A couple of weeks ago, Luke received this anonymous handwritten letter in his snail mail box: "What do you think the odds are Rob Black has all the model releases for the movies he's directed?"
That was it. But it was enough to get Luke wondering, and now he's hearing that Extreme Associates does not have the models releases to individual productions from the recently fired Tiffany Mynx and Van Damage that Extreme has sold to a cable TV company. I hear that Rob Black's company has already received payment for the shows but was unable to deliver on the releases.
Apparently, the forthcoming Tiffany Mynx and Van Damage (photo 1/99) comps to be released by Extreme in their hardcore versions and already sold to cable TV contain scenes from Tiff and Van's movies for which Rob has the masters (because Extreme Associates makes the dupes and distributes the product of such production companies as Tom Byron's, Tiff's and Van's), but the releases are in the hands of the production companies Tiffany Mynx Productions and Van Damage Productions.
Rob Black told www.geneross.com: "We have not sold anything to cable. We have not received any money from any cable deals." [Black has been battling back and forth with a certain cable company over licensing agreements, and the cable company's alleged unauthorized licensing of Black's product. Black's attorney last week appeared to be willing to ride out the problem, but Black says certain circumstances have altered the situation, and they're going after the company.]
"That's what we're going through with our lawyers today," Black says. "That [cable] company's going to be called Extreme Productions TV. We're going after them full bore. We're in meetings right now. We have contracts that....signed as president of Extreme. They're [the cable station] running things already that I never signed. They were supposed to send a list of all materials they had and renegotiate prices. They did not do either of them. We said, 'Okay, that's how you want to be..' They have a title, Fire Wire that we know they have, and they're saying they don't have it. And they went directly to our director, direct, and asked if they could get it from him. He said, 'I don't own the f---ing thing.'
"The model releases for the Van and Tiffany movies? Van Damage stole them from our offices. He stole the model releases and masters. He knew he stole the masters because he replaced the masters on the shelves with work tapes, bogus tapes. So when we picked the masters up, it felt like there were tapes in there. When we moved our offices, we had to move all the masters. So, as we started moving all the masters, one of them fell to the ground and a f---ing tape fell out that said, 'Cellar Dwellers Work Tape.' One of our editors goes, 'Is this supposed to be there?' We went through all the tapes. He [Van Damage] replaced all the masters with bogus tapes. If he owned them, like he thinks he does, why would he replace them with bogus tapes? If you take a look at every Extreme box it says I produced the movie and I'm the holder of records. Black fired Tiffany and Van (who've lived together for over a year) in early February, 1999.
Page 109 of the April AVN features an ad by Extreme Associates for "Tiffany Mynx: Rest In Peace," which contains eight scenes and two hours of tape. During her tenure with Extreme Associates, Mynx, a heavy pot smoker with a reputation for laziness (according to Extreme sources), produced only one movie, "Asswoman in Wonderland."
Attorney Michael Friedman, who represents accountant Mike Daniels in his suit against Rob Black, writes to Luke: "I take exception to your reference in your column tonight regarding Tiffany Mynx being a heavy pot smoker and lazy. I do not know where you got this information but I can assure you that, in order for her to be a feature dancer, she must have a great deal of energy and cannot be lazy. Let's see Rob Black shake his ass from Thurs to Sat. Then we'll really see who's lazy."
Rob Black told www.geneross.com: "That's true about her. She is a lazy, f---ing dope-smoking f---. That can be attested to by everybody including Patrick Collins who she tried stealing $20,000 from. We had to get the attorneys, and we had to pay the f---ing bills to get her out of that f---ing mess. Patrick will attest to that. The AVN ad features a tombstone which reads "Rest in Peace Tiffany Mynx "Asswoman" Born 2/9/98 Dead 2/2/99." And there's a derogatory picture of Mynx smoking a cigarette, her face covered with cum.
Mynx could sue Black for defamation, I'm told. It's hard to imagine that she gave Rob a release to put her in a bad light. "He stole her image and flushed it down the toilet for his own satisfaction," says a source. "Taking those personal feelings he might have and putting them into an ad and a video to be distributed worldwide is risky business."
I hear that Rob took White-out and forged a release from Mynx to take to the insistent cable company for the Mynx RIP movie. Such forgery is illegal and may bring down criminal charges against Black aka Robert Zicari.

Luke hears that Extreme plans to release a Van Damage compilation tape called "The Damage is Done." Again, the proper releases are missing, I hear.
Black told www.geneross.com: "That's a complete falsehood. There's no such thing. But that's a great idea. I don't know where Luke's getting that one from."
I hear that Extreme and Mike Daniels are taking their court case to private arbitration. Black agrees.
I hear that Tom Byron is doing scenes for Seymore Butts, indicating that Tommy and his Tom Byron Productions are in financial trouble.
Rob told www.geneross.com: "That's completely and utterly false. The last scene he did was five or six months ago. And the only reason that he would work for Seymore, and he don't work for anybody else, was because Seymore pays his rate of a thousand dollars and Tommy gets to f--- Alisha Klass. Former Extreme contract girl Stryc9 says she has not been paid by Extreme for several scenes. And I hear that Tiffany Mynx and Van Damage claim that Extreme owes them money for scenes. Perhaps they will fold their case into that of Daniels, who's represented by attorney Michael Friedman.

What is Extreme doing with its money? I hear that Asswoman made over $50,000. Extreme's earnings do not seem to be flowing back to the production companies of Byron, Mynx and Van Damage. I hear that Mynx and Van were not paid according to their 25 - 75% split deal with Extreme Associates (whereby Extreme keeps 25% of the sales).

