism. you can't really do what he claims, they're simply too hard to transfer into and you can't do it that many times and meet eligibility-requirements. if you don't do 2-full years that are needed to obtain a diploma, they won't even take your application. also, he may be a decently-bright guy but williams take about 5% of transfers and harvard takes like 40/1000 applicants--it's much harder to get in that way. also, if it's the second time you're transferring, they assume something's wrong with you and you're a serial "grass is always greener" applicant. frankly, i think he generally comes off as a smart emerson student, not the truly exceptional one he would have to have been to do that.

Gram Ponante responds: "Sending me this e-mail only after posting your musings on your site seems like the work of a Dartmouth man, but I do appreciate your restraint. Thrown out of every school I ever attended for fighting, arson, steroid use, and blasphemy, my greatest shame was being an autodidact."

Why Men Should Say No To Female Demands For Oral Sex

Chaim Amalek: I have the perfect rejoinder to those women who demand oral from men.
Chaim Amalek: Tell them that, epidemiologically speaking, a man licking a woman's cooter with his lips and tongue is about as safe for a man as his f---ing a woman without a condom is for a woman.
Chaim Amalek: Women who demand that men engage in this unsafe sex are just being pigs. Dirty, nasty, stinky, needy, bloody pigs.
Chaim Amalek: And these are the women most likely to be carriers of syphillis, herpes, chlamydia, ghonorreah, and various other STDs one can get from orally servicing a woman. Oh sure, some women will tell you that they guy can use a dental dam, but let's face it, nobody uses those things.
Chaim Amalek: So ladies, just shut the hell up about having a guy go down on you, and be happy you have a penis to penetrate you the way the bible intends.
Chaim Amalek: Otherwise, get yourself a clean dyke girlfriend on the side.
Chaim Amalek: Men need to learn to stand up for their health, which means just saying to to demands from women to have their genitals licked. Unless a woman is your spouse or willing to undergo exhaustive medical probing by competent medical personnel, the intelligent man must decline all entreaties for oral sex, and without apology.
Chaim Amalek: Otherwise he is a wimp of the worst sort (think George Pataki), and women hate wimps.
Chaim Amalek: More advice, but this time to women: How Not to Dress and wear your hair - if it is a style sported by butch dykes, then you should avoid it.
Chaim Amalek: Men don't like their women to look like butch dykes.
Chaim Amalek: That means never cut your hair, unless say, it impedes walking, or your man asks you to get it cut a certain way.

Thursday night. It's hard to find parking on Cahuenga Blvd. I end up near Santa Monica Blvd, and my car is still a few feet into the red.

I arrive at the club Tokio (1640 N. Cahuenga Blvd, near Hollywood Blvd) at 10:15. The first porn person I see is Ryan Knox. I ask him about Porn Star Karaoke Tuesday night. There was a good turnout for Keiko's birthday -- her husband Rob Longshot, Pamela Peaks, Kris Slater, Coffee Ron (director), an intoxicated Jim South Jr. with his girlfriend Holly Wellin, Roy Karch, Rusty Nails, Don Hollywood and his wife Brooke Hunter. James Dean had to stay outside because he's only 19.

In his six months in the biz, Ryan, 25, has done 33-scenes.

He used to live in Redlands where he'd watch up to seven porn videos a day and masturbate himself into oblivion. When he was 18, he was jacking off to Alana Evans. Now he's worked with her.

Ryan wants to do more MILF-stuff. I had a similar older woman phase when I was his age. Then I got into my thirties and I started liking them ten years younger than me.

Ryan, who's covered with tattoos, wants to find a sugar momma.

He says his parents and his grandfather support his porn work and they lend him money to get through tough stretches.

I hear that Porn Star Karaoke people (perhaps connected to Sardos Bar) called the Tokyo Bar and complained about Porn Karaoke ripping off their concept. Then the person called LFP and complained.

Porn Karaoke people say that Porn Star Karaoke is completely different. That Sardos is a dive bar. That its evening is more laidback. Porn Karaoke aims at the hip crowd cruising Cahuenga and Hollywood Blvds on Thursday night where there are six or more clubs hopping.

At last week's Kimberly Kane party, the porn girls didn't show up until 12:30am.

Ryan Knox says Suicide Girls are lesbians with tattoos. He wants to get some of them into porn.

He tried to talk Bella into it. She says she has too many tattoos.

"I don't know who she's talking to," says Ryan. He says she could be big.

I meet LFP assistant publicist Laura Jean who introduces me to Bella, who's in charge of the Suicide Girls. She says 30 of them are coming to the party.

Bella and I step outside. It's 10:30pm.

Duke: "How did you get involved with Suicide Girls?"

Bella: "A friend of mine told me about it. It was a premiere. I was immediately interested because I want people to know that you can be different and beautiful, even if you're not on the cover of Elle magazine. Do you know what I mean?"

Duke: "Yeah."

Bella: "You can be completely different and still be exotic?"

