Risi Simms an Underage Runaway?

According to a strange Myspace posting, Risi Simms is an underage runaway working on the porn business. She is allegedly using a fake ID.

I don’t know if the post is true, or just a jealous ex-boyfriend trying to start trouble, but if true, it could be a world of trouble for studios.

    First let me state this for you. I am not giving you definitive advice as a lawyer or legal council on this issue.
    I am someone who was going to work with [RISI SIMMS] and caught the issue of proper identification before it had an effect on me and my business. I am currently suffering no damages and simply felt an obligation to notify any agents and industry contacts that may have worked with her as soon as possible.

    This information is being provided for your use and for informational instruction. I make no warranty for the absolute validity of this information. I can only say that what is written here is understood to be fact by me and a few other knowledgeable sources. Despite Renna Ryann’s claims to have seen a valid scan of Risi’s ID no such scan has ever occurred and no card checksum has been recorded. Risi Simms has not ever been verified via a card swipe. The only card swipe recorded for her was done using someone else’s ID on a scanner that only works for Florida and it was turned away from the camera to avoid showing the actual owner. The reason for this was that a Florida card swipe was used and she was using a fake New Jersey ID that could not scan. The lack of an obvious card swipe is an anomaly for the site in which the content is posted. Her content is the only content on the site that lacks an obvious swipe with clear visibility of the card owner being processed (thumb over address and name info). Risi Simms herself (when the card swipe failed for her ID prior to clearance for working with me) stated that when failed swipes have occurred in the past she would always use someone else’s card to get around it on video. Risi Simms has been contacted numerous times by various parties to confirm or deny the allegations and has not yet responded to any questions.

    Now for the bad news:
    Unfortunately it is not likely that you can prosecute a minor who has signed contracts which they are not legally able to sign. In the state of California, particularly in regard to labor law almost no contracts are legally enforceable even if signed by an adult. The same can be said of release documents. Since the porn industry already exists on grey area law and loop holes, it is best not to push our luck too much in regard to reclaiming questionable content. In particular it is wise to weigh out potential losses verse cost of legal action. In particular on contracts that do not properly establish identity and that are without witness. Generally speaking the problem lies with the catch 22 of having a minor sign a contract without first properly verifying credentials that would prove the age of the party entering into the contract to be of legal status. Only when a credential is fully verified via a background check (which can only legally be obtained via a legal release) and a card swipe should you consider entering into a contract that may place you as liable for damages against a minor. In short if the card doesn’t scan you cannot verify that a signature is enforceable and valid for use contractually. If you cannot verify the ID as valid nothing signed is able to be used. Then of course there is plausible deniability meaning she can just say she didn’t sign anything. If you lack verification of signature and are attempting a contract with a minor this can become messy. So as for legal action against any minor I would advise against it and just be careful next time. As a recommendation you probably shouldn’t try and sue a child it draws attention to your lack of proper procedure and eventually leads to an audit of all talent and footage.
    In the case of Risi I doubt an 18 year old has anything substantial to take in a civil suit and it has been understood by the majority of people she has worked with she is homeless. The costs of putting together a case will not yield any settlement, and no finding in a criminal or civil case will leave you with content or pursuable restitution. You cannot force Risi to make legal content as promised by invalidated contracts or as a result of your content being illegal, regardless of her now legal status, so the point is moot. Basically you can expect that any work with her is a loss. People cannot be forced to have sex for money against their will even if they have done something technically illegal but not punishable. At best you can expect that you will receive nothing for your efforts but a headache, a loss in capital, and an audit from numerous federal regulatory committees/enforcers. The Federal government loves to make examples of porn industry violations when they are called to their attention. This will likely become an example to the industry if it is not resolved quietly.

    A few questions for you: If you worked with her did you use a scanner to verify her ID? If you did scan her ID you should have the verification code (checksum) and additional information from the ID as proof. If not did you get a copy of her ID and use it with a release for a background check? Did the background check show her to be of legal age to comply with Federal laws? Were you using a location that is legally zoned for adult Industry use? If you did not completely verify all of her information prior to working with her I would advise you to review any content for proper record keeping and be ready to remove it. I doubt any government agency, or court would sympathize with someone who failed to check all available information, or verify compliance to Federal and State laws prior to having paid for the right to perform a sexual act with a minor (even if they are unaware or the age violation) for the specific purpose of being recorded by camera for resale to the public. Then there is the potential liability of either you or your other talent having sex with a minor who was transported illegally across state line. That is a Federal offense and can lead to 10 years in jail for each party involved. Endangering a minor; Delinquency of a minor; Unlawful sex with a minor. Unless you are in New Jersey you are dealing with more than just State age of consent and statutory rape laws. My advice to you is that you obtain an ID card scanner with a chip set for most of the states you work with. Most fake IDs are not able to be scanned because they lack a magnetic strip, so if an ID doesn’t scan do NOT work with that talent until the ID or background check goes through. Taking the time prior to a shoot to verify credentials saves you trouble later.