From duplication, to talent paid, to Tiffany Mynx being paid. I have cancelled checks by Tiffany Mynx Productions for thousands of dollars which say 'in lieu of payment for Asswoman.' When Tiffany Mynx cashed that check she was paid for that movie as a performer. Period. End of f---ing story. She didn't direct that movie. Tiffany Mynx did not direct that movie. Tiffany Mynx did not write that movie. My MOTHER came up with the concept for the movie about being in Wonderland, and Lizzy Borden wrote the f---ing script while Tiffany Mynx layed on her bed and smoked pot throughout the entire f---ing day. I f---ing directed the movie. I shot the movie. Ask Nina Hartley. I was on the f---ing set shooting Nina Hartley on the f---ing set. We produced it. The same documents in the Daniels vs Tom Byron Productions lawsuit that show TBP is owed money, reveal that Mynx and Van's companies are owed money also by Extreme Associates (100% owned by Rob Black).
I hear that Byron, who remains tight with Rob, is now a part of Black's production company Extreme Video (as opposed to the distributor Extreme Associates, which is 100% owned by Black).

In a January 1999 interview with Luke, Black said that Mynx, Byron and Van Damage were only employees of Extreme Associates who got paid a director's fee. But the various production companies of Mynx, Byron and VD own the copyrights to all their productions.

Black also disputed Ford conjecture about his "drug habit" as being a possible cause of money disappearing and denies inordinate pressure to pay his father back on a loan.
Black: "No drug habit. Anybody who knows me knows it's the cleanest I've been my entire life. I don't lie about my drug habits. I talked on Ed Powers' radio show about my drugs. When I'm clean I'm clean. When I used to do drugs before, I told people I smoked joints and wrote sexual atrocities. I don't try to keep a squeaky clean image. No cigarettes. No booze. An observer: "I don't know what is going on with Extreme Associates because they're generating enough business to be able to run things completely honestly, legally and above board. Why they're not is curious? Is it a drug habit? Is it the debt that Rob owes Dominic [Rob's dad]? Is Extreme funding movies that people don't know about? What good does it do Extreme Associates to withhold money from the people owed the money unless they're using it for something fun or nefarious or productive?"

Dick Sucking Disrupts Extreme
Rob Black's Extreme Associates resembles a frat house, and all the illicit sex going on there behind the scenes is f---ing up the high profile company.

Interesting that Gene uses the word "refutes," rather than "rebutts," meaning that Gene must KNOW the TRUTH.

I hear that Jon Dough is on his way out from Extreme. He missed an important shoot Monday with Ashlyn. He's been a giant failure for Extreme. Contract boy Luciano meanwhile is healing and performed a couple of decent scenes this week.

Van Damage and Tiffany Mynx have signed with attorney Michael Friedman who represents accountant Michael Daniels who's suing Black and Extreme Associates for ripping off Tom Byron Productions, of which Daniels owns 25%.
Sources back up most of the serious charges Black leveled this week at Van Damage and Tiffany Mynx. But Black left out a lot of information about himself, such as his own predilections to hit up talent for blow jobs and sex.
Rob: "That’s complete and utterly false. Nobody will f---ing tell you I do that. I always sit there and comment to people when people tell stories about the business, that I didn’t have enough balls to do that to anybody because I can’t f---ing do that. It’s bulls---. I’ve never done it."

Luke hears that Extreme Associates resembles a frat house. Doors slam and tempers flare regularly, much of it a result of people f---ing people they shouldn't be f---ing. Even hulking 300-pound ex-Screw writer David Aaron Clark, I hear, is getting BJs from porn girls, which arouses the ire of his Extreme peers. Has David been boffing Lizzy behind Rob's back?
Every week or so Rob's girlfriend Lizzy Borden finds out about another one of Rob's sexual escapades (usually with porn girls), and throws a screaming fit.

New salesman Jon Blatt seeks to professionalize the company but he's regarded by most of his Extreme peers as a creep who's always sticking his nose into things.

CAUSE I KNOW WHO THE PERSON IS WHO’S THE f---ING RAT!! This person is DISGRUNTLED because Jon’s not happy with the way they are performing. I know who the rat is because Jon Blatt tells me every day the people that are f---ing losers at this f---ing company. But I didn’t want to FIRE people. I just wanted to realign things to do, but now I got to fire people."
Luke: Where's the money? Court documents from Mike Daniels' side reveal that Extreme has not been paying Tom Byron, Van Damage and Tiffany Mynx Productions what it owes. Black is correct, I hear, that he does not have a drug problem, and that Extreme is spending big money on itself, including the move into its new headquarters. What Black does not reveal is the thousands of dollars Extreme spends on the whims of Rob and Tommy Byron and their high-flying trips around the world.
I also hear that Rob has silently funneled Extreme Associates money to his father Dominic Zicari who in turn has set up large personal stock portfolios for Rob and Tom. In other words, Rob is stiffing Tom Byron Productions because of troubles with Mike Daniels, but is making it up to his star and buddy Tommy in other ways. Remember how Byron dedicated one of his AVN awards in January, 1999, to "Rob Black, my friend and lover."
Rob: "That’s complete and utterly false. Yeah, we had to go to Brazil on a trip where we shot two movies. We went to ECW because we had to bring Jasmin there to get dropped on her f---ing head. Those things are high-flying junkets? o. Complete and utter lie. Rob is funneling money to his father, Dominic, who’s putting up large stock portfolios for Tom and Rob? Let me tell you something. I wish we had the money to funnel to my dad for f---ing stock things. That’s utterly false and I resent whoever f---ing said that about my dad. What can I say? I hear that an outsider wants to purchase Van's videos that have not been already distributed by Extreme, and that E.A. will have to bid for them.

Black hired a smart college kid to manage Extreme Associates' wrestling connection, but Rob keeps doing deals behind the kid's back, leaving the E.A. wrestling con in shambles.