Duke: "When did you get your first tattoo?"

Bella: "When I was 18. Two years later, I covered it (butterfly) up with three-feet wings on my back."

Bella says she has three names tattooed on her body, three ex-fiances (she broke up with all of them). She claims she regrets none of these tattoos (nor the relationships). "It's like a diary that I write on myself. They're all experiences."

Duke: "Why didn't you get married?"

Bella: "It's too scary. I'm too young. I'm 23 and I don't plan to get married any time soon. They weren't the right people. I'm a heartbreaker, I guess."

Duke: "What do you do 9-5?"

Bella: "I'm an alternative model. I'm shooting with MTV's Jackass Saturday. I've done Nordstroms, Gucci, big names. They're into tattoos now.

"Before I got tattooed, I only got one out of ten jobs [she auditioned for]. Now I get eight out of ten. It's having that shtick, that interesting thing that people can look at. Anybody can be a pretty face. You have to be different."

Bella has four piercings, none I can see. One on each of her nipples, and her belly button and down below.

Duke: "What was it like the first time you posed naked?"

Bella: "It was uncomfortable but Misty (owner of Suicidegirls.com) is an incredible woman. She made me comfortable. You can be yourself and be interesting and be beautiful and not feel uncomfortable because it is not a male photographer."

Duke: "When you were a kid, what did you want to be when you grew up?"

Bella: "A ballerina. I was a cheerleader in highschool. I've done everything. Three years ago, I bought a tattoo shop in Seattle [where she's from]. I have the whole alternative vibe going."

Bella has lived in Los Angeles for over two years. One of her ex-fiances runs her tattoo shop -- Easy Choppers and Tattoos in Bellevue, Washington.

Duke: "Did you notice any difference in the way people you treat you when you got tattoos?"

Bella: "Absolutely. People treat you like you're a criminal or a drug addict. I've had problems in the past but not since I got tattoos. Tattoos are a rush. They supplement for drugs and stuff like that. I get an endorphin rush that you wouldn't get from anything else. Whenever I feel the need to drink heavily or do drugs, I just go get a tattoo.

"They say tattooing is addictive. I completely agree with that."

Duke: "Is there a part of yourself that wants to hurt yourself that is satisfied by getting a tattoo?"

Bella: "No. It's more the art aspect. People can paint or create a sculpture. I get tattooed. That's my form of art."

Duke: "How have tattoos affected the way you carry yourself in the world?"

Bella: "It's definitely affected how I deal with people on a daily basis. Sometimes you don't get the best reactions."

Duke: "So you've built up a thicker skin?"

Bella: "Exactly. I've built up a tolerance to people. I get a lot of men who walk up to me and say, 'You'd be beautiful if you weren't tattooed.' I'm like, why be beautiful? You're so ugly.

"I love who I am as a person. I know I'm a good person. I've got good karma."

Duke: "Has it affected the crowd you hang out with?"

Bella: "No. The men that I date generally don't have tattoos. I look at tattoos every day in the mirror. It's like a t-shirt that you can't take off. It's hard for me to date a guy who has piercings or tattoos.

"Jealousy is hard for me to handle [in a guy]. I'm obviously a nude model. I promote clubs every night. If somebody is jealous, I can not handle that. That's my job. That's why I've been single for two years now."

Duke: "How do you deal with monogamy?"

Bella: "I'm a very monogamous person. People assume that just because I'm tattooed, I'm promiscuous."

She says she's slept with fewer than ten men in her life.

Duke: "How did your parents react to your tattoos?"

Bella: "My mom said, 'You're ruining the skin that I gave you. I still love you.' I said, there's no still love you. There's love you, period. No, I'm going to love you. You either love someone or you don't. There's no in-between."

Duke: "What do you love and hate about your life now?"

Bella: "I love my friends who are there for me through thick and thin, through addictions, through going out every night. I hate the people that weren't there. The people who bailed because it was easier to do that."

Duke: "What do you love and hate about LA?"

Bella: "I love the weather. I hate that it is so superficial. I'm just starting to see now billboards with tattoos and flyers and advertisements... But on the other hand, you can't promote Sky Vodka unless you're Heather Graham."

Bella introduces me to three Suicide girls - Erika, Stacey and Desiree. I should interview them but I'm too chicken. Erika is a stunning singer and a Penelope Cruz-lookalike.

I don't see any tattoos or piercings on them. I guess they're hidden.

I'm in a room full of beautiful young women yet I can't muster the least attempt to hit on any of them. Must be my strong moral principles. How could I meet a woman of valor in a tawdry club?

Bella has her own website, where she writes:

I'm just a chick that has all guy friends, I can't stand drama as my life has recently been put through the cleaners...Girls tend to have a lot of it. I have my moments but, I'm at overload right now. I don't want to know what she said or what he was wearing and I sure as hell don't want to go to starshoes...(you hear me West Hollywood?) You should know I love to be stupid and act a fool....if you can't deal f--- off now, please...I am a silly dork that gets f---ed up with my friends and has fun for fun...not because I am addicted..I had to quit for a while and get clean so i could do what I wanted for the sheer joy of it and not because I was addicted.

