Desi & Ellie Foxx have filed a lawsuit against AIM for lack of privacy concerning their medical records and deceptive practices.
Seems like they just can’t stay out of the headlines. Missing the spotlight I guess, and the money. "They" held a press conference at the offices of, surprise, surprise, AIDS Healthcare Foundation!
According to a story on Xbiz– “Once I was in the adult industry for a while, I realized there were several issues that weren’t being addressed,”" Desi" said.
"Desi" says that in order to work, she was tested several times at AIM. She was required to pay for those tests and had to sign release-of-information forms. She says AIM then made her test results available online for adult producers.
“With this lawsuit,” Desi says, “we hope to stop AIM from violating our and other patients’ legal rights.”
NL- (I will preface this by saying it is only a rumor but I have 1st hand emails to back it up) This is one of several cases where AIDS Healthcare Foundation finds "victims" and offers to "help" them if they back AHF’s causes.

You can’t work in Adult films without an Aim test. If you’re a performer, you owe it to other talent, the companies you work for and yourself, proof that you’re disease free. I didn’t know this at first but Desi and Elli are suing because their medical records were made public. Desi says they were posted on a popular industry blog this February. I don’t remember any blog posting anyone’s medical records. After everyone I’ve contacted, many now seem to think she meant to say FORUM, not blog. AIM has exercised NO CONTROL over the people that they have given this access to. Maybe someone should go on that database and post all of your test results. The next day I read a news article further talking about her lawsuit and she said her medical records were posted online on a popular industry blog back in February. The DAMAGES are punitive, somtimes calle exemplary damages……..”To reform or deter the DEFENDANT(aim) and others(like the prick who posted the results)from engaging in conduct similar to that which formed the basis of the lawsuit.
Punitve damages are often rewarded where “compensatory damages” are deemed an inadequate remedy. Punitive damages are awarded usually under tort alw, where the defendants condust was egregiuosly insedious(releasing private medical information easily falls within this limitation)
In calfornia, punitive damages are determined by statute, not by case law. And the statutes in the state of calfornia on punitve damages, and releasing private medical records are CRYSTAL clear.
And the person who posted these medical records, when,not if, he/she is identified is in for one hell of a lawsuit too, and criminal charges. AIM may also face criminal charges, and which ever doctors name is on those results that are being given to anyone who makes a monetary donation to AIM, is also going to face major problems with the medical ethics community.

Test99 is the master account at XPT which only the higher ups at JM Productions have access to. I thought it was his wife. 1. The lawsuit concerning Diana and Elli is not about a forum or blog – it is about AIM giving copies of the AIM test results to producers/directors, specifically over the web. The testing database is open to directors and producers who have paid and joined as official industry members to receive that information. Yes – everyone is still supposed to bring a copy of the test with them to the shoot, and it is then photocopied. However, conscientious producers/directors want to check if everyone is on schedule for their tests, so they don’t get nasty, last minute surprises and have to book new talent at the last minute. It is a system that works for the most part, as long as everyone does what they are supposed to do and doesn’t try to cut corners or cheat.
This lawsuit isn’t going to shut AIM down. If anything is going to shut AIM down, it will be lack of funds and their continuing bad press and public relations skills. The lawsuit will most likely just cost a lot of money for AIM, simply to have it thrown out of court as frivolous. That’s what AHF wants — nuisance suits to take everyone’s mind off the fact that they are also a testing clinic and that they could make a nicer profit by being THE testing clinic for adult.
