Buttman Goes To Washington

We live in such interesting times; chaotic, unbalanced, scary, and yet oddly interesting. I never imagined I’ll witness the beginning of the very end of America in my lifetime: The return of the great depression, systematic destruction of the middle class, collapse of privacy and civil rights; and in the midst of it all, the trial of a middle aged smut peddler who has a lifelong obsession with female bottom and calls himself Buttman. His guilt is distributing movies depicting consenting adults performing sexual acts for the entertainment and viewing pleasure of consenting adults; and this is not happening in The Islamic Republic of Iran, this is happening in The United States of America. Perhaps we better stop jerking ourselves off with “the land of the free” schtick. It has become a worn out joke that doesn’t mean anything anymore.
The more I look at the current events, the more I realize how the United States government is getting more lazy, pathetic and shameless at orchestrating conspiracies, whether that conspiracy is crashing airplanes to buildings in broad daylight in order to start wars, or bringing down the financial market in order to gain control over it, or putting a pornographer on trial in order to send a warning message to the adult industry and create theatrical impressions. They don’t even care whether people believe and buy their bullshit or not, they just do what they please. Let’s take a closer look at the trial of Buttman and examine its facts to see how phony it is:
1. John Stagliano AKA Buttman is being accused of distributing obscene material. The movies in question contain scenes of girls dressed as nuns while fucking, and doing milk enema on each other. The aforementioned movies were neither produced nor directed by Stagliano, they were distributed by his video distribution company Evil Angel. A good question is why the government has decided to go after the middle man who has distributed the movies for a %30 profit shares instead of the people who have financed and directed the movies? The answer is because those people were not as famous as John Stagliano, and they would not make good candidates for the government’s celebrity trial. Furthermore, the nature of the material in these movies pales in comparison to the nature of tons of material which is available in porn market. Any fair, rational, unbiased and unprejudiced person can compare dressing as nuns and milk enema to humiliation, extreme bondage and depictions of rape, torture and murder and decide which is worse and where the line must be drawn; and how and based on what the limitations of acceptable behavior should be defined. If a person inflicts actual, physical and/or psychological harm on another person under the pretence of making movies, then what he does could and should be considered wrong and he must be stopped; but as long as two persons are engaged in consenting sex without harming each other, no person, no government, no institution and no law should have the right to interfere with them and disturb them. Period.
2. The persecution team tends to establish its obscenity case against John Stagliano based on what is known as The Miller Test which was developed in the 1973 case Miller vs. California in order to determine whether a speech or expression can be labeled obscene or not. The Miller test has three parts:
A. Whether the average person, applying “contemporary community standards”, would find that the work, taken as a whole, appeals to the prurient interest,
B. Whether the work depicts/describes, in a patently offensive way, sexual conduct specifically defined by applicable state law,
C. Whether the work, taken as a whole, lacks artistic, literary, political or scientific value.
The work is considered obscene only if all three conditions are satisfied.
The key in this case is to define “contemporary community standards” in 21st century America, and then explaining how those “community standards” have been offended. The word “community” is derived from the Old French communité which is derived from the Latin communitas, a broad term for fellowship or organized society. In sociology, the concept of community has led to significant debate, and sociologists are yet to reach agreement on a definition of the term. There were 94 discrete definitions of the term by the mid 1950s. Traditionally a “community” has been defined as a group of interacting people living in a common location. The word is often used to refer to a group that is organized around common interests and values and is attributed with social cohesion within a shared geographical location, generally in social units larger than a household. The word can also refer to the national community or global community. However, since the invention of the internet, the concept of community no longer has geographical limitations, as people from around the globe can now gather in an online community and share common interests and values regardless of physical location. Let’s put it this way: A speech or expression can no longer be labeled obscene based on the community standards, because there is no such thing as geographical and physical community any longer. In 1973, porn movies were being shown in sleazy hole-in-the-wall theatres, with the posters of performers and scene descriptions on public display outside the theatres. During that time, one could argue that the co-existence of a XXX theatre with the school in a particular neighborhood is unacceptable. Today, porn movies are no longer being shown in XXX theatres; they’re available to everybody who has a DVD player or cable subscription or internet access who can watch whatever he wants in the privacy of his home. He doesn’t need to interfere with anybody to get what he wants to watch, all he needs to do is to sit in his room and press a button. Hence, his act of watching porn does not interfere with any interests and values except for his own. In other words, in 21st century America every individual is a community, and therefore community standards are personal and private and cannot be determined by an outdated method like The Miller Test.
3. Upon examining the obscenity case against John Stagliano, it becomes evident that the case has no merits and no logic or moral principle can justify the existence of such case in 21st century America. Therefore, it becomes evident that pursuing this case by the U.S government is not about the justice, law or well being of U.S citizens; this case is designed to send the adult industry a warning message, to tarnish the boundaries of the government intervention in privacy and rights of its citizens, and above all, it’s a theatrical gimmick to further divert people’s attention from the real issues and clear and present dangers such as two ongoing, seemingly endless wars, double-dip recession, steep rise in unemployment and severe budget deficit, dangers that are threatening the very fabrics of America, and soon will turn this once decent country into a desolate land. Evil is not in graphic depictions of consenting adults having sex, evil is in despair, fear and financial stress; and today that evil is looming over America and its sinister presence can be felt in every American home, every American school and every American neighborhood. I don’t know if it’s too late for America or is there still hope; but I remember a quote from James Davidson who once wrote:
“In a Democracy the people get what the majority deserves.”

