HIV-Positive Performer Shuts Down L.A. Porn Industry

A porn actor’s positive HIV test, which prompted a  temporary shutdown of Los Angeles’ billion-dollar  adult film industry Monday night, has reignited the debate over mandatory condom use in X-rated productions.

The HIV scare comes less than one month after the launch of a new online sexual health database aimed at preventing the spread of sexually transmitted diseases among porn actors through mandatory testing. To be listed in the database — a requisite for getting work — porn actors must get tested every 30 days and present a clean bill of health. But critics say routine testing does not prevent STDs from creeping in.

"Testing is not a substitute for condom use, and it never will be," said Michael Weinstein, president of the AIDS Healthcare Foundation in Los Angeles. "No test can detect HIV from the moment of infection. There will always be a window period," which might not reflect recent infection.

The Free Speech Coalition, the industry trade group behind the database, announced the positive HIV test and requested the voluntary production moratorium Monday. A spokeswoman did not immediately respond to ABCNews.com’s request for comment.

The positive test results will be confirmed by more sensitive testing methods, but details of the case, including the performer’s name, age and sex, will not be released. It is also unclear how many sexual partners might be at risk.

"The average American male has seven female sexual partners in a lifetime. But it’s possible for a male to have seven sexual partners in a single day on porn movie set," said Weinstein. "Because this is a network that’s kind of inbred, the spread of disease could be exponential."

The AIDS Healthcare Foundation is pushing for mandatory condom use in the making of adult films — a move that’s met with strong resistance from the industry itself.

"If the market would accept condom-positive movies, that’s what we would all be making. The fact is consumers don’t want that," Christian Mann, general manger of Evil Angel Productions and unpaid Free Speech Coalition board member, told ABCNews.com when the database launched.

"The market will always trump regulation," said Mann. "If you make it so California-based productions cannot compete in the market, you’ll just drive production out of the state."

But Weinstein insists that worker safety should not be optional.

"You can’t dangle from a 30-story building from a rope; you have to wear a harness," he said. "The idea that hurting these performers is a matter of freedom of expression is simply wrong."

    Note that he calls this an “outbreak.”

    An outbreak means multiple (related) exposures within the industry. Someone working as a performer and also coming down with HIV does not an outbreak make. That’s an instance, not an outbreak.

    There has not been an actual outbreak in 7 years.

    The testing is not even complete in the instant case, so how can he call it an outbreak? Because he’s WISHING FOR an outbreak.

    This is the organization that DESTROYED the health clinic for the adult industry. And now they seem to deny it. For God’s sake, they PICKETED in front of AIM.

    Weinstein also repeats debunked LA County numbers (which LA County publicly backed away from in the LA Times) when he claims that this is “thought to be the 23rd industry-related HIV case since 2004.”

    Finally, Weinstein accuses FSC of a crime — obstructing the health investigation in LA County. There IS NO LA COUNTY INVESTIGATION in this case.

    Lies, lies, lies and grandstanding.

The talent is generally unstable and uneducated that they escort which is highly risky, have unsafe sex in their private lives, hence condoms need to be mandatory. end of discussion. I fully support weinstein. Again if you saw what types of sexual acts these girls performed during escorting to strangers such as swallowing, bare back blow jobs and i am sure bare back sexual intercourse.

Maybe the reason why so many porn girls go to escorting might be due to the bad economy forcing them to seek alternative sources of income other than shooting scenes or running websites. But whatever the motivation, even they have the right to practice what they do safely. Why not decriminalize all consensual sex work and give them more resources to be more safe, rather than crack on them?

    And I really, really hate to break this to you, but “bareback blowjobs” are the default for damn near everyone who engages in sex. Condoms are swell for PIV and anal intercourse for protection against pregnancy and STI, but for BJ’s they are essentially ineffective, since oral sex is not the main transmitter of HIV or any other STD. Plus, condoms aren’t very condusive to decent blowjobs, because they just don’t taste to well. Ask any woman who has done a hummer.

    Bareback sex between partners who are clean will not spread any diseases. That is proven FACT. Testing, isolating and treating those who are infected is a far more effective approach to STI protection, with respect for and deferrence to those who want to use condoms as a backstop being a reinforcement. Simply mandating condoms while eschewing testing is a recipe for disaster…and a complete lack of common sense.

    I think some escorts are careful and take precautions – however many do not – that I know for a fact.

    For the porn industry to be seen as TRULY caring about keeping the risk of STDs (mainly HIV) low, I personally feel that every porn studio and porn agency needs to agree to not book or work with talent that openly escorts or participates in rings such as TheLuxuryCompanion.com

    If the studios and/or agencies don’t (or won’t) care about the public health risk, then I think the testing facilities and organizations like APHSS need to put their foot down and agree not to grant database access to studios and agents who represent or work with talents who have an issue with making a solid choice between being a porn star or an escort.

    Just like “crossovers” are being asked to pick a “side” – I think all talent needs to decide right now whether they are going to be an escort – or a pornstar.

    You can’t do both – it’s just not safe.