Nasty Comments About Suicide Girls

I found a treasure trove here:

this community is made for ex sg's and members... So yeah I would get a little pissed when some random person comes in here talking about how tattoos means this and this and blah blah. . . b/c for one I find it insulting that someone would just assume that. SECONDLY, NO ONE should insult my intellegence and tell me that I am 'insecure and a self-injurer.' 35 f---ing comments later I am annoyed b/c when this community was first made I thought it was the best idea ever It was awesome to keep in touch with the other ex sg's and so forth. Yeah, I am bothered by the fact that both of those users in the last post arent even members of the community and sit here and talk s---. I went back and saw some of the comments brainlesswonder said to xiolah and other girls and I thought why the f--- isnt this guy banned yet? Sure, I can be a little snotty and sarcastic. God, whatever I have to go to school now and break up this kitten fight on the floor but I needed to vent.

J.P. Guiness writes:

Suicidegirls: Why it sucks!

This last Thursday, I had decided to sever my ties with Suicidegirls.com. The reason? I was zotted over something that I did not do. Sean, the Fuehrer of SG, claimed I was soliciting the SG models. That is total bulls---! Never did such a thing take place! I sent three emails to Sean defending myself and this allegation and I also demanded proof that I did. I never got any response from him. The problems though go even further than what happened. A couple of months ago, I was a member of SG's Seattle group until the recent group manager booted me out. She claimed I was not attending that many events plus I made some of the members feel "uncomfortable". This was a double dose of bulls---! It seems pretty rich from the group manager to ban me because I wasn't attending enough events. She wasn't attending many of the events either! As for making people feel "uncomfortable", I never did or said anything to hurt or offend anybody! Before she became the group leader, there were no problems. The previous group leader was cool and had no problems with me whatsoever! I think what is happening is that SG Seattle has basically become a stupid, childish elitist social clique. If you ain't their defenition of "cool", then you ain't getting in!

Don't get me wrong. I don't hate a lot of the people on SG. Many of them are cool people and I have made some good friends. I even visited Portland, Oregon a few weeks ago. I was still a member of Portland SG, Portland SG, a far better group than SG Seattle and a better group leader (Ryan, an SG girl and one cool person!) and I thought I would hang out with some of them. Had a really cool time! This was one of the reasons I would have stayed on at SG. At least there were some people I liked and had no problems with them and they had no problem with me! I was hoping to stay on but I guess Sean SG had some other ideas.

To sum up all that has happened, I have come to the conclusion that the people that are running SG have had their heads have become swelled and have let their success get the best of them. Also, certain elitist, "more punk rock/goth/indy than thou" people have ruined what was a perfectly good website community. I guess I am not the only person who has gotten "burned" by them. They will continue to treat their members and their models like dirt and one day there will not be an SG anymore. I hope Sean and Missy don't get too comfortable on top. It's a long way to the bottom! In the meantime, life goes on and I will be joining Fatalbeauty.com and trying out Spiceplay.com this week which are better websites anyways! So as for SG. Good riddence!

Bishop Calls Me The Devil

3:50pm. Bishop phones: "I am convinced that you are the devil. There's just all kinds of hell you raise. If I were you, I'd have a look in the mirror, and make sure there are no horns growing out.

"The latest rumor is that Gabor had me call you [about Mr. Johnson and Pimpfomation XXX].

"You were the one that called me. I didn't call you. We had a conversation. I'm not sorry about anything I said. Not even a little bit."

Luke In Chinatown

I got lost going to the Union railroad station in downtown Los Angeles.

I just spent $1,700 ($3,600 in the past six months) on my van. Friday afternoon, it stalled and stopped on 800 N. Hill next to 500 W. Alpine St. It wouldn't turn over.

I made nervous calls on my cell phone, finally getting a towtruck.

I pulled out my jumper cables and opened the hood and stood there until a white guy pulled over and gave me a jump. My car revved but wouldn't fire. We pushed it onto the sidewalk.

Waiting for my tow truck, I call another company. They say it will cost $220 to get me back home. I stay with the original guy, who gets there after an hour. He only charges me $95.

(Luckily, since I first got car insurance in the summer of 1985, I've bought towing insurance and have never had to pay for a tow.)

My friend found another ride home. I wasted four hours. I felt emasculated sitting there in Chinatown with my car dead. My true fear, my deepest darkest dread, is not so much the crappy state of my vehicle, but that it is a metaphor for the real me. Under pressure, I can't turn the switch and rev my engine.