I don’t know like what’s going on with this wrestling ‘con.’ I think the only thing is that Kevin owns a wrestling company that we’re going to try and f---ing form here. Sources say that Rob Black loves to flaunt his wealth, and rubs it in the face of the poorer Extreme employees.
Black: "You’ve come to my house. You’ve come to Tommy’s house. What do we flaunt? We don’t have enough trash cans outside, and we have trash spilling over into our yard. So what wealth is flashed there? Please tell me. We have s--- stains on our carpets from our f---ing dogs. What wealth do we f---ing flaunt? Rob hired a fast-talking chainsmoking cellphone gobbling cable sales gal from mainstream (Lisa) who tried to put one over Rob. She sought to get power of attorney to make deals for E.A., alerting Black to her shifty ways. The main cable company E.A. has been dealing with is TeN, which has a dubious reputation of its own.
Rob: "That’s true. She’s out to get power of attorney to make deals for us. That’s true."
Extreme Associates record keeping, as one would expect from this frat house, is in shambles, though Blatt is shaping things up. Charley Crowe didn't even bother to obtain releases for his Extreme movie Archer's Last Day though the company scrambled to get the job done afterwards. Many of the missing releases are for performances by Tiffany Mynx and Van Damage who've since left the company and won't be amenable to signing releases.
Not to worry, Black and company have forged model releases for their productions. The cable company (Ten?) realized that many of the releases it was given by Extreme were forgeries and refused to accept them. Criminal charges loom against Black.
Reached for comment at 2:46 PM, Black told Luke F-rd, "Go f--- yourself. That's my comment. Run it."
Rob told www.geneross.com: "You can come down and check the records. Blatt’s shaping things up. I didn’t know Charley Crowe was a prima donna. I thought everybody likes him. He doesn’t f---ing bother nobody. The remarks about the movie Archer’s Last Day and missing releases are completely and utterly false. I’ll bring them over to you. That we forged model releases is completely f---ing false. You can look at the goddamn signatures. Lies! Lies! Lies! Van Damage and Tiffany Mynx are NOT in the movie. Luke F-rd can go f--- himself. Criminal charges loom against Black?: God bless him. Let them bring them against me. Van Damage is not a Navy SEAL. Tiffany Mynx will never get her children back. The courts will know the f---ing conduct that goes around there. Criminal charges will be brought up against Van Damage by the four girls we have sexual harassment against them. And he will be prosecuted the fullest extent of the law. They can f---ing try and come up with any dirty laundry they want because it’s all bulls---. I welcome it."
Van Damage told www.geneross.com in February, 1999: "People here [Extreme Associates] are making business decisions based on what they read on Luke F-rd... Rob was also convinced that Tif was talking to Luke F-rd and wreaking havoc. Yeah, right, she’s talking to Ford, creating chaos. Ford called me once. I said, ‘You’re that cocksucker,’ and hung up on him. I don’t give that guy the time of day."

Earlier this week, Extreme
Associates owner Rob Black told www.geneross.com
about recently fired star Tiffany Mynx: "She is a lazy, f---ing dope-smoking
f---. That can be attested to by everybody including Patrick Collins
who she tried stealing $20,000 from. We had to get the
attorneys, and we had to pay the f---ing bills to get her out of that
f---ing mess. Patrick will attest to that. Our attorneys had to spend
hours on the phone with the furniture people to get her out of that
mess. The bill alone for that was over five grand which I paid for."
But according to a letter sent February 17, 1998, Rob Black's own lawyer, Michael Kerry Burke of Goldberg, Burke & Stull, totally denied Rob's claims.
Luke has a copy of the letter sent to Patrick Collins of Elegant Angel regarding the "Tiffany Mynx Gift":
Dear Mr. Collins:
Our firm represents Shannon Prince (also known as Tiffany Mynx), until recently an employee of Elegant Angels Productions.
I am in receipt of your letter dated February 16, 1998, apparently distributed to the industry as a press release today, accusing Ms. Prince of stealing approximately $20,000 from you by charging furniture and other items on her company charge card. This false statement and false implication is defamatory.
As you know, Elegant Angel held a Christmas party on December 16, 1997. At that party, you presented your directors with Christmas gifts, a bonus for their performance, productivity and profitability for Elegant Angel over the past year. As was reported in both a press release and in Adult Video News magazine (February 1998, pages 86 and 100), you presented Tom Byron with a Mercedes Benz; Rob Black with a Porsche; and Van Damage with a Corvette.
Tiffany Mynx, who had produced and directed "Cheek to Cheek" and "Cheek to Cheek II" was told by you that her Christmas bonus was the first and last months' rent and security deposit on a new townhouse or condominium, and any furniture she desired to purchase. You specifically told her that "there is no limit, just don't go crazy in Beverly Hills." There were several witnesses to this conversation, and to this gift. (Apparently, you decided on this gift to Ms. Prince because Ms. Prince had recently filed for divorce, and was looking for a new place to live.)
As you know, Ms. Prince has been either professionally occupied or out of town ever since that Christmas party. For instance, she spent the holidays with her family, and thereafter worked for Elegant Angel in Las Vegas, Nevada; Pennsylvania; Fort Lauderdale, Florida; and Atlanta, Georgia before finally returning to Los Angeles last week. This past weekend was the first opportunity Ms. Prince has had to purchase the furniture you authorized and instructed her to buy as part of her Christmas gift and bonus for last year's performance. Your gift was irrevocable at the time it was made in December 1997, that she was, by work and circumstance, forced to wait this long to obtain her bonus does not make it revocable.
Your press release does not mention that the furniture she purchased was a gift, nor does it mention that it was a bonus. Further, your press release fails to mention that you had authorized her to purchase furniture for her new place. The comments and implications made in your press release, as well as the tone and tenor of the letter, imply that Tiffany Mynx is a thief, that the money was taken from Elegant Angel, and that she was not entitled to it. Further, it implies that her decision to buy such furniture was unilateral and unauthorized. Given the true facts and circumstances, these statements are defamatory and libelous. They constitute libel and slander per se, in that they accuse Ms. Prince of a crime, and tend to injure her in respect to her office, profession, trade or business.
I will address the subject of your purported agreement with Tom Byron by separate letter. However, your February 16, 1998 letter also states that:
"You may hear rumors that all three of these gentlemen [Tom Byron, Rob Black and Van Damage] have been planning this movie for quite some time, and that they were shooting extra scenes with my money to prepare for it. I can tell you that, to the best of my knowledge, these rumors are untrue."
Though pretending to deny these allegations, your very letter raises (and republishes) libelous, defamatory and slanderous allegations against Tom Byron, Rob Black and Van Damage. You may be liable for the republication of such slanderous allegations. To my knowledge, no such rumors have been circulating; if they have, they certainly have not been published to the industry at large, as your letter was intended to do.
I must caution you that my clients take quite seriously their professional reputations, and reserve the right to protect their reputations by all means, including but not limited to legal action to enforce their legal rights.

