AIDS Healthcare Foundation Files Lawsuit to require CONDOM use in porn movies

LA Times Reports: “The petition… asks the court to order the county public health department to enforce regulations that require condom use in adult film production or take other ‘reasonable steps’ to stem the spread of disease.”

LOS ANGELES (July 16, 2009)⎯In response to the County’s inaction regarding the latest HIV outbreak and thousands of reported sexually transmitted diseases in LA’s porn industry, AIDS Healthcare Foundation (AHF) will host a press conference tomorrow, Friday, July 17th at 10:30 AM Pacific to announce the filing of a lawsuit against the Los Angeles County Department of Public Health (DPH) to require condom use in the production of pornography. 

The lawsuit was filed in Superior Court of California, County of Los Angeles (Case No.: BS121665) today, Wednesday, July 16th and seeks a Writ of Mandate “compelling the Los Angeles County Department of Public Health to discharge its ministerial and non-discretionary statutory duty to combat an acknowledged epidemic of sexually transmitted diseases stemming from production of hardcore pornography in Los Angeles County.”

AHF filed the lawsuit after exhausting all other methods to compel the County to fulfill its obligation to protect the public’s health in the wake of last month’s revelation that an actress working in the adult film business had tested positive for HIV.   At that time, AHF had urged the County to better monitor HIV and STD prevention in the region’s adult film industry—and require condom use—or to shut down porn sets.    

Since the June 17th reporting of the latest HIV outbreak—and the subsequent report by the LA Times that as many as 22 porn performers may have tested positive in the last five years—no action has been taken by the County to halt the spread of STDs on LA porn sets or to conduct the proper and legally required public health follow-up with those thought to be infected. 

“The Department of Public Health has a responsibility to try and control the spread of STDs in LA County—particularly in a commercial venue.  Despite this responsibility, 29 days after an outbreak of a potentially lethal virus—HIV—in the porn industry, the County has not taken a single step to address this serious public health threat,” said Michael Weinstein, President of AIDS Healthcare Foundation.  “As an HIV and STD medical provider, it is our obligation to pursue County action on this issue, which goes beyond just the recent HIV outbreak and includes an epidemic of thousands of STD cases in the porn industry—an epidemic virtually ignored by the County Dept. of Public Health. This is not just about one industry, but about our entire community as the spread of disease among performers endangers themselves as well as their sexual partners outside the industry.  There is no firewall between porn performers and the general public.”

The fact that the DPH is aware of the ongoing pervasive sexually transmitted disease crisis in LA’s pornography industry is well documented.  DPH has cited numerous figures confirming an STD epidemic among performers in adult films, including the fact that performers in hardcore pornography are ten times more likely to be infected with a sexually transmitted disease than members of the population at large. 

“You cannot implement effective public health under a cone of silence.  Unfortunately, whether due to squeamishness around the subject matter or plain bureaucratic indifference, silence has been the County’s only response when it comes to the rampant STD problem in LA’s porn industry,” added Weinstein.
  
According to figures cited by DPH, there were 2,013 documented cases of Chlamydia among LA porn performers between 2003 and 2007.  In the same period, 965 cases of gonorrhea were documented.  Many performers suffer multiple infections.  In the period April 2004 to March 2008 there have been 2,847 STD infections diagnosed among 1,884 performers in the hardcore industry in LA County.  DPH attributes the epidemic of sexually transmitted diseases in the porn industry to a lack of protective equipment for partners, including condoms.  The agency recommends condoms be used during production, but has never taken steps to ensure their use, or to protect the performers who are essentially required to endanger their health in order to remain employed.

“By recommending—but not requiring—condom use on porn film sets, the County is basically abdicating its responsibility to perform its main function—which is to protect the public health,” said Whitney Engeran-Cordova, Director of AIDS Healthcare Foundation’s Public Health Division.  “Thousands of STDs could be prevented in Los Angeles County with the mandated use of condoms on porn sets.”
 
The lawsuit’s Prayer for Relief states: “That this Court issue a write of mandate, directing DPH to enforce California Health and Safety Code sections 120575 and 120175 by requiring all performers to use condoms in the making of hardcore pornography, or alternatively taking any and all other reasonable steps necessary to stem the spread of sexually transmitted diseases in the production of pornography in Los Angeles County.”

“Despite a duty to take all reasonable measures necessary to prevent transmission of these diseases, LA public health officials have done nothing to combat this known, serious health threat to the people of Los Angeles County,” said Brian Chase, Assistant Legal Counsel for AIDS Healthcare Foundation.  “Not only is the County in clear violation of California Health and Safety Code, but the agency’s inaction is needlessly placing thousands of people at risk of disease and death.”

AHF has previously sought remedy for public health issues through the legal system and succeeded. Late last year, in response to an AHF lawsuit filed in Superior Court of California County of Los Angeles, a judge ordered California’s Department of Health Care Services (DHCS) to implement a landmark 2002 law intended to extend Medi-Cal (Medicaid) coverage to HIV-positive Californians. The Court ruled that the state’s Department of Health Care Services (DHCS) “…arbitrarily failed to meet its statutory duties…” in implementing the 2002 legislation.

