Why Can’t we just Name Names in HIV Scare?

Because the law won’t let us. When AIM named the HIV positive person and the quarentine list in 2004 they got sued because they were actually giving out medical information which you are not allowed to do. They paid a lot in that lawsuit.

There are a lot of names floating around and who did it with whom and at which studio. It’s almost impossible to confirm anything. The one way to tell there is a problem with someone, that they may be on the quarentine list, is that their name will be missing from the AIM database.

So by process of elimination, if we know someone’s real name we can look them up and if they are there, they are NOT involved ( so far) in the chain of partners.

BUT The chain of partners is only gotten by asking those who have been found so far, who they had sex with. If they are not honest, or if they don’t remember, or if they don’t know the names, the list of those quarentined will not be complete.

I have often asked people during interviews, "Who was that scene with?" and they have answered that they didn’t remember or they didn’t know the name of the person. So finding this chain of 1st & 2nd generation is not as easy as it seems.

This is how it works. Patient Zero has sex with people. These people become the 1st generation because they had direct contact with the infected individual. Those in the 1st generation ( who didn’t yet know there was a problem) go out and have sex or do sex scenes with more people who become 2nd generation. And this can go on until the HIV positive individual is notified and all the sex going on is shut down until everyone is cleared which can take from a couple weeks to a couple months for those in the direct chain.

To make matters worse, I can’t legally tell you anything that i know because any description of anyone ( you notice that AIM didn’t even say male or female this time?) can get me in trouble. And it was AVN, not AIM that told us their source said it was a male who worked in the gay and straight industry.

MikeSouth.com gave the name of patient zero and then two posts later said that it was not him. It is also scary with rumors running all over the place that you name someone and get it wrong.

If I tell you that someone ISN’T on the quarentine list, and further down the line we find out they are I can get sued for that also. SOOO unfortunately I can tell you nothing. I can’t even give you clues. It sux. I am sorry.

I believe that because of the danger in our industry that AIM SHOULD be allowed to release the names, and they should be exempt from that portion of the laws. That is why when you  go for blood tests you sign a paper saying you give permission for them to give out your information. BUT I believe that paperwork was also ruled illegal. Which is why Darren James sued and won.

    Why is what’s labeled as AIDS in Africa equally distributed amongst the sexes there while in the Western world it’s more often than not still a gay/bi/transgender guy’s disease? Aren’t these two things self-evidently epidemiologically different as day and night?

    How the fuck do they label so many previously existing, old diseases under one “syndrome” as “AIDS”; kaposi sarcoma, diarrhea, cervical cancer, etc?

    Is HIV = AIDS a scam?

    Regardless, do some guys choose to do gay and tranny work because on average they get paid quite a bit less than women and “need” to? I guess they could be doing gay escorting, too since sugar-mommas are not as often an option.

    I don’t think HIV / AIDS is a scam, BUT the more I’m researching the more I’m noticing that it’s a “scientifically valid justification” for discrimination on quite a few levels.

    Personally I think the AIDS thing, as it’s called, has to do with, not a virus, but behavior. Doctors with advanced degrees have duly noted that there is a correlation betweem the open gay lifestyle explosion in the 80s which included lots of poppers, other drugs and multiple sex partners with what was then called GRID (gay related immune dificiency) and immune suppression. Now take into account Bob Gallo was convicted of scientific misconduct and now admits that HIV needs a ‘co-factor’ to cause AIDS, take into the account the millions of dollars that goes into the pockets of researchers and “non profit” organations (such as AHF, where the workers have an average salary of 100 grand), and go figure that we are only being told what that want us to here… “epidemic”… “we save lives”… “send us more money so we can save yours”, blah, blah, blah…

    what is correct is that aim never took the time or made the effort to implement the legal means to address the privacy rights issue…it CAN be done…its done every time you visit a doctor.

    with that being said, HIPPA does not allow you to say who has what and what not. Patient doctor/confidentiality…

  8. I’m a medical assistant and studying phlebotomy and man HIPAA is constantly drilled into your head.

    If you sign a release when having a test at AIM then there would be no violation of releasing the name but in the medical field HIPAA is taken very seriously since medical personal can be fined for disclosing shit.