    A background check on [RISI SIMMS] shows clearly that [RISI SIMMS] has a history of mental illness and being a run-away. If her information had been properly authorized after a card swipe and a release was signed you would find her age and all supporting criminal and medical information are easily verified. The mental health status of [RISI SIMMS] is enough to invalidate her contracts. She has already been found not to be of sound mind. It is well documented in her records that she is mentally unfit, advised that she be medicated indefinitely, and that she be regularly institutionalized for long periods of time due to numerous attempts at harming to herself and others, destruction of property, extremely bazaar behavior, and antisocial tendencies. She voluntarily admits to having been prescribed anti-psychotics and other prescriptions used for treatment of mental disability/illness. [RISI SIMMS] further volunteers that she has stopped taking the medications prescribed to her against the advice of her doctors and guardians. This further complicates the issues attached to this situation because she tells people openly about all of her conditions when they are willing to listen. Like most mentally disturbed people [RISI SIMMS] is very open about all of the information above and often brags to others about it, so no one can claim that they are not aware of her quirky behavior or mental disposition. If her odd behavior and comments are not enough to substantiate the above claims several well published interviews have been given in which she speaks openly of her mental illness, criminal, and homeless status. She is also openly aggressive about her opinions of others, and of the very field she is working. This quickly shows a pattern of self-loathing and self destructive behavior as documented in her medical history. For those who have worked with her it is also well established she has a history of mental break downs on set, and vomiting prior to, during, and post scene. She is known to sometimes threaten other co-stars before and after scenes. She many times has to cancel scenes with people as a result of both physical and psychological issues related to her mental disposition and physical state. She has been hospitalized several times since starting work in the adult film industry and is extremely unstable. This is no secret and easily found out by asking around. With the criminal/medical background checks the times of cancelled appointments can quickly be correlated to times she has been in mental hospitals, or picked up by police and returned to her families care. It only takes a slightly more critical eye and a few extra steps to avoid the problems that this is going to bring up for everyone who has worked with her. Having attempted work with her and subsequently spoken to a lawyer to see exactly what could happen here are some of the possible issues that may come up when dealing with this situation. Much of the information she provides to others has potential for liable to interviewers or writers who if by submitting the unedited copy to print are accepting the liability for potentially endangering both her and her family. Due to her mental disability [RISI SIMMS] is unable to determine what a safe level of disclosure is in regard to her family, self, and friends. [RISI SIMMS] often gives personal information about her family and friends which is potentially dangerous and risks defamation and harm to others. Anyone providing most of the information she has given to them may be responsible should someone be harmed as a result of information printed that either she or other sources may have provided. It should be understood that printing anything without protective editing is a huge risk to a publication. If she gave you her personal address and phone number would you print it knowing that if she was found to be mentally unfit that you would be liable for charges of endangerment? This coupled with the obvious issues of recording a minor during a sexual act, and other related charges makes this situation a very serious one.

    This is all just something to think about.

  9. She looks underage to me, she’s built like a girl in her 15-17 y, her body is dissymetric, parts of her still developing. She taks and reasons like an underage girl (i’ve read some interview with her), she’s got that baby innocence still on her face, baby fat, and fucks like an underage girl. A little homeless girl, that had to fuck for food.
    Nobody will raise the issue, there is a lot to be lost by the porn companies. Nobody would care for some homeless piece of shit like her.

    She went to my high school (and middle school actually), and graduated with me. Although her birthday is during the late summer, she is well almost 20 years old now. She is not a close friend or actually even a friend really, but I talked to her.

    Plus, Uki, she isn’t homeless. She’s actually married now, and lives with her hubby.

    Anyway, sorry for posting on an old post, but I couldn’t resist to bust this myth. 🙂