Various sources confirm that Rob Black has been selling movies by Tiffany Mynx and Van Damage without proper authorization. A source with knowledge of Colorado Satellite Broadcasting regards Rob Black as a man of questionable character, and says that Rob sold movies to CSB without proper authorizations - meaning both models releases and proof of ownership.
Rob Black's attorney Adam Stull has sent out letters reading, in part, "Extreme Associates is not authorizing Colorado Satellite Broadcasting to broadcast any of Extreme's movies that are currently signed by Lisa Schmidt, except "Asswoman in Wonderland" and "Lewd Behavior II."
Later, Stull writes: "My account of the fee arrangement between "Asswoman in Wonderland" is correct. There is no agreement for $3,000. The price for this movie is considerably more than $3,000 because it is not a "Gonzo" movie."
The Lisa is the fast talking sales agent who got fired by Rob.
Apparently, Extreme Associates gave CSB the masters to some of "its" videos, but with no releases, at least not for Tiff and Van's vids.
Luke understands that Asswoman in Wonderland is Tiffany Mynx's movie and she has the model releases for it. It is not Rob's movie to license.
Called at 3:43 PM, Black's attorney Adam "Stall" Stull had no comment.
Luke received this unsigned letter:
Hey Luke,
How would you like to be the man who puts Rob Black in jail? I read your posting Update 4/9/99 about Extreme Associates, and it was absolutely true. How in the hell did you find all these things out? I have an insider's view at what goes on at Extreme, and you stumlbed on some real sensitive s---!
Rob Black is releasing Tiffany Mynx and Van Damage titles without proper model releases. Van Damage has ll the original (and only existing) model releases for all seven of his titles released by Extreme Associates. From what I understand, Damage also copyrighted all of his titles through a Beverly Hills copyright attorney while he was still at Extreme, because he feared that Rob was hiding money and would try to avoid paying him his due. But I've also heard Rob talk and he is going to try to milk Damage's titles for all he can get out of them, because he doesn't think anyone is going to come around asking for them (model releases). Van Damage was too much of a dumb-ass to realize he should have gotten out while he had the chance. Tiffany Mynx was fired because she wouldn't sleep with Rob, and he is determined that she will never get a dime out of him, even though she was his number one contract girl, and she went without pay because Rob told her the company was barely making it. When he couldn't hide the fact there was money in the bank (i.e., trips to Brazil, Rob's Xmas vacation, and Rob gambling and doing drugs at the CES), he fired her because of some lame excuse that she let Tommy Byron's dog escape while Rob was in Brazil. Everyone knows that the Warehouse manager was being paid extra to feed and watch the dogs during their trip. I don't know exactly how much Rob owes Tiffany, but I've heard that if he paid her what he truly owes her, than the figure would be in the high 40k range. I can only imagine what he really owes Van Damage on seven movies! But Rob doesn't have a care in the world, because he thinks that he is untouchable!
How you found out that Black tried to pass off a forged model release of Tiffany Mynx also amazes me. But it's true. In Rob Black's haste to do away with Tiffany Mynx, he neglected to have her fill out model releases for all of her scenes she performed for him. Maybe because it's a common practice to fill out a model release only after you get paid! So Rob did the next best ethical thing, he acquired a model release that Tiffany had given Tom Byron, and he changed the names of the movie on the release, and it's all fixed. The cable guys were a little too wary of Rob. Mainly because it took several weeks for Rob to produce the paperwork and the obvious white-out sent red flags flying.
Everyone that works for Rob is on pins and needles, because he hates bad press and he hates it when people know the truth about his dirty little business secrets.
So Luke, how about one little phone call to the District Attorney's Office, or even Federal Officials, about the whereabouts of all that missing paperwork? Don't you think they might find it interesting that an adult video company is releasing and rereleasing compilations of movies that are missing documents required by federal law? I'm sure that the video distributors around the country would also be very concerned as well, do you think they know about Rob not having proper model releases?
You really need to call Van Damage and the cable guys so they can confirm these facts. I don't know their phone numbers, but I know that you can get them. While you're at it, try and get a hold of former producer and director, Keith Again. Keith directed Pornoman 2000 and The Adventures of High Fly. Keith was fired from Extreme and Rob still has not apid him for his last movie. Rob won't pay him because he knows that Keith does not have the financial means to go after Rob legally - so Rob threw him out on his ass.

