AOL vs Cyber Entertainment Network

In December of last year, America On Line filed a massive lawsuit over spam against the Cyber Entertainment Network (CEN), one of porn's three biggest internet companies.

PCFormat magazine writes: "Say what you like about AOL, it doesn't do things by halves. When it wants you to subscribe to its ISP service, it unleashes enough sign-up CDs to cool the world's ambient temperature by 5ºC should they all be turned reflective-side up simultaneously, and when it wants to sue a company for spamming its customers, it does so in spades.

"The company in question is Cyber Entertainment Network, one of the Internet's biggest porn site operators. AOL's lawsuit charges CEN and its affiliates with subjecting AOL subscribers - all 27 million of them - to a huge and ongoing spam campaign."

Luke says: I've been following internet discussions of this on the newsgroup news.admin.net-abuse.email.

The site itself seems still to be within the same Cavecreek/CWIE netblock that, along with celebticket.com, it was in last August when I submitted an RBL nom for the latter, even though both sites have been reported for being advertised in email spam in .sightings since then, Celebticket as recently as 1-29. All that's still upstreamed by Level3 too, just as it was then. A buffoon at Cavecreek told me on 8-17-00 that "We do not host these sites," but when I immediately responded to the same person with a query as to why, then, both sites appeared within the same Cavecreek netblock from which his email to me originated, he fell silent.

If any of these sites *hosted* by Cavecreek have been advertised in this spam AOL users have been receiving, I rather hope AOL legal includes Cavecreek of Phoenix, AZ in its suit. Perhaps I should put a bug in their ear about it...

In both cases spam for truecelebs went on and on and complaints were ignored and then it switched over to celebticket (where of course, complaints were ignored).

I see a difference between paying for clicks and "hiring and retaining" the spammers. Back in February of last year CEN posted to the ynot message boards when UU.net pulled the plug on some of their sites. In response, someone pointed out that CEN had in-house staff whose only job was to spam ICQ and AOL. I don't believe CEN responded and nobody else entered the fray in CEN's defense. It appeared to me to be common knowledge, or at least entirely believable to the rest of the crowd. I can't prove that level of involvement by CEN, but I'd bet all my quatloos that AOL will be able to prove it if CEN doesn't settle the case first.

Roy writes on YNOT: This is a question about APIC and their operation. I have a few friends whose celebrity avs sites were shut down by Steve Easton and his non profit organization. Is there some sort of glitch in the law where some giant companies with sites like TrueCelebs.com can get away with publishing celebrity content? Woudn't APIC go directly for the largest celebrity violators if their goal is to clean the net of copyright infringement.

Steve Easton from APIC (monitors stolen content on the internet) writes on YNOTmasters.com: APIC works with Mitchell Kamarck and Lin Milano. We only represent about 15 celebrities. We go after all sites, including the big ones. CEN has complied to all of our requests. They also remove anything that is knowingly Playboy. I do not support the celebrity sites at all, but until the celebrities get involved, there is little we can do. Roy, was a repeat offender of copyrights on several sites. The infringers never tell the whole story, just the part that makes them look like a victim.

Small AVS [Adult Verification Services] sites add up to a big piece of the pie. People are complaining that traffic is down? business isn't what it was? How can you compete with an ADULTCHECK GOLD membership when they have every bit of stolen content there is? ADULTCHECK.COM is the website. The small AVS guys are the ingrediant making ADULTCHECK rich by doing the dirty work. In the meantime, ADULTCHECK's attorneys sue everyone that infringes on the idea of AVS. Try using ----check in an AVS domain. However they do not respond to any infringement notices. It's companies like that, that are destroying the entire industry.

Skitz writes: Luke, You know I have my had problems with CEN. I recently retracted a statement I made about them, and even though there's no strong animosity between me and JoeE any more, there's no loss of love either. HOWEVER, I have to say, that this AOL lawsuit is a witch-hunt, and I think you're contributing to it. I used to work at the same group of desks as the guy who was in charge of dealing with spammers in CENs programs, and I can tell you, they did not take it lightly.

In fact, I felt they were unnecessarily brutal to people caught using email spam. Most had their accounts shut off immediately, when CEN became aware of any spamming done by one of their affiliates. I always felt a warning would be better. Whether the webmasters were producing one or 100 signups daily, ALL were cut off if they were caught spamming, without mercy and without a second chance.

Further, I have had a backup AOL account for almost two years. Whenever I got any adult spam, I would always trace the source, and send an email to whomever the spammer was using for sponsors. In all that time, I never received an email from a site flying CEN banners.

I know you are interested in the truth, and so am I, which is why I admitted my lie publically. The truth is that CEN has zero tolerance for spam. They have been particularly stringent in this since the UUNET problems a year ago. John Bennett is a smart man, and would not encourage a behavior that has the potential to bring down his company.

A Conversation With Fantasyman Ron Levi

Last week, Fantasyman aka Ron Levi, the owner of Cybererotica and the most influential and powerful man in internet pornography, sent out the toughest email of his career, advising webmasters that he was lowering payouts for many of his programs.

It was another sign of a tougher leaner internet economy.

Surprisingly, Levi's email, which contained the headline "The Humbling Of Cybererotica," has drawn praise from around the industry for its forthright attitude.

Not all webmasters, however, were impressed. Last week, I received email from VeronicaSnake, an anonymous porn webmaster who's attacked Cybererotica.com owner Ron Levi on the boards for years.