I got home to this email:

I find you to be a complete male chauvinistic prick! God intended all sex to be pleasurable, not just penile penetration. I find the statement that most men don't like pleasuring women orally a little weak. As for the woman's point of view... is a very intimate act that takes a good amount of trust and self-assurance to participate in. However, on the flip side some woman find the thought of ... a little disgusting and aren't very keen on the idea of oral .... themselves. It works both ways, you've gotta give to receive. In short, there's nothing wrong if you like ..... and there's nothing wrong if you don't.

Porn Generation: How One Young Man Prostituted Himself to the Religious Right For Spending Money

It's everywhere, from commercials to New York Times bestsellers to college (and even younger) classrooms. In fact, pornography has become such a part of normal life in 21st century America that many teens and twenty-somethings have had no more important influence. They are the porn generation, where life's expectations come from Mouseketeer pop tarts, Victoria's Secret, Internet titillation, and condom-flogging sex education.

More power to him, what Jonathon doesn't know is that I told a friend of mine of 17 yrs today to go f--- himself as well- and funny enough he is the Publisher of AVN Online- go figure. Its not a industry where we look out for each other, we cut each others throats day and night and the realisation of it is pretty tough. Being steeped on, helping elevate folks and generally putting forward anything goes without any compensation. None. Many people that put companies on the map are broke, missing or just end nowhere after putting every ounce of what they got into them. This is a repetitive and recurring tragedy for many and most people in this biz. Its a tough pill to swallow.

Were his predictions correct .. of course.

Holly Randall: 'I didn't steal $250 from Aria Giovanni'

She writes on XPT:

She's one of my closests friends-- I was a bridesmaid at her wedding for christsakes! I don't know anything about that, and obviously I'm sure she would have told me that if it was true. I've got to call her tomorrow so maybe she knows where the rumor started.

Girl's frame of mind during gag scene?

Smelly Monkey writes on XPT:

I think most people like to be in control of most aspects of everything they do or at the very least on par with the other person or people they do them with. But during some of the rough scenes in porn its clearly one sided in the mans favor.

Some of the things they do to the girls is brutal and i have often wondered what goes through their heads at that time, i have noticed a few of the following.

* delayed responses to simple questions: Like when the man will say how do you like that or suck my balls, it takes the girl a few seconds longer then normal to respond. Does this mean she has just completely shut off even thinking and just hopes for the scene to get over with , get her money and go home, or perhaps something deeper?

* the empty look in the girls eyes half way through the scene; Does this mean she underestimated what she was getting herself into, conflicted on whether she should get up and leave or figure she is half way through it to get it done. Weighing up if the extra emotional damage is worth the pay check?. and lastly

* the rare exception that the girl actually likes it and makes it vocal angering the men who are supposed to be degrading her making them go harder and leaving some damage taylor hill comes to mind.

I guess im wondering if girls ever reflect on doing this or if they just shut it off completely. Camilla did and worse yet she did it during the act making it all the more painful. Its a difficult question to ask here as Kami would never admit it and meliss is pure evil. I guess i just felt it needed to be raised.

Porn star Kami Andrews writes:

I begged to be in gag factor. I was a fan of the series before I got in porn. they squeezed me and jamie brooks in while they were waiting to shoot chunky gang bang. haha i loved it. not the bit where jim said "ew thats gross what did you eat." that part made me really sad.

There are so many porn chicks now no one really notices when they go missing. Plus we have better pharmacuticals to ease the pain away.

The joy of my life is I don't think anything to much.

Soopergriz writes:

Max Hardcore has twice been sued by his starlets, I believe Olivia and Allysin Embers. Allysin Embers' allegations were that she clearly asked him to stop and Max directed the crew to keep filming. I have seen the Allysin Embers scene, it is a mock rape on the beach in France, and it is pretty hard - who am I to say whether or not it was consensual. I seem to recall that this case was thrown out with evidence that she shot other scenes with her 'rapist' afterward. I don't know what happened with the Olivia suit, but notably Max pulled the video and reissued it without the scene, which suggests a settlement of some kind.

Kevin Blatt Claims AVN 'Raped And Pillaged Webmasters'

KB (brother-in-law to Jennifer Rosenblatt) writes on GFY:

I personally think that as long as AVN thinks they own the internet they'll always have a perception problem. When AVN came in and bought IA 2000 they didn't offer the webmaster anything of great value- they just upped pricing and raped and pillaged the webmasters. Yes we had some great shows out of them no doubt, but in the end at what cost to us? I think any company that wants to promote shows or a trade magazine should have 1 very important thing- TRAFFIC. Or at least the knowledge of how to get it, retain it, and market it- So far I don't know of one person at AVN that has ever owned or run a successful paysite- that is their biggest problem.

If I wanted to write for JAMA- ( The Journal for the Medical Association) you'd bet your bottom dollar I better have practiced medicine somewhere or went to medical school.

Why should it be any different when discussing the web- I loved TOM HYMES he was a great writer for AVN and took the time to learn things about the web that not many others really cared to learn- but at the end of the day....you think Ron Levi or John Bennet read anything they wrote and took it seriously?