Attorney Michael N. Friedman represents ex-members of Extreme Associates Tiffany Mynx and Van Damage, as well as Mike Daniels, a partner in Tom Byron Productions, who's suing Rob Black and his distribution company Extreme Associates.
Friedman sent me the first page of a letter he received from Adam Stull, Black's lawyer.
Dated 4/23/99, the letter reads in part:
It has come to the attention of Extreme Associates that your clients, Van Brunt [Van Damage] and Shannon Price [Tiffany Mynx], have taken several video masters and model releases belonging to Extreme Associates. These masters and model releases were surreptitiously taken from the Company offices of Extreme Associates, and were taken without the consent or permission of Extreme Associates and its principles (Rob Black and Tom Byron). These titles include:
* Lewd Behavior
* Lewd Behavior - 2nd Offense
* Lewd Behavior - 3rd Offense
* The Damage Report
* Filthy Lil' Pornabees
* Filthy Lil' Pornabees 2
* Flesh Pot
* One untitled film in the can
* Asswoman in Wonderland
Your clients are hereby notified to cease and desist any and all use of the above-listed titles. Neither Van Brunt nor Shannon Prince may use, sell, license or encumber any of the titles listed above. At best, your clients may have had an oral agreement for compensation arising out of Extreme's use and licensing of its copyrighted works which Van Brunt and Shannon Prince produced for Extreme Associates.
Friedman adds: "The remainder of the letter contains threats against Van and Tiffany and I am not interested in having those threats posted on the internet. What is interesting to me about this letter is that it confirms that Tom Byron is, indeed, a principal of Extreme Associates. Moreover, it claims that the listed titles belong to Extreme Associates, a video distributor. I do not have all of the box covers for all of these titles at this time. However, I do have the box covers for Lewd Behavior and Lewd Behavior - 2nd Offense. These box covers clearly evidence that the copyright for these titles belongs to VG Productions, which as you know, is Van's production company. I also have a box cover for a video produced by Rob Black entitled "The Cellar." Please note that this box cover indicates that Rob Black holds the copyright for "The Cellar." All of this artwork was commissioned by Extreme Associates and Extreme Associates provided the information regarding the copyright holder. Please take a look for yourself."

Friedman: "I leave it for you and your industry to decide who is telling the truth in this instance -- Rob Black, through his attorney, or Van Damage, who has the box covers, the masters and the model releases for these videos? If anyone intends to distribute or disseminate any of the videos referenced in Adam Stull's letter, they should make their deal with VG Productions and/or Tiffany Mynx Productions (for Asswoman in Wonderland.) Extreme Associates does not own these videos -- Extreme owes Van and Tiffany over $100,000 by our preliminary estimates, and Extreme Associates is now attempting to steal Van's and Tiffany's videos away from them. Rob and Tom will never be permitted to get away with this."