I forwarded Veronica's emails to Levi and then talked to him over the phone.

Levi: "I don't think Veronica needs to be responded to. I'm Ron Levi. Everybody knows who I am. There's a face. There's a life. There's a reputation. You know I won't respond to anonymous posters. I will answer your questions."

Luke: "What happened after you sent out that email last week lowering some payouts?"

Levi: "I was concerned but when I sent the email out, we had a bigger day [in traffic] than the day before. And yesterday was a bigger than that day.

"My biggest program, the one that brings me the most signups, is my Follow Me Free program. I didn't touch that program because it's fine. Six of the free programs I didn't touch. All I did was move back down some programs that I had moved up.

"And let's not forget that I am giving away a $110,000 Hummer. We're bringing Snoop Doggy Dog into the Players Ball.

"Click on my inside board and read webmaster's comments. There hasn't been a blip in their support."

Luke: "What happened with MrSkin?"

Levi: "The MrSkin thing, you can appreciate this by the way I explained it in that email. This guy [MrSkin] is a jackoff. I tried to get him to move his membership billing [from visitors who come straight to MrSkin.com, rather then get sent through CE's banners] from $24:95 to $39:95 and he wouldn't do it. So, ok dude, I will come down to your figure. What else could I do? I had all these people cancelling.

"MrSkin operates his own site. We just a partnership deal [for traffic].

"Why am I unethical for doing business with someone who's unethical?

"We didn't make any hasty decisions. We ran the numbers and found we could not keep up certain payouts. We had to cut them.

"We keep our members longer than anybody because we have more content than anybody. If you compare us to CEN, IGallery or MaxCash, it's not even close. No lo contendre.

"The bottom line is that I have some $45 programs that I've reduced to $40, and some $50 programs that I've reduced to $40. It doesn't take a rocket scientist to figure out that if I am signing people up for $39:95 and paying people $50 for that signup, and with credit card processing charges, I wasn't making money. I'm still paying out more than the industry average.

"For a $39:95 signup, I probably net about $34 after paying the credit card processor. And I pay out $40 for that signup.

"This reduction in some payouts isn't a doom and gloom thing. This is an in-depth analysis.

"When I change a payout up to $45 and $50, it really costs me that. Because I don't shave signups. These other guys raise their payouts and start shaving people. Very much like Xpics did in their day. And that's why I couldn't chase them up to 18c per click way back when.

"I have never done blind cross billing. It is done with full disclosure. Let's say somebody signs up for Cybererotica. They hit submit. The credit card gets approved. They then get offered another web site for a free ten days that will turn into billing. It's done with full disclosure. It's passed scrutiny. It's marketing. I've been doing this forever. If you buy Cybererotica, you get offered Clubpix Teens. If you buy Clubpix Teens, you get offered XXX Password. This is nothing new."

Luke: "Do free trials cause more chargebacks?"

Levi: "Ok, let's say you have 100 signups for that $1:95 trial. That means you have to deal with a 100 people on that $1:95 trial when only 50% are going to convert to a paid trial. Now you've injected 100 people into your E-commerce billing structure that you have to deal with through your customer service cancellations and all that. We do a free trial. We make sure that the credit card has that much room on it, like reserving the $39:95 [membership rate]. We go through our trial period and deal with cancels, never doing any E-commerce with them. Then when we go to bill them, we're dealing with 50%...

"So we have half of the potential risk. Those other people who billed the $1:95, it could turn into a $100 chargeback.

"The reason that the free trial was no good was that DMR, IBill and the other third party billing companies used to offer that stuff and they never policed the pages. There wasn't full disclosure. A guy could say free, free, free and not say you're going to get billed. And because of all the unethical signup pages and tours out there, not being policed by those credit card agencies, it became a problem.

"We've always maintained that we've never had a problem with chargebacks from free trials. And if you're only dealing with half the people to start with, isn't it just reasonable to realize that you're going to deal with half the amount of problems."

Oz, who runs the TrueCash.com affiliate program, writes in the latest YNOT Adult Webmaster online magazine:

Why the big hubbub over this [Ron Levi] email? It is the first time, at least to my knowledge, that a major sponsor has stepped up to the plate and ANNOUNCED that payouts were being LOWERED. And why am I so bowled over by this announcement? Because it is a symbol to me that on-line adult is ready to dump the training wheels, grow up a little bit, and face reality.

I see the same numbers and trends he does: we are dealing with an industry-wide problem of extreme product saturation, diminishing paysite member retention, and rampant webmaster fraud...

If I was like some other (UN-NAMED) program operators I would simply continue to raise payouts while cutting webmasters off at the knees.

MR HABERSKI apparently had on CHEYENNE SILVER'S site, according to your friday interview, pictures of her 4 year old daughter, not to mention pictures of her teenaged brother, a prom date, and pictures of CHEYENNE when she was a child. When asked to take the pictures down, MR HABERSKI declined several times and finally a cease and desist letter was sent to him.

According to the interview, STEVE AND MARCIE HIRSCH, OWNER and VP of VIVID VIDEO not only knew about the minors but condoned it. CHEYENNE SILVER is a contract girl for VIVID. For them to plead ignorance is pure nonsense. VIVID VIDEOs own webmaster reviewed the content-the site was up for months and VIVID was the top banner advertiser. VIVID was making money from a PORN site that had a 4 year old girl on it. So what is to be done about this?? What do readers think of STEVE HIRSCH of VIVID VIDEO allowing this to go on.