Dismissing the charges is just that, dismissing the charges, the judge made this decision because it was essentially a bad case and the prosecutors fucked it up even deeper and further. I agree, this is a victory for STAGLIANO, as an individual who will not have to sevre jail time for making a dirty movie……It is not a victory for the industry, in that MILLER was not tested, and the jury did not even get the opportunity to either reject or accept the governments prosecution. The JURY could have put MILLER to the test,,,they did not get that opportunity.
I saw alot of talk on these industry boards about having the case in D.C., and discussing how people from D.C. would apply ‘community standards” But we will never know.
This is a victory for Stagliano, not the industry. A jury verdict would have been a win for the industry, and what I would have referred. A judge, throwing out a single weak case doesnt make a win for the industry the way a jury verdict would.

That doesn’t add any credibility or value to The Miller Test. There are several strange laws that can date back very far, most of which remain in the books today, even if rarely enforced. Here are some examples:
In New Jersey, cabbage can’t be sold on Sunday
In Miami, it is forbidden to imitate an animal.
In Philadelphia, you can’t put pretzels in bags based on an Act of 1760.
In Ohio, one must have a license to keep a live bear as a pet.

Ultimately, in this industry there’s every man for himself, and no person or group represents anybody or anything. Great article, Colonel. This was definitely a conspiracy. Politico reports that Orin Hatch and right wing Senators were putting pressure under DOJ to go after big fish pornographers. The Senate Judaical Oversight Committee doesn’t like porn–look at the relative opposition to former deputy AG David Ogden because of his involvement with Playboy. Hatch, in particular, thinks porn is a huge threat to the nation and wants to take it down.

Motivating the anti-erotica movement is the myth of porn addiction. I wish someone would just categorically disprove that description because it doesn’t do anyone any good.

Origen, if it had been a real conspiracy directed by Hatch and company, DOJ would have hit Hirsch, Orenstein, Jordan, Flynt, Collins, and other distributors at the same time as directors. They would have filed in different jurisdictions with hand selected judges looking for future favors, with substantially more resources poured into the cases. They would have also used prosecutorial dream teams rather than the second and third stringers working this case. Further, they would have used selected far more extreme examples for the gonzo crowd while using mail-related cases for the couple porn crowd; doing so while fanning the flames of public opinion much more than they have in recent years (tainting potential jurors with horror stories like Lubbens does).
So while this politically motivated scam trial was definitely a waste of tax payer dollars, none of what took place was outside the realm of throwing a bone to those claiming federal laws were being broken. There are far more porn-unfriendly communities, judges, prosecutors, and probably FBI agents out there that would have been used if this was a conspiracy. That doesn’t diminish the fact that it put John’s freedom and money at risk or that it was a sad priority for the governmental resources so wastefully spent but only those prone to thinking everything is a conspiracy (while lacking substantive proof) would label it as a conspiracy.

This is 2000s, not 1930s, so going after everybody at the same time like J. Edgar Hoover and Co. used to do during the prohibition era would not be working. That would have been too obvious if they were going to hit everybody at the same time, therefore they preferred to take one step at a time, and started with John Stagliano, the most famous gonzo producer/director/distributer in the adult industry. In their opinion, convicting somebody like Stagliano with obscenity charges who distributes hardcore gonzo titles would have been easier than convicting somebody like for instance Steve Hirsch who distributes softcore couple friendly titles. Convicting Stagliano was the first phase in a much larger operation, but now that they failed, they have to start over and find a new approach.