Aly @ AVN replies:

Good lord, KB, perhaps if you actually started reading the magazine you'd learn something yourself! Like, for example, that the very useful information presented to readers in the last two issues is offered up by respected and successful leaders in this industry. They include, your good friend J$tyle$, Me, Eric Matis, Mark Gallione, Chandie Foster, Scott Rabinowitz, Derek Meklir, Eric from Gamma, Lars, Brock MacKenzie, Jack Mardack, Matthew Sclier, Gary Olen, Kevin Ho, Mike Price, various attorneys... I really could go on and on, but perhaps you should start looking at the magazine again before you pretend any further that you have the slightest idea what's going on.

JaceXXX writes:

i was told recently about a buddy of mine that called lawrence walters and wanted to hire him to do some work...my buddy was told that he was not even allowed to speak with lawrence until a $1400 retainer was paid....then my buddy would have to pay whatever other retainers were necessary for the issue...so basically, lawrence has a speaking fee, you can't speak with him unless you pay the fee...

KB responds:

Aly dearest- I read all your magazines- At least what I can in between all the ads- I recognize two of the people you mentioned as serious players in this biz- Mike Price and Kevin Ho and yes I have read both of their articles. I think there is a big difference between getting company reps who make $20,000 a year to write for you for free - and having TRAFFIC.

XBIZ is owned by a webmaster [Alec Helmy] who is known for his scruples in this industry- it also so happens he has run a very successful affiliate program for a very long time GIGACASH. I think if you read their magazine more closely you'll see what the webmasters really and truly want- REAL ARTICLES from REAL WEB OWNERS and PEOPLE IN THE KNOW and not just GREEDY ads- If you told me that Grim SHawn was writing for you next month with Porn Daddy - It wouldn't surprise me in th eleast.... You are forgetting my sister in law was responsible for selling all the ads over there- and I yelled and screamed at her that AVN sucked the entire time she worked there as well. Don't believe me? ask her. Of course there aren't as many ads these days...

Aly responds:

It's not about the show floor, and it's not about keeping newbies out. I've had quite a lot of positive feedback from a number of people who are very happy to pay that for the new show format.

On a side note, and I realise this may sound picky... I'd really appreciate it if people wouldn't misuse the word 'rape' quite so much. It's a different level of violation that shouldn't be diluted by misuse.

Dave Cummings writes:

I think that porn side of things and the Internet side of things are both part of the Adult Industry (just like Gentlemen's clubs, etc also are). The porn video side has websites, uses VOD as "distributors", etc, while the Internet often uses porn stars for signings/appearances/etc as well as gathers content via porn-type shoots for their web sites (and, aren't some sites now even distributing/licensing/selling DVD's of their content shoots?), etc. I think we're all inter-twined, and I think it's a positive thing. I think it's healthy for all of us to have AVN encompassing the entire Adult Industry.

KB writes:

Also let me say that my good buddies writing over at AVN never owned or ran an adult paysite or worked in a position that gave them 100% access to their backends- this includes you and Farley who is the publisher of AVN Online- Derek Meklir is a great marketing guy no doubt- and Lars is a marketing wiz as well- HOWEVER- I recall the day Scott Rabinowitz got into this business, and I recall the day Chandie came back from her 4 yr hiatus away and asked me for my help in finding her a job- Now she is revered as the next David Van Der Poel? Give me a break- I love Chandie don't get me wrong- but half of these people do what they do for AVN for FREE PROMOTION- just like J STyles told me he'd be writing for you guys to promote his business- seems pretty cut and dried to me. When AVN wants a real professional to write a column for them tell them I am available and my price is $500 an article TIME =MONEY Anyone writing for free is just a GOAT looking for a FREE OUTLET and is using AVN for all they are worth, and these days it's not too much...

This discussion just ended. Have a nice evening.

Kevin Blatt writes:

The biggest problems I have with AVN are:

A). They have me on their mailing list as KB from TripleX Cash I haven't worked for them in almost three years...this tells me their information is old and outdated.

B). They fired my sister in law with NO CAUSE and still owe her a GRIP. Never gave her an accounting of her commissions and fighting a woman who is expecting to give birth in a couple of months.

The owner Paul Fishbein told me in an email exactly 1 year ago that she was like a sister to him and this was like a divorce - and that she'd get very penny owed to her THAT HAS NOT HAPPENED.

My sister in law has been very upset by their actions, and that causes my entire family to be upset as well. When you f--- with my family- you have a major problem with me. PERIOD.

If AVN is such a powerhouse and has made a gazillion dollars over the last 9 years than the right thing to do is for them to PAY HER- not fight with her After all, she helped the owners of AVN to millionaires. Now all she is getting is aggravation. AVN needs to pay up to look good in my eyes- they breached an agreement and now are playing games. I have absolutely nothing to gain by posting this information only have something to lose...but obviously I have come to the realization that AVN does NOT put money in my pocket- WEBMASTERS DO. The same webmasters that come to this board, the Phoenix Forum , The AWE shows, the Webmaster Access shows, and the Cybernet Expo- Sure Internext is a great time and an excuse to come see many webmasters- but I see enough of them at the Players Ball- which by the way will always be at the same time as their show - and will NEVER AGAIN BE AFFILIATED WITH AVN.