  1. AIM is supposed to rep performers but this will only help further obliterate what’s left of the porn industry. Again, there is no ‘epidemic’. The word needs to be looked up in the dictionary. And if HIV is something to be feared, condoms don’t help because the openings in rubbers are huge compared to the size of any “HIV” retrovirus.

  2. correct me if I am wrong but the other 22 cases, were they not active performers, weren’t they people who either a) wanted to get into the jiz biz and found out they were hiv + or people that walked in off the streets and got tested, the place is open to the public is it not?

  7. I agree with Miss Biatch, in addition to what I’ve already stated here and as stated before currently the porn industry is twice as safe as the general population when it comes to contracting the mysterious and unprecedented HIV retrovirus.

    One assumes risks in anything. Living in a bad neighborhood, driving a car (which has 40-50,000 fatalities per year, plus countless other injuries), having a psycho girl or boyfriend. But this is America and it’s our right to choose.

    Performers don’t get residuals or health care benefits so this issue isn’t about helping or protecting people. It’s all politics.

    Yes, this involves only LA county, but the potential financial impacts on the bulk of the industry, which is located primarily within its borders, would be staggering should people have to relocate to continue business.

    There are more gaping holes in the AHF’s premise than there are in all of Porn Valley. In order to prove their ridiculous “statistics” posited in the suit, they’d have to give comparable – and accurate – figures for STD infections in the general population, which are WAY higher, I guarantee. Also, there is absolutely no way to verify if actual adult performers have contracted various infections from their personal contacts outside of work rather than from other performers, thus stretching the whole (pun intended) of AHF’s logic even further. We all know that by virtue of the industry’s generally careful testing process, performers are significantly “safer” overall, which flies in the face of AHF’s assertion that adult performers are a risk to the general citizenry of LA county. What total bullshit! But all of this is still highly troubling, since lawmakers are notoriously prone to overlooking the true facts.

    General, do these stats state for a fact that this number is individual performers, or individual instances, i.e. performers with multiple infections? Still bad, but potentially not completely accurate as stated. Sure, common sense would tell you that people who have lots of (non-vanilla) sex with multiple partners are more prone to contracting STIs; however, the incidences of all the other STIs you mention are anybody’s guess, and guesses – or “imagining” – are not facts. Until the proponents of such measures can come up with ironclad facts that can be broken down into specific, incremental segments, then it’s all just smoke and mirrors in a big ‘ol dog ‘n’ pony show. Anyone should still feel safer having sex with porn chicks – and I do – than the average women down at the mall.

    This is individual performers…2567 to be exact. Of these 974 had repeat infections, averageing 66 days between infections, and 435 of then had both gonn/chlam reported at the same time. And yes, the incidences of the other disesases are anybody’s guess, and I will leave that to you to decide for yourself what those numbers might be. I would think that at least an equal number have at least herpes, if not hpv, pid etc. There is a reason these tests are not ‘Mandatory” in the industry. If they were, the healt department would be going nuts over this shit. Better to not test and not report than to test and give all this information to the county health as they would be required to do. That is why the gay industry does not test and you never hear about the health department coming down on the gay industry, even though over 50% of the gay performers are HIV positive. The health department has NO stats on the gay industry, but they do have stats on the str8 industry because the str8 industry has a testing progam that gives them the information.

    The big unanswerd question really is, how many individual performers has AIM tested in that time period. Without that number then the actual percentage of performers who are infected on an annual basis is impossible to calculate.

    That old line about porn people being safer than the general population is laughable. It is a lie that has been repeated so many times that people believe it, just like porn is a 13 billion dollar industry.

    Do you think the porn industry would ever do any kind of study to see how many past performers over the years have developed cervical cancer due to REPEATED exposure to the hpv virus. Not on your life.

    Then, general, I challenge you to present actual facts to back up your statement, which is complete conjecture. Facts don’t lie, but people that lack them do.

    As you say, without AIM’s full data these are just empty numbers. I also have seen NO comparable data on the general population, so those empty numbers are decidedly one-sided as well. Your assertion that HPV, or any virus, is transmitted with every single contact is patently false, and you need to broaden your source material beyond the pamphlets distributed by the angry villagers.     According to AIM(sharon Mitchell) won sworn testimony in ront of the california state legislature, the monthly gonn/chlam rate for performers is about @% each individal month, which trnslates to about 25% of all performers every year. NOw take into account the very common practice of taking the gonn/chlam medication about 4 or 5 days before testing, and the number of people who go to west oaks urgent during the middle of the month when they get that itch(the go to riggs is the middle of the month and continue working with their :clean: AIM test, and that right there is about a ten times higher rate of JUST gonn/chlam than the genereal public.

    P.s. Third AX, since youre having so much ses with porn stars when was your last herpes test? Or do you just prefer not to think about it?