9. Plaintiffs are informed and believe...that...defendants Extreme Video and Extreme Associates were the alter-ego of defendants Black and Byron because (a) defendants Black and Byron commingled the assets of defendants Extreme Video and Extreme Associates with their own personal assets; (b) defendants Black and Byron used the assets of Extreme Video and Extreme Associates as their own personal assets...All of the foregoing makes it unjust and inequitable for defendants Black and Byron to use the corporate form of Extreme Video and Extreme Associates to shield themselves from liability for the damages alleged herein.
17. In or about February 1998, defendant Black reached an oral agreement with plaintiffs setting forth the terms by which Extreme Associates would distribute adult videos produced by VGP and TMP. Pursuant to this agreement, Extreme Associates would advance the production costs and distribute the videos in exchange for 25% of the gross domestic income from the sale of the videos, plus reimbursement of advanced production costs. The remaining sums collected by defendant Extreme for the distribution of plaintiff's videos would be paid to plaintiffs, including 100% of the money derived from the sale of foreign distribution rights to foreign distributors and broadcast rights to cable television broadcasters, the latter requiring substantial editing to make it suitable for broadcast.
18. Plaintiffs and defendant Extreme performed pursuant to this agreement from approximately February 9, 1998 to February 9, 1999. During this time, VGP produced seven videos: Lewd Behavior, Lewd Behavior - 2nd Offense, Lewd Behavior - 3rd Offense, Filthy Lil' Pornabees, Filthy Lil' Pornabees 2, Flesh Pot and The Damage Report. During this same time, TMP produced one video: Asswoman in Wonderland.
19. Except as alleged hereinbelow, each of VGP's videos are owned and copywritten by VGP, and VGP possesses all model release forms for each performer in each video, as well as age verifications for each performer, as required by federal law. VGP also possesses the masters of each video.
21. In addition to producing the above-referenced videos, Tiffany performed in approximately ten scenes for Extreme Video. Van also performed in approximately three scenes for Extreme Video. Defendant Black verbally agreed to pay Tiffany and Van for scene work at a rate of $1,000 per scene, and Van and Tiffany agreed to execute model releases upon receipt of payment.
22. In the one year that plaintiffs produced adult videos pursuant to their agreement with Extreme, sales of plaintiffs' videos were strong and produced substantial revenues and profits. Plaintiffs are informed and believe and based thereon allege that, after deduction for productiona dn distribution costs, plaintiffs' videos generated approximately $120,000.
23. In addition to selling plaintiffs' videos, defendant Extreme sold plaintiffs' foreign distribution rights for said videos. Plaintiffs are informed...that the sale of foreign distribution rights for their videos generated revenues for plaintiffs in the approximate sum of $15,000.
24. Plaintiffs are informed that..defendant Extreme sold the broadcaster known as Colorado Satellite Broadcasting for the approximate sum of $30,000.
25. Based upon their agreement with defendant Black, plaintiffs were entitled to receive as their share of the revenues from the sale of their videos, the foreign distribution rights for their videos, the broadcast rights for their videos and their performances for Extreme Video $178,000.
26. Defendants and each of them were obligated to pay to plaintiffs, by virtue of their agreement, the sum of $178,000. Defendants breach said agreement by failing to pay plaintiff said sum. Defendants paid plaintiffs approximately $15,000 and has wrongfully retained the remaining funds.
34. By virtue of said distribution agreement, plaintiffs reposed their trust in defendants Extreme and Black to collect monies owing to plaintiffs for the sale of their videos and other rights, to account for all monies collected and to promptly pay to plaintiffs all monies owing plaintiffs on account of said monies.
35. In reliance upon defendant Black's representations that defendants would distribute plaintiffs' videos pursuant to their agreement, plaintiffs entrusted defendants with possession of the original masters for plaintiffs' videos for defendants to duplicate and sell, and further entrusted defendants with the collection and accounting of all monies generated by said sales.
36. Defendants Extreme and Black defrauded plaintiffs, in breach of their fiduciary duty, by
a) failing to account to plaintiffs all monies collected for the sale of their videos;
b) entering into cash transactions for the sale of plaintiffs' videos and failing to record the cash collected in Extreme's accounting records and converting the cash collected to defendants' own personal use and benefit;
c) failing to pay plaintiffs monies owing to them which were collected by defendants and are still held by defendants;
d) altering the box cover art work for the video "The Damage Report" to provide that the copyright holder is Extreme Associates rather than VG Productions;
e) failing to return plaintiffs' original masters upon demand therefore;
f) creating derivative works based upon plaintiffs' videos without their permission and/or consent and without paying plaintiffs for their use of plaintiffs' concepts;
g) converting or attempting to convert plaintiffs' videos to their own use and benefit;
h) altering model releases signed by plaintiff Tiffany Mynx to sell her video to Colorado Satellite Broadcasting without her permission or consent;
i) continuing to distribute plaintiffs' videos beyond the termination date of their distribution agreement; and
j) by committing such other acts and omissions of which plaintiffs are currently unaware but which will be proved at time of trial.
37. ...Plaintiffs have sustained damages...in excess of $200,000...
38. The acts of defendants Extreme and Black were malicious and fraudulent. Defendant Black harbors ill-will toward plaintiffs and each of them and intended to cause them injury. In an interview March 3, Black stated:
"See, I told you the [Vivid] deal wasn't going to happen. I told you. Didn't I tell you? They [Damage and Mynx] want too much money because of what I was paying them. You'd think that if I wasn't paying them, and f---ing them...bulls---...they'd take anything they could get, right? Tiffany had a good life. I told them they ain't gonna get paid by anybody else out there. Nobody's gonna give you f---in ten [$10,000] a movie. They're not comin' back, never in a million years...those f---in' pieces of s---."
Based upon the foregoing, plaintiffs are entitled to punitive damages in an amount to be determined at trial but in no event less than $500,000.
40. Between February 9, 1998, and February 9, 1999, plaintiffs produced the above-entitled videos and registered the copyright for each said video. By virtue of their creation of the videos, and their registration of the copyrights therefor, plaintiffs were and are the owners of the copyrights for all of said videos and own all rights acquired thereby, including but not limited to the names and cocnepts included in said videos...
41. Subsequent to February 9, 1999, defendants...infringed on plaintiffs' copyrights by committing the following acts:
a) Using the name "Lewd Behavior" in videos produced by Extreme Video and distributed by Extreme Associates;
b) Using the name "Lewd Behavior" in videos produced by Extreme Videos...
c) Using the images and likeness of plaintiff Tiffany Mynx...
d) Using the image and likeness of Van Damage...
e) Making compilations of scenes from plaintiffs' videos; and
f) Committing such other acts of which plaintffs are not presently aware but which will be proved at trial.
45. After February 9, 1999, defendants...misappropriated plaintiffs' images and have marketed them for their own use and benefit, including...
a) Defendants advertised and released a video compilation of scenes which included performances by plaintiff Tiffany Mynx in a video entitled "Tiffany Mynx - Rest in Peace." The box cover depicts the face of plaintiff Tiffany Mynx, splattered with sperm, on a tombstone. A true and correct copy of a full-page advertisement published in the April 1999 edition of Adul Video News (AVN) is set forth below:
b) Defendants have advertised a video entitled "Asswoman - The Rebirth," which depicts plaintiff Tiffany Mynx lying face down, dead on the ground with the woman cast to replace Tiffany Mynx as Asswoman standing above holding a smoking gun...
c) Defendants have created and intend to release a compilation of scenes in which plaintiff Van Damage performed and which Van Damage produced, entitled "The Damage is Done." Although this video has not yet been released, plaintiffs are informed and believe...that the video has been produced and that the art work for the box cover for this video has been ordered.
47. The acts of defendants and each of them were malicious and intended to injure plaintiffs... The advertisement for "Tiffany Myn - Rest in Peace" depicts plaintiff Tiffany Mynx in an unfavorable and unflattering manner. It includes the statement "The dead speaks," referring to plaintiff Tiffany Mynx, and shows her name, and her industry identity as Asswoman, on a tombstone which bears the dates that plaintiff Tiffany Mynx was in contract with defendant Extreme Associates. Likewise, the advertisement for "Asswoman - The Rebirth" includes the statement, "What do you do when your dog can't see, walk, bark or fetch? You take it out back and shoot the Mutha f---er!" It also includes the statement, "Let the retribution begin." Based upon the foregoing, plaintiffs are entitled to...$500,000.
49. Within two years past, at Chatsworth, California, defendant Extreme became indebted to plaintiff for...$178,000.
50. Despite demand therefor, only approximately $15,000 of said sum was paid, and there is still due and owing the sum of $163,000 plus interest...
August 30, 1999
Attorney Michael Friedman writes Luke: I wanted to give you an update on the lawsuit Tiffany Mynx and Van Damage filed against Extreme Associates, Rob Black and Tom Byron. The lawsuit was originally filed in the spring of this year. Extreme hired the law firm Lenske, Lenske & Abrams to defend. The attorney handling the case is Bita Azimi.
Van and Tiffany's first task has been to obtain Extreme's financial records in order to ascertain its reported sales and collections. Extreme's former bookkeeper, Kim, told Tiffany and Van that she had made backup copies of Extreme's books up to March 1999, when she was fired by Extreme. Although she promised to give a copy of the backups to Tiffany and Van, she never did so I served her with a subpena to produce the computer floppy disks.
Normally service of a subpena for a document production is accomplished by a registered process server. However, I had hoped that by talking to Kim, I might persuade her to give me copies of the files without the formality of responding to a subpena. Therefore, I decided to serve the subpena myself. Well, Kim lives in a large gated community in the Valley. I gained entry to the community by entering on foot through a gate that was opened by an exiting car. I went to Kim's door, heard the TV on, and knocked. No answer, but through the rear patio door, I could see some movement inside. I decided to wait outside and stake out her apartment, figuring I might catch her leaving the apartment or opening the door to let someone out. I sat there for about 3 hours playing with the cats in the complex that came by to check me out, and knocked periodically on Kim's door. Still no answer. Defeated, I left.
Two days later I gained entry to Kim's apartment complex in the same manner and found her entertaining with her front door open. I went to the door and the first person I saw was Stryc-9 smoking a cigarette. I asked if Kim was there and some fellow with a beard told me that there was no one named Kim there. I told him that Kim's name is in the directory for this unit and that I wanted to talk to her. I got the front door slammed in my face. I waited outside again and this time, after about 10 minutes, the door opened and the bearded fellow looked outside to see if the coast was clear. I popped out and he ran back inside and slammed the door. This time I knocked vigorously on the door and, through the door, was told that they were calling security on me.
I waited around and sure enough, a security guard arrived. I informed him that I was trying to serve a subpena on one of the complex's residents and that she was evading service. He checked my ID, and my State Bar card, and called back to his supervisor. To the surprise of Kim and her friends, who figured that this guard would toss me out of the compex on my ear for trespassing, he entered Kim's apartment and brought her out for me so that I could serve her with the subpena. He knew, as did I, that one can do just about anything short of breaking and entering to serve a subpena. The quickest way to get this over with was for him to bring her out.
Anyway, Kim was not in a mood to talk to me and, it turns out, she made some deal with Rob Black and now denies that she ever had the back up files on disk. Interestingly, she was also represented by Bita Azimi, who has threatened me with all sorts of criminal and state bar charges, but nothing has ever happened and I doubt it ever will.
In the meantime, because the complaint included a claim of copyright violation (for Tiffany Mynx RIP and Asswoman - The Rebirth) Bita Azimi was able to have the case transferred from the Van Nuys Superior Court to the United States District Court in Los Angeles, where the case was assigned to Judge Consuelo B. Marshall. I know Judge Marshall well and would definitely want her as a judge if I was defending an adult video producer on federal obscenity charges because she has a reputation of being a liberal, at least compared to other judges in the same court. However, I was very concerned that she would find the issues raised by the case to be rather distasteful. Interestingly, Bita Azimi, Rob Black's own lawyer, appears to be quite offended by the works of hers and my clients and even referred to your site as a porno site.
In Mike Daniel's case against Extreme Associates and Tom Byron, which was also filed in Van Nuys Superior Court, I recall that the judge in that case laughed out loud in open court at some of the titles of Tom's videos that were financed in part by Daniels. He even read some of the titles he found amusing into the court record.
On the other hand, I remember watching Larry Flynt paying his contempt fine levied by Judge Terry Hatter in pennies in the clerk's office of the United States District Court in Los Angeles back in the late 1980s. (A law school buddy and moot court partner of mine was Judge Hatter's clerk and let me into the Clerk's office to watch.) Judge Hatter, like Judge Marshall, has a reputation as a liberal judge.
It didn't help Larry Flynt and I didn't think that this case would fair well in federal court either. Therefore, after discussing the issue with several attorneys familiar with various aspects of the issue, I dismissed the lawsuit which had been transferred to federal court and refiled the same action, minus the copyright claim, back in the Van Nuys Superior Court. The complaint was served on Extreme about two weeks ago and I am again working on getting Extreme's financial records, this time directly from Extreme.
I expect that the parties will each try to obtain information from the other throughout the fall and I will update you when I have found out more.