I am through being a nice guy - I am going to continue to expose all the filth in this industry from now on- I have realized many things in the past two weeks- I am my own man- I promote in a way that is effective for me and the companies I represent. I am too smart and far too creative for this business in many ways and most importantly I have an exit strategy. I have decided i will be leaving this business one yr from today and will be off doing my mainstream ventures- I am adding a few more clients to my portfolio for the next year and will be aggressively blowing them up You won't see me being a goat for anyone ever again- I am my own person - a good person, and one who deserves better than pissing with dysfunctional assholes who are not real business people. Like me or hate me- you will READ my posts and you will send traffic to my programs... WHY? Because I represent history in this business, and represent great companies that deserve to be recognized.

How come I knew that Red Light was winning the award for Best Selling DVD in July of last year when the voting process didn't come up for another couple of months?

I don't think anyone votes for Best Selling DVD. Those are numbers compiled from surveys and the One Night In Paris was clearly going to win.

AlienQ writes: "Damn KB tell us how you really feel! I am gonna step away from this thread for a while, to hot for me."

KB writes:

You are damn right there are a lot of serious reasons.

A). All my friends who I have personally helped in this business have either turned on me or my family and have given absolutely no indication tha tthyey are thankful.

B). I have spent the last three years fighting for what was owed to me by several web companies who tried to f--- me- 2 of them I obviously cannot mention due to legal s--- I signed. I have successfully sued two companies who were SHAVING and stealing from me- I caught them with their hands in the cookie jar and nailed their asses to the wall- I have negotiated the sale of several companies- only one webmaster took very good care of me- THANK YOU RICK MUENYOUNG - ( original owner of YNOT)

C). I was the one responsible for making Paris Hilton an overexposed whore, helped my buddy Rick and Red Light to sell over 700,000 copies of a DVD that I got 0 bucks for other than my monthly retainer from Red Light

D). I have been blocked from many high paying jobs in this business by some people who have no clue what I do or how I do it- they simply fear anyone with a head on their shoulders and anyone who is smart enough to find out when something doesn't smell or look right

E). I am constantly barraged by morons on this board and elsewhere who have no idea that they are talking to a 36 yr old businessman who was corporately trained by Fortune 100 companies such as Reynold's Metals Co AT&T, and Nationwide. It's hard to really bite your tongue sometimes.

F). I am always being measured up to my brother in this business who has absolutely nothing to do with my business- he did get me into it and we do promote the Players Ball together, but other than that we haven't worked alongside of each other since our partnership with Homegrown on IOU/ Amateurfootage.com 7 yrs ago.

G). I am sick and tired of watching people who have serious drug problems and make $20,000 a yr come to shows and to boards with an attitude like they are a millionaire and don't care about anyone- they just need to join this f---ed up fraternity we call the online biz.

H) I am tired of making others look good- and making millions of dollars for people who tell me i'LL BE REWARDED HANDSOMELY and then disappear.

I). I will be repping companies that have only the best intentions from now on and are not bulls---- only programs that give webmasters some intrinsic value. I am ending on I- because that is the only person that matters in this business. I will spend 1 more year working my ass off for whomever wishes to have a solid rep who looks out for their company.

Genesis Skye: No Call, No Show, No Woman, No Cry

Mandy Taylor, who discovered Genesis Skye, posts on XPT:

How freaking lovely. Was supposed to be here at 3pm... now 4:30pm and still no call. Costed us all money over here.

Yeapeers..... That's why I'm in such a great mood right now.... I normally wouldn't post about it but hell thought such betrayal that I felt the want to.

I have come to the conclusion she is rude and inconsiderate. And as far as I am concerned our friendship is over. Friends dont f--- over friends. Oh well I have plenty more.

Monstar asks Mandy: Does this change your outlook on the Missy Monroe thing?

Mandy responds:

Doesn't change what I said about the missy thing in the least. Everything I said was true. And I never saw her do anything but pot and whippits.

She is most likely partying yes..its her birthday... her 21st.. what she is doing I have no clue. Would love to hear the excuse though. And I am 45mins from where she is in Wisconsin and she has been to my house and its a relatively short drive.

She knew people were taking off of work and driving 4hours to shoot today just because she is in town. She called me needing $$.

Valid reason from her? hehehheheh Thats being optimistic! Her laundry list of reasons are usually... I slept to late... broke up with boyfriend...phone died... car problems... traffic. She has always been late but has never no call no showed till now. But I doubt theres a good reason. Oh and the time i was locked out of her house and had to sit outside from 10pm till 9am... She couldnt be bothered to answer her phone during the whole time bc she was partying... good reason!