  13. well when you get tested at AIM you sign a waiver allow the release of your test results. So is that waiver not valid? I just got tested today and signed agreed to it since I test in Florida at a “draw station” and have to go through all the legal shit on web pages rather than paper.

    I don’t want to say something that is going to offend anyone, for a change I know, because generalizing an entire group of people isn’t fair but it’s flat out FUCKED UP that guys are doing gay and straight scenes. If someone can name me one infected person in the industry who didn’t get it from someone who did gay movies I’d love to know who that person is. Marc Wallice did gay escorting and did gay scenes which I just found out. He tested positive right after I got in the business so I didn’t know him or much about his situation.
    This is a sad day and it’s fucking up people’s lives, with the loss of income and the thought in the back of your mind wondering if you’re on the list and what how your test will come back. I got a lot of shit for openly saying I won’t shoot with guys who do gay / tranny scenes but look at the track record of those who have been infected and I’m more than happy with that decision.

  15. I don’t know about AIM since I’m not in the industry or know the privacy laws of Florida.

    But generally if you have tests they are kept private. Your information is not to be released unless you give permission. Do they make you sign waiver in California at AIM? Did you have to sign waivers in Florida? Are the names to be released to only certain people or the general public.

    As someone who is soon to be certified in phlebotomy I am honestly curious. 🙂

  17. when you are signing a release of information, it says who can read it I.E AIM is JUST a release to put on the database, which doesn’t make it public record..

    A doctor can have you sign a release to send info to a specialist but it can’t go any where else..

    I am sure florida does the same.. HIPPA rules still apply

  19. I don’t know the circumstances of Darren james getting the disease, but in Brazil the tranny niche is HUGE and who knows what REALLY was shot there and if that girl had shot with trannies in the past?

    All I know is that it makes everything far higher risk which is my biggest gripe about it along with escorting especially without condoms…but we’ve done that topic to death and no one will change their minds about that. Marc Wallice did gay escorting so who knows really?

    I do blame the producers as much as anyone, but girls have a right to a “No List” but many don’t give a shit as long as they get their rate which is sad.

  20. Privacy laws in FL are governed by federal HIPAA regulations. Even when working in addictions tx, I couldn’t give full disclosure to the drug court without expressed client consent (waivers).

    I in 5/02 received notice from Tampa General Hosp. that AIDS tainted blood was given during the time that I received a transfusion. The letter stressed “privacy…confidentiality” but I was greeted at the testing site by the local ABC news affiliate.

    While elated to test negative, my heart broke for the 23 yr. old who not only tested positive but was outed by the news crew and later participated in the TGH press conference.

    TGH administration said a “standard press release” was issued per the tainted blood but names of those potentially exposed were confidential. However, doesn’t forwarding testing time and dates to the press negate HIPAA’s purpose?

    I fully appreciate both sides of the coin: a need exists for initial privacy but ultimately, as in mass exposure from tainted blood or within the adult industry, one should come forward.

    I respect those stepping forward; the veil of supposed shame and stigma lifts and the voice of experience often speaks louder than textbooks.

    My transfusion followed my kid’s birth and the letter is in her baby book; talk about a sign of the times.

    This whole event is really tragic. As a consumer people think I just don’t care but porn is not worth ruining your body.

  23. I had a no list, every girl should, didn’t spare me from the HIV outbreaks, close enough to the fire without getting burned. You can’t release test results publicly, that person may face retribution, further discrimination, and at the very least will be denied insurance for the rest of their lives. There’s a reason for the law. I was also at the first attempted union meeting at Shane’s house, and the creepy attorney put his hands on me in front of everybody and everybody saw me jump and he was no longer welcome. Porn will never have a union, scab labor is too easy to find and lets face it, most young performers aren’t the sharpest tacks in the box. Yes origen they will never force regulation on million dollar companies because the state of California makes a lot of loot off porn, they and the comanies consider talent acceptable casualties. OSHA will not impose manditory condoms because the way scenes are shot(sloppy facials) I don’t think the risk would be diminished and then I can just hear the arguement now” why should we test when we have to wear condoms?” The only way to diminish your risk is to have a small group of people who only work with each other,and test frequently. And for someone who actually was at the first and only union meeting, if it had continued I guarantee we would have been frozen out by the large companies easily.