I had the opportunity to review the December 1999 edition of Hustler Erotic Video Guide (for work, of course) and noticed an article about Rob Black and Extreme Associates. Among other things, its says the following:
Black claims to have proof that he owns the Asswoman title, contrary to what is alleged in the $2 and 1/2 million legal action brought against him by former associates Tiffany Mynx and Van Damage. Says Rob, "I hope they've got a lot of money, because we've got a bunch of countersuits going in federal court." He claims the case will set a precedent about the claims of "what is called disgruntled employees." Meanwhile, he's using footage of them in two compilations: The Damage is Done and Tiffany Mynx: Rest in Peace. Damages's only comment on the matter is, "I made seven movies for Rob and he never paid me a dime."
Well, I have a few comments of my own about this.
First, Rob's counter-suit in Federal Court was dismissed because the parties had tentatively reached an out-of-court settlement. That settlement has not worked out so far, as Tiffany and Rob continue to haggle over small change which, if this were purely a business deal, should not have stood in the way of a settlement. I am informed that more is at stake than mere money, and that past matters of a sexual nature between Rob and Tiffany may be standing in the way of this settlement. Perhaps this explains why Rob has made such vicious statements about Tiffany in the past, and Tiffany has not responded in kind, but instead continues to have a happy relationship with Van. Perhaps Rob is not happy when he does not get what he wants. All I know is that, if this case is going to settle, I need to be a psychologist as much as a business attorney.
Second, if Rob has proof that he owns the Asswoman title, and it is not the copyright registration he filed five months after Tiffany registered her copyright for the Asswoman in Wonderland video, then Rob has violated federal law by failing to produce that evidence when his attorney and I met in September to exchange evidence. If his proof is just that copyright registration, it is a violation of federal law to attempt to copyright an already copyrighted work. Needless to say, Rob's comments to the press will have to be fully explored as discovery gets underway in Van and Tiffany's lawsuit.
Third, while Rob continues to assert that Van and Tiffany were employees of Extreme Associates, disgruntled or otherwise, his attorney has produced documents showing that Rob claims that Van and Tiffany owe Extreme Associates approximately $40,000 for ads Rob placed in AVN, allegedly for Van and Tiffany's videos. What is that about? How can Van and Tiffany be employees of Extreme Associates on one hand, and have to pay for AVN ads for their videos on the other hand? I am looking forward to discussing this issue with Rob at his deposition and will report his response to you. My humble opinion, however, is that Rob is lying when he says that Van and Tiffany were employees of Extreme Associates. I have proof too. When Extreme Associates' books were set up in May 1998, Rob's cousin, Bruce Zicari, an accountant in New Jersey, oversaw the process. The accounting records show that separate accounts were opened for VG Productions, Extreme Video, Tom Byron Productions, Mark Kulkis and Dominic Zicari (Rob's father) As videos were sold, or costs were incurred, these credits and debits were allocated to each account. (Tiffany did not have her own account in May 1998 because Asswoman in Wonderland, her only video distributed by Extreme, was not made until August 1998.) Bruce Zicari had to approve the accounting before Rob's father, Dominic, would pay the accountant. The accountant was paid in full, which says to me that Bruce Zicari approved the accounting set up. This is not an employment relationship. Additionally, when I met with Rob's attorney in September to exchange evidence, she produced no evidence of employment records, no evidence of employee withholdings, no evidence of worker's compensation insurance. Her comment to me was that Van and Tiffany were independent contractors. Apparently, even she cannot support Rob's position that Van and Tiffany were employees of Extreme Associates.
Fourth, I was advised by Rob's attorney that Van and Tiffany should be concerned that Extreme Associates may declare bankruptcy. This, more than anything, prompted serious settlement negotiations between me and Rob's lawyer. If Van and Tiffany need to be concerned about Extreme's solvency, perhaps every other entity doing business with Extreme may have to worry about it too. That is speculation on my part, but I believed Rob's attorney when she told me this -- she has always been very honest with me and I am very happy to be working with her despite some rather graphic comments you made in your last piece about this case (which gave us all a good chuckle.)
Lastly, if things are so great at Extreme, and Rob doesn't need Van or Tiffany to get by, why is he still trying to make money off of them and their names by making compilations of their work. Tiffany has received so much positive feedback on Rob's compilation, "Tiffany Mynx - Rest in Peace" on her website www.tiffanymynx.com that she would like to be able to sell them on her website. Funny, I dont' see Rob making compilations of Lizzy Borden scenes or Jasmin St. Clair scenes. Is it possible that Rob just likes Tiffany better? Or maybe Rob is doing this to spite Van and Tiffany. I don't really know. It doesn't make sense to me. All I know is that he is giving Tiffany and Van that much more market exposure. What do you think?