All I know is i have NEVER EVER been booked for a shoot and cancelled or missed it. I have always managed to be where i am supposed to every day for the last 4yrs of my tiny career. I may not do alot of movies but I do about 4photo shoots a wk on average for the past 4yrs.... Amazing how i make it to them.

I can assure you she is fine and healthy and living and is just being a huge immature ass and not calling and doing what Genesis does best. If she was in a garbage bag right now I could prob careless. Im not about to deal with the "Im a porn star and a princess" and cant make it.

Phasion is the one who put it together. Mr. Johnson just happened to be a part of that s---. You feelin' me?"

Duke: "Yeah."

Tone: "I'm quite sure that no documentary part of the DVD is going to get the award. I'm quite sure that it's the f---ing in that movie that got that award. So s---, so we at the bar [in Las Vegas in January], me, C--tree, and Phasion, me and C--tree and Duane Cummingz are in the movie. I have a scene up in there, you know what I'm saying?"

Duke: "Yeah."

Tone: "Tone Capone the Black Corleone. You know what I'm saying? We're at the bar, you know what I'm saying? Me, C--tree and I didn't see Mr. Johnson, but he happened to ease by us with that award he supposedly snatched from Gabor. He walked past us. He didn't even acknowledge us. None of that s---. You know what I'm saying? C--tree, like, 'Johnson, you don't see us?'

"He turned around, oh man. You know what I'm saying? What's up man? Thanks for this award. Thank G-d, man. Thank G-d, man.

"We're like, cool, man. Why don't you buy a nigger a drink or something? Let's celebrate. You know what I'm saying?"

Duke: "Yeah."

Tone: "[Mr. Johnson says] 'No, man. I gotta go, man. I gotta get out of here, man.' You know what I'm saying?

"He's prancing the parade and he got away from us. You know what I'm saying?

"And that s--- had me hot."

Duke: "Right."

Tone: "You know what I'm saying? Because motherf---ers didn't get no recognition for that s---, acknowledgment, or none of that s---. He just snuck off with the fake award. You know what I'm saying? That fake-ass award. You know what I'm saying? But it's all good though. F--- Johnson."

Duke: "So Phasion was the real director?"

Tone: "Yep."

Duke: "How long you been in the biz, Tone?"

Tone: "I've been in the biz for like two years, man. You know what I'm saying? The most underrated nigger in the industry. You put that on that website. You know what I'm saying? The most underrated nigger in the industry. You know what I'm saying? But it's all good, though."

Duke: "How many scenes have you done?"

Tone: "S---, I've done over 40-scenes. You know what I'm saying? You can go to iafd.com and check me."

Duke: "Who's treated you best and who's treated you worst in the industry?"

Tone: "I'm just going to say it like this, man. This is a shady game. You know what I'm saying? But my boy, Mike Metropolis, looks out for me. You know what I'm saying? He stays in there with me when I was f---ing up. But now I'm back and you know what I'm saying? I'm 100% strong in this s---.

"I got a scene in Pimpfomation XXX with Sunshine. An anal scene."

Duke: "What was Mr. Johnson doing in Pimpfomation XXX?"

Tone: "Man, I don't know what the f--- he was doing because I never even met the motherf---er until in Las Vegas. You know what I'm saying?

"When I did the scene, I didn't know what the f--- kind of movie it was going to be or none of that s---. You know what I'm saying? That's how I know my dog Phasion put that s--- together.

Outrage Over Animal Killing Porn

Photographer Holly Randall posts on XPT:

I love animals, and I think it has a lot to do with the maternal instinct that most women have. Biology has made women into mothers automatically. My boyfriend and I were driving home from dinner the other night and I saw a stray dog crossing the street-- I screamed at him to stop so we could pick it up but he told me I was nuts and kept driving. He was probably right... I've already got a dog who is totally crazy, I don't need to adopt another one!

Help me posts:

Only in porn is it acceptable to stuff 2 cocks up a girls ass until she's a bleeding mess, ram a few down her throat until it ruptures, pump a few gonnorea and chlamydia fillled loads in every orafice possible, and then tell her she's on her own to pay the medical bills. And if you get hiv the industry will then print unflattering pictures of you, call you a skanking whore, and forget about you before the next scheduled shoot. But god forbid you do any harm to an innowcent buffolo that was raised in captivity for the sole purpose of being hunted by someone willing to pay the money to pull the trigger.

And now everyone is contacting PETA to get on this companies case.

If PETA had any credibility they would go after the porn industry that treats HUMANS like nothing more than disposable animals.

IS it just me or is the idea of porn producers calling for the ETHICAL THREATMENT OF ANIMALS, just a little bit hypocritcal considering how they treat human beings.

And isn't even funnier seeing these posrn starlets crying about these poor animals but doing nothing at all to help the abused(not all porn people are abused) humans in their own industry.
And AVN is still running ads for videos shot in brazil and other places by talent who then come back to infect their coworkers here in porn valley.