Can you ever be 100% sure that ANY relationship is completely monogamous, and that you are totally “safe”? Lock down your woman/man and monitor their every move?     2500 ifected performers is a fact that cannot be ignored, and the only real debate about this number is how many MORE there actually are than just the 2500 reprted by AIM. Lets correleate dr riggs clinic and a few others in the valley in there and see the real number. But you cannot dispute the 2500 infected performers.(of course you can ignore it and pretend not to see it, but it doesnt change the fact.

    The real reason the condom issue is finally seeing the light of day is due to potential mass infection at this point.

    That quarantine period was much much much too short and since the people in quarantine have been released as of July 6th (I believe), who knows how many people each of those individuals have worked with and so forth.

    “Not Detected” does not mean negative. The HIV incubation period has a very highly variable timetable.

    Even performers who haven’t worked for months, generally (if they’re smart) get tested 3 months to a year afterwards to ENSURE that they are in the clear. I did.

    Give this about 2 to 4 months. I hope for the best, but honestly I expect to hear of something slipping through the cracks.

    One of the main premises for the AHF’s suit is that porn performers are going out into the general pop and transmitting STD’s to the unsuspecting citizens of LA county – and they are talking primarily about HIV, not other STIs – this is why porn workers must be legally forced to use condoms. I challenge that these statements are wholly unproven with any factual data, and that individuals outside of the industry could – and I’m saying “could,” because it’s virtually impossible to prove any such assumption, just like it’s virtually impossible to prove the assumption that porn perfs are solely the carriers, you dig? – be equally responsible. Hence, my suggestion earlier in this thread, that by the AHF’s same logic, EVERYONE in the general pop should also be legally bound to the same mandate.

    i suggest you do some homework and look up the Brooke Ashley case..In Dec. 2008 the Supreme Court Of the State of California ruled that the production company was liable for the HIV infection of Brooke Ashley. That is a closed case, no further papeal, a done deal.
    Not one single peice of evidence, not one positive test, NOTHING, was presented to even suggest that someone on that set was HIV positive and still they found in favor of the plaintiff.

    And just for the hellof it, what do you have to back up your statements that the porn industry is cleaner than the general public.
    These 2500 cases are PROVEN cases. The morbidity reports have been sent by AIM to the health department, there is NO disputing that. And this is only gonn/chlam. If you did a simple one generation q-list for each of theses exposures, the number of EXPOSED performers is astronomical.
    The 2500 cases have been VERIFIED. There is no doubt about that.

    The Fact is 2500 performers have been infected. The fact is that does not even icnlude herpes, hpv etc. The fact is these people who have been PROVEN to be infected are exposing countless others in tthe WORKPLACE. IT is not a privacy issue. Your statement that they are primarily talking about HIV is simply a factual error. Read the ACTUAL SUIT, NOT WHAT OTHERS ON GOSSIP SITES ARE SAYING ABOUT IT.

Open more clinics, hire more medically trained clinicians, buy more computers and diagnostic equipment, create a working solution that will involve the medical side along with the content producers to develop higher health standards for their independent contractors (or porn performers, if you prefer). This seems like a more truly industry changing plan that you and the AHF’s solution of hiring county condom chasers. But it’s never about real solutions with you regulation zealots, is it?

    By the way, another thought on your favorite number, 2500, “general Sesame Street” – this is the number of performers who tested positive for gonn/chlam over a four-year period, which gave them all dirty tests from AIM, which prevented them from working on any porn set… other than maybe Tom Moore’s. So there was in actuality (and in all fairness, an assumed) negligible transmission of these STIs to any other performers in this workplace (and you have to ponder where those STIs were contracted in the first place since every performer has to have a clean test before having contact with another performer, so there’s that pesky civilian component again). That being considered, I’d say current testing is working very well, and could be made even better with some of that cash you and the AHF are proposing to flush away on the county.

    Is very diferent than to prove prostitution that to enforce labor standards.
    The evidence of lack of protection is on film, they do not need to bust a house, they just have to watch the videos to see who is not using protection in their shoots and fine them. Far more easier.

    Back to our Photoshop/geography quandary. How to track down those nefarious pornsters who refuse to use condoms? Hmmm… The County will have to hire lots of guys ‘n’ gals with clipboards and two-way radios, who will have to find out where every porn shoot is taking place each day. They’ll have to load up into a fleet of County vehicles and fan out over the hills and dales of Porn Valley, all the way to the furthest borders, and enter the homes of Private Citizens, who have allowed their Private Homes to be used for the purpose of producing pornography. All of this will require a proper search warrant, of course, so they’ll have to get law enforcement involved. You see, porn isn’t primarily produced in a commercial facility, like a film studio, where county health officials can just walk in and start checkin’ cocks. So I’m thinking that the citizens will get a bit testy when confronted with the invasion of privacy issues this plan embraces. But, no, li’l g – Citizen Hero and Slayer of Diseased Homos – and his pals in the AHF haven’t thought all of this through, because they’re content to take random pot-shots at the porn industry, because they live in utter fear of people having sex. These people could care less about The Porn Worker, or else why would they further financially burden every other worker in LA County with the massive bill that this will rack up?
