I arrived at Rob Spallone's at one PM. He finally chased down porn's most wanted man - Dan Beck, producer of the World Biggest Anal Gangbang, the shoot where Brooke Ashley got HIV. Beck lives in New York.

Robert DuPree owns HCTV. Dan Beck wrote tens of thousands of dollars worth of checks on an HCTV account that DuPree has succeeded in refusing to pay. The Spallones are out $1100 and are not happy.

I would like to provide you with a dance related update... with the focus being on New York and Sacramento.

Court Decisions:

There is a lot to report, but before I do, I want to clear up a few recent misconceptions about the recent court decisions.

First and foremost, the US Constitution and the First Amendment no doubt allow nude dancing simply because of its artistic, communicative nature.

Even so, they also allow municipalities to impose what are known as time, place and manner restrictions. As expected, cities are granted this power in an effort to reduce the problems commonly referred to as "secondary effects such as prositution, lowering of property values and crime."

What is interesting to note is at the current time, the same municipalities that you pay taxes to can use outdated studies from other states to prove their theories correct, EVEN IF YOUR ESTABLISHMENT HAS HAD NO PROBLEMS. For instance, I am in the process of preparing a secondary effects report that shows that prostitution in Sacramento clubs does not exist, even though law enforcement says it does. And how can I disprove it?

Simple, I am crunching numbers, and have found zero arrest reports from the Police or Sherrif's Department that support their sides. In other words, no one has been arrested, so how can the prostitution be occuring?

Additionally, if law enforcement is being solicited, how come they are not arresting the dancers? Something is wrong here, and were trying to stop it.

Adult Zoning Ordiances:

As we all know, there's a national trend toward the enactment of more restrictive adult zoning ordiances, and wether we like it or not, THEY ARE VERY CONSTITUTIONAL AND ARE ALSO HOLDING UP EVERYWHERE.

With respect to New York City, its unfortunate, but the battle is just about over... Why? it's simple, their legal team started out way too late, and took the position that "its Unconstitutional" and we'll fight it in court.

With that in mind, its doubtful that the Supreme Court will hear the case, let alone overturn it.

Additionally, nowhere in the Constitition does it protect lap dancing, so municipalities are enacting anywhere from three foot to ten foot distance rules that are also holding up to court challenge.

With respect to New York City, we're not dead yet, but just about, as dancers are required to "cover up" and are thus wearing full length bikinis and forbidden to "dance in any sexual or lewd way."

Tipping problems:

But what really hurts is that dancers cannot solicit tips. Then how do dancers collect tips, if they do at all? Simple, A bouncer carries around a basket for the customers to deposit the tips.

One way the clubs are circumventing this law, thanks to another recent court agreement, is that a club can post a $50,000 bond to cover future fines.

Dancer Licensing:

Another avenue for regulation is requiring adult entertainment licenses for both business and dancers. With new, stiff laws in place, businesses can pay up to $10,000 per year, while the dancers are paying up to $500 per year for their permits and in some cases over $1,000 for an additional business license. And yes, these proposals are also holding up to court challenges.

Anti-Body Rub Law

Additionally, another New York State City has passed an ordinance that's of interest to us.... its called the body rub ordiance and is slated to be signed into law by the mayor of Schenectedy any day and to go into effect October 1. As written, the ordinance clearly outlaws all touching for erotic purposes by specified anatomical areas - the genitals, breasts and buttocks. Is this the end of lap dances?

As you can see, New York's Adult Entertainment industry is in for a major shake up, and the fallout is being felt around the country.

Good News:

Yet even with all these negative aspects facing us, there has been some good news.... namely two clubs in Schenectady brought suit against the City and won. The suit, based on Schenectady's poorly written law, resulted in a victory when it was declared blatently unconstitutional. In total, the city's clubs were awarded $30,000 each plus lawyers fees, while the seven dancers they arrested got $3,000 each.

As you can see, by fighting back, a battle can and has been won, but will we win the war?

I doubt it unless we band together and fight back now. Additionally, we can never win when the owners of businesses like The Toy Box are facing felony charges for promoting prostition. Dancing, prostitution?