It’s far more expensive to launch a group investigation. They went after Stagliano first because he is relatively unknown to the non-porn public but a huge player. JJ would have been next (and still might be). Flynt has been to court before and, not to offend Buttman, has ALOT more money than him to defend and possibly appeal his case all the way to supreme court.
As for not going after Vivid or Wicked, these guys are focused on gonzo because it is more likely to result in a conviction. Also, like joe, these guys won’t “say” that they are against the concept of pornography because that would be being pro-censorship (going against their conservative values). Instead, folks like Hatch hide behind community and parent “interests”. The issue of STD diseases is a different issue, and before you further turn this thread into another round of condom lectures, let me remind you that condom is only a piece of plastic that can and will break any moment during sex. It does not guarantee safety, so let’s not divert the conversation, let’s focus on the subject of this thread and talk about John Stagliano and the obscenity charges against him and what do you think of them and why.

Another thing that I have to address about the government conspiracy against porn, is to explain why John Stagliano obscenity case had failed if it was the first phase of an orchestrated conspiracy. The answer is simple: Because the government has gotten too big, too clumsy, too complex, too insufficient and too multilayered. We don’t have a coherent, functional government in this country. There are too many people, too many agencies, too many personnel and so much bureaucracy. According to a new and controversial Washington Post article, currently there are close to 800,000 personnel within the U.S government who have Top Secret Clearance. With this much disorganization, you can’t expect anything to work properly; that’s why they keep failing again and again at anything they conspire and plan to accomplish whether it’s war or taking over the financial market, shutting down porn, etc.
But Colonel, I blame America and the media. People are so obsessed with the federal government that they ignore state and local issues. There’s a brutal drug war going on across this country and most crime reporters and police departments are silent. Government would work much better if local districts would step up and serve their constituent needs rather than leeching off the federal government.
Then again, they need revenue to do that and nobody wants to pay local taxes.
In regards to the government and the mess it’s gotten America into, one viable solution would be to close the gap between poor and rich by regulating corporations, penalizing them for outsourcing American jobs to overseas and increasing taxes on them. However, it’s very unlikely to happen, because the corporations own the government and control every aspect of it from The White House to Capitol Hill.

Dan Leal AKA Porno Dan has gotten himself into deep shit: He’s dealing with the aftermath of his relationship with 18 year old new comer Mallory Rae Murphy and a CAL-OSHA complaint against his company Immoral Productions. In addition, following a fight that broke out between Dan and Domenic Kane at an X-Biz awards party in last February, Dan is facing accusations of defamation of character from Kane. I doubt if any of these has anything to do with Jim Lane/Powers, although I heard the relationship between Dan and him are not as good as it used to be. The alleged $60 million law suit could have been filed by Domenic Kane, although I can’t confirm or deny any concrete facts regarding the aforementioned law suit. At this point, there’s so much hype and rumor surrounding this subject, and if you ask Dan about it, he will conveniently change the subject and will instead talk about the latest volume in his Fuck a Fan series.

A few days after the radio debate, Luke wrote an article in which he insisted his story was true, and that all Vivid girls have AIDS. That was weird, fucked up and oddly entertaining.

I report on her, she reports , or, releases “press releases” on porners. She shows bias towards XPT, accuses Derek Hay of rape, (in our archives), and harasses others on her agenda, while I do my business the same way. Except that I do not print libelous statements.
Calling me a stalker is libelous. One would think that if she was so concerned for her or her family’s safety she would choose one of the following options:
1-Stop mentioning me. She has said it a hundred times that she will ignore me, and yet, that paragraph directly accuses me of sending her a phony link ( she stole from XPT) and libels me by saying I put her family in harm’s way. How?????
2-I have a lawyer, a very good one. If I am such a menace, and she claims to know my personal information,then file charges. But, she wont . Why? And, believe me, they would laugh her out of the initial filing of charges. That’s why I have a documentation of everything that she prints. To me, it’s insurance. To her, stalking.