If half of the people in porn cared about humans half as much as they cared about these animals then maybe their critisism of this company would have some credibility. But standing up for animal rights while remaining completely silent about the rights of human beings is the epitomy of hypocrisy.

How much money have porn people donated to these causes? How much money have any of these people put up for those infected whit hiv in your industry? The answer to the second question is very close to absolutely nothing.

Now if you will excuse me i'm going fishing. And yes, I am going to kill those fish, and barbque them in a light lemon sauce with a hint of garlic. Maybe I'll even videotape the cleaning of the fish.

For the record, I too find this type of entertainment disgusting and worthy of all of the critisism that is being thrown at them. But lets get the priorities straight here people. In pron it seems that animals are worth more than humans.

Speculation About Skeeter Kerkove

Smiling Arab writes on XPT:

But from what Luke writes (and some anon posters have hinted), Skeeter no longer lived at "home" with Brigitte prior to this happening.

I find it strange that everyone jumped to the suspicion (James, of course, was needling) that he's "on the run." Luke could answer this with a simple phone call to the LAPD. He could not so much be on the run as much as (a.) separated from his wife; (b.) facing financial ruin; and (c.) having his income taken away.

As for a condition of parole to stay away from porn, it's doubtful. His real last name is Kerkove. His Meagan's Law page indicates that "Skeeter" is a known alias. If he was trying to hide, Christ he was doing a horrible job of it.

What I find funny is that people have tap-danced around his (estranged, it seems) wife. Some of the most irrationally malicious, hateful people I've never met are "former" (and the former can mean a manner of hours, or minutes) lovers. Who's to say she didn't decide to finish off his reputation? Who's to say this wasn't meant to deprive him of income in addition to the fact that he'll never obtain custody of his children outside of, probably, supervised visitation? There's been practically no speculation at all as to who fed xxxporntalk this information (I don't know if it was posted anywhere else as well).

The one problem with this theory is that it's not very smart, since there was no big hoopla about their break-up and most assumed they were still cohabitating the same domicile. But pissed off spouses aren't the most logical creatures; pissed off porn spouses, probably even less so. But if she's angry enough to have done this, it follows that she'll eventually out herself. I have no clue how many enemies he had outside of Monkey.

'Congratulations, David Joseph'

Rob Spallone tells me: "Who gave you the story about Elegant Angel and Red Light? That Red Light is buying Elegant Angel?"

Duke: "I just said that Elegant Angel has been sold."

Rob: "That's not true."

Duke: "I believe it is."

Rob: "I'm 100% positive. I was at lunch today and David [Joseph] from Red Light is very good friends with Patrick [Collings, putative owner of Elegant Angel]. I was with Marty and Ed. David came over. They said, 'Congratulations.' They were joking around. And David said, 'What are you talking about?'

"Ed works for Patrick. Ed knows the place ain't sold."

Rob: "I said, who said this? They said it was on your site. I said, I'll call Duke right now."

Duke: "I stand by the story. It may not have gone through officially but it is going to happen in the next few weeks."

Patrick can't wait to get rid of that company. That's why he's got no directors of note. He's cut expenses to the bone.

Rob: "That's not true."

I have comcast cable at home, and recently got "Comcast On Demand" pay service when I upgraded to digital cable. I discovered that while before all the adult movies available had been edited down to the "cable-R" style (no erections or spread shots, no penetration or explicit oral, etc.), they now offered full-on hardcore... blowjobs, f---ing, the whole nine yards, EXCEPT...

No anal scenes and NO MONEY-SHOTS! How odd... I mean, what brain- trust decided that it's ok to show a girl deep-throating a 10" cock or taking it in her pussy, but to show the guy cumming or to have him put his dick in the three-hole crosses the line into purient interest? Do they think someone is going to go through the lengthy process of clicking on "On Demand", clicking on "Movies", clicking on "Adult", purusing the list of titles before clicking on the chosen video, clicking on "confirm purchase", sit back, start watching two girls and a guy f---ing and sucking the s--- out of each other than suddenly gasp in outrage when a guy shoots his load? That they're going to call the cable company to protest? "Yes, Comcast? I just wanted to let you know that I was thouroughly enjoying 'Barely Legal Sluts Vol. III" when suddenly the guy actually had an orgasm on screen! You could actually see the seman squirting! I'm shocked and disgusted! What kind of degenerate s--- are you guys showing??? I'm calling my congressman! Cancel my service at once!"

It's laughable what a tight-rope these Fortune 500 companies walk while trying to maximize their profits while at the same time trying to cover their asses... it's also amusing to picture the committee meeting that decides what they can and can't do. "OK Fred, gang- bangs with up to four guys are OK, but five or more is right out." I fail to see their logic. Do they really believe that by not showing anal or pop-shots that it's going to protect them if some overzealous prosecutor decides to make a name for himself?

And here's an interesting aside. No cum shots, no anal, but fully 40% of the available titles were of the "barely legal" genre... Hmmmmm...