Hanco Fronts For Extreme Associates
Taylor writes: Hello Luke, One of my models/talent has explained to me that she recently found out that a company that approached her, and shot her and her friends for "Internet Stills" called Hanco Entertainment Internet Multimedia is actually a front for Extreme Associates. I understand that the folks at Hanco are acquiring new models/talent to do "Photo Layouts for the Internet", many times a boy-girl or girl-girl layout, and shooting video (most of the time without the consent of the models, and without additional payment to the models) of the scene. They have apparently found a number of new models, and some not-so-new models to do "scenes" for them at a greatly reduced price.
If most of these folks knew it was for Extreme Associates, I have been told they would probably NOT have done the shoots, or at the very least, asked for their normal scene rate. I understand that the porn business has many folks that are less than truthful in their dealings with talent, I just wanted to give a "heads-up" to some of the folks who read your web site. The bottom line is that once you sign your model release, whatever the producer wants to do with your footage is up to him/her/them. Hanco's phone number is 805-370-8900, they are located in Camarillo, CA., The person in charge there is named "Price".
Moffit Timlake writes: Good morning Luke, I just read the allegation that Hanco is a front for Extreme. I would like to know the basis for this claim. I met Price at the Miami IA2000 show and he and his outfit seemed pretty autonomous- besides, how would "a front for Extreme" actually work? Also, given Rob Black's penchant for taking the limelight, why would he have anyone front for him? Who is Taylor? I think someone is giving Extreme a little too much credit and simultaneously maligning Price. That's merely my observation.
Taylor responds: Follow up... Now I understand that they may be two separate companies legally, however Price from Hanco may have invested money in to EXTREME to get content for their web site.. They are doing business together, and have admitted it to some of my models.. My understanding is that today their was to be a big shoot at Hanco, and that Extreme was to be on the set, and now many of the talent have canceled. Moffit Timlake may be unaware of just how close Hanco and Extreme really are.

Ashlyn Gere Leaving Extreme
Gene Ross reports that Ashlyn Gere has left Rob Black's Extreme Associates. I'm not sure that their much hyped feature with Ashlyn, "Rubber", was ever made.
Ashlyn tells Gene: "Rubber was supposed to come first. Everything else was second but they were coming first. So I had one scene in Tommy's movie. I had one scene in Lizzy's [Borden] movie. But the big thing that was going to do this Extreme publicity-thing never got fulfilled. Needless to say, after two years of it I was tired of waiting. I know that a lot of the money's going into wrestling, so I couldn't understand why Rubber never got made."

OK Luke here is the scoop on Rob as I got it from insiders at Extreme. The real reason that Rob is paying off his ex-girlfriend Nikki is said to be because Nikki has threatened that she will go to the police with damaging information on Rob. Most of this information appears to related to the Isreal Gonzales shoot out at Elegant Angel where two people died. Word is Rob knows a LOT more than he wants to have to explain to the police. What is it that Rob knows? Was there premeditation? Was Rob supplying Isreal with something? Maybe Jef Hickey knows. OK Rob you can stop paying Nikki now. Oh yes, and Your welcome.

I read your gossip based on lies and false accusations and one part of me wasn't going to write to you however the other part thought maybe I should. I read your story that you repeated by Mike South today and was completly blown away at such lies.
The relationship that I currently have with Rob is NOT based on whether I am blackmailing him or not. We speak today and always will because we are friends and we have a mutual caring for one another.
Rob has told the police all that he knows regarding that awful night. Rob does not know anymore or any less and neither do I. I'm not quite sure where Mike South gets his information and I think that maybe you should inform him that it's a very serious crime to insinuate that you know information regarding the death of a police officer and you haven't stepped forward. Mike should know, he just implicated himself as withholding information. Maybe I should make a few calls!

Rob Black's Favorite Amusements