The Savannah story was sent to me by an anonymous source with a fake email through those masking services. But the person said Savannah had been killed and sent me the links. No where on either story does it say she was killed or survived. But as the story says of her having her throat slashed, one can only assume she died after being found naked by neighbors bleeding from her neck. I Googled for the story and it was all word for word from The Sun. Ace Cartier then sent me a link from a forum where the person said how she was attacked last year and how her attacker was sentenced to only eight years this week. I never heard of her being attacked last year and I also checked a few of the porn sites and no one mentioned it either. I did look at those sites to see if they had first reported she was attacked when I thought she had been attacked the other day. No one had anything of her being attacked at all. I didn’t get the story from XPT because I rarely check there anymore and only check the forum once a week because of how slow the forum has gotten.
Jeremy, I never sided with Sophia when it came to you or even gave an opinion when everything was happening between you and her and everything she accused you of. So since his blogs were about a porn blogger, then he should also be taken off. The administrator emailed me back saying he suspended the blogS because they broke the rules. Blogspot caters to spammers and that’s why it takes longer to suspend unlike WordPress who won’t tolerate spammers.
Redgoat has also admitted to starting numerous Twitter accounts posing as me to many in the porn industry. Many have been deleted already. He also RTd a fake tweet of mine saying how I was happy Jenna Jameson had been attacked by Tito. I never said no such thing. I told everyone to look at my stream and how also I would never be happy that any woman was attacked. I have saved screencaps of him trying to contact the heads of Twitter telling them to ban me. I have saved screencaps of him sending many in the adult industry links to my blog saying they should sue me. He got Jenna Jameson’s lawyer to my blog when the blog post he was so upset about were comments from TMZ. I don’t know the protocol when it comes to drug testing and so that’s why I posted what people on TMZ were saying. Redgoat has tried to get Jenna, Porno Dan, and Derek Hay to sue me. I have Derek’s emails of this exchange and I later contacted Derek myself.
Months ago an account on XPT called Test99 posted my IP number. It’s an administrator account. Someone told me only the higher ups at JM Productions have access to this account. I thought it was his wife. I contacted Jeff and told him what was happening and he banned me from XPT which means he is Test99. Because of what was done, Donny Long then starts threatening me. I highly doubt he’s reading my posts on XPT. So my guess is that SOMEONE sent Donny my IP where he is now threatening me.
How my life has been put in danger is after I was given the email exchange with Derek Hay. You of all people Conolel know about Derek Hay. Derek thought I was Cindi also. Because of what was said on that email exchange, the process has now been started on my end legally to protect my family and I. Do not sit there and agree with Redgoat without asking more questions or talking to me.
I’ve told Cindi and Harvey and many others this and sent them many of the emails. Many in the adult industry has seen with their own two eyes the stalking, harassment, and threats he’s done to me. They have told me many times to sue him because I had a clear case of stalking against him. Redgoat has told me he has the time to see this through to the end. Of course he has the time. Why would a porn forum moderator care that I linked to a non-porn porn blog especially when that forum still has up pictures of dead children?
He’s stalked me for so long, tried finding out where I live, harassed me, threatened to sue me, got Twitter imposter pages making people in the industry think it’s me, threatened to pull my WordPress blog, started blogs solely based on me, and contacted Jenna Jameson via Twitter saying I’m “stalking” her because I have many entries on her in my blog. She’s a porn star! What the fuck should I write about on a porn blog?? Especially when she’s the most famous right now with the most mainstream press of her out there for me to write about. He doesn’t care about her or any woman for that matter. He just uses anyone he can to get them to come after me.
I’ve tried many times to be friends with him but he has serious problems. He turns on you at the blink of an eye. He once told me I had the patience of an angel because I replied nicely to him on XPT in a PM after he had sent me a negative PM.
I would never call anyone or send them things to their home because I argue with them on a message board. I and the people in my life haven’t done any of this. But you lie so often that I don’t believe any of these things ever happened.

As to your conflict with Redgoat, I was interested to know how your life could be in danger by somebody that you only encounter on an internet message board and how is he stalking you. I don’t visit XPT too often and haven’t been following your brawling with Redgoat. I did not side with Redgoat, I was only being objective; and Redgoat provided an explanation that I found convincing and sufficient. As I mentioned in my previous comment, in my opinion, what Redgoat does is not stalking, it’s archiving information and blogging, and anybody who browses through his blog page and goes through the screen captures of your writings will realize that. It’s all in there in black and white, raw and unedited for people to read and draw their conclusions.
As I told you before, you tend to write and express opinions about the adult industry, a business that you’re not a part of and have very little knowledge about. So don’t be surprised when the industry workers often find your opinions biased, insulting, prejudiced and wrong and react harshly. If you truly want to be involved in the adult industry, perhaps you should do what Luke Ford did: Move to Los Angeles, get a place, associate with pornographers, go to sets, go to parties, get an inside view and then write about it. There are no two ways about it. The write-up was originally posted HERE ON LIB (after Jed asked me about my experiences in the pen). Not one single word was changed in my write up when it was posted up on Poontalk by a different title. The title I believe was “Jeremy Steele Violated in Jail while Taking a Dump”. Now, does the article (again as originally posted as a comment on LIB) suggest I was raped while taking a shit?

I also told someone how it was getting way out of hand between you two and I was stepping away. I also defended you a few more times on Poontalk but the comments never went through. Besides, I’ve never said anything that later on I regret saying, so archiving my writings by somebody else wouldn’t bother me, especially when those writings are posted in full, as screen captures and without being taken out of the context, similar to the way Redgoat has posted your writings.
