FBI's Friendly Conversation With Rob Spallone

I hear that federales grabbed Rob Spallone at James DiGiorgio's office this morning. [I learn later this was all invented.] Jim has no comment.

I hear that the folks who nabbed Rob wore suits. Rob was taken away for questioning. He should be back in town in a few days.

This "questioning" or "talking to" Rob is such a very big surprise. This friendly conversation has nothing to do with porn.

I've had multiple conversations with Jim today and apparently he's taken the vow of Omerta (silence) on this matter. No matter how I try to open him up, he don't say jack.

All in all, a very big surprise. Nobody knew this was coming. Ahem. Yes sir, that's my story and I am sticking to it. I am shocked and amazed that my good buddy Rob Spallone, who I've always known to be a law abiding citizen and a mild mannered Roman Catholic with a Jewish mother would be taken away by the FBI for questioning. It must be one big giant misunderstanding.

Best Rape Films

Pat Riley writes on RAME: Seeing that the American ones are only available from the archival houses such as Alpha Blue, I very much doubt anyone is going to put them on DVD. The Japanese are apparently embarrassed about the whole Nikkatsu era according to Weisser and I doubt they're going to re-issue them. Even he doesn't seem to sell them although this could of course change. Is there enough money in them to take the risk?

BTW, don't call them "roughies" otherwise they'll get categorized with the nudie-roughies of the sixties, a genre of far greater appeal to the raincoater. (Degradation of the female versus forcing the female to accept sex.)

As to taste, Waterpower and Winter Heat are among the best (i.e. most erotic) porn ever made; Jailhouse Girls is good but they fudge the body cavity search scene and the after the initial rape scene in the van, the movie deteriorates; Little Orphan Dusty is badly made with a not very attractive Rhonda Jo Petty; Forced Heat has some really ugly hippy types and was also badly made; Summer In Heat only has the last scene in the category of rape and it's not very satisfying; and Defiance has a not too pretty Jean Jennings who (another reason it won't be re-released) was 17 when the movie was made. There are quite a few other explicit ones from the seventies (e.g. The Virgin Rape) but these are some of the most prominent.

Mainstream has some good rape movies too and of course with mainstream you get superior acting and cinematic values. Harem with Nastassia Kinski and Ben Kingsley, Tattoo with Maud Adams and Bruce Dern, and Straw Dogs with Susan George and Dustin Hoffman (?) are three that come to mind. Pity that the feminists and the politically correct forced the genre to stop.

FTC Adjusts Case Against Verity, Crescent

A preliminary injunction issued in the matter of Federal Trade Commission and the People of the State of New York v. The Crescent Publishing Group, Inc., et al., by U.S. District Court Judge Lewis A. Kaplan bars the defendants from conducting business on the Internet without first obtaining a $10 million bond that could be used "to satisfy any judgment entered against the defendants" following trial. The injunction also prevents the defendants from transferring assets to shareholders, officers and directors of their companies; requires repatriation of offshore funds; and requires clear and conspicuous disclosure of any charges for Web-based services.

The Commission has authorized staff to file with the court to amend a previously issued complaint regarding the following: Verity International Ltd., et al. The FTC brought this complaint contending that Verity International was involved in illegally billing consumers in connection with the provision of adult "videotext" services. The amended complaint clarifies that it covers unfair and deceptive practices engaged in by the defendants prior to the direct billing that was the focus of the original complaint; adds Automatic Communications Limited, a Bahamian corporation, as a defendant; and charges that the defendants deceptively failed to disclose the cost of their "adult" entertainment services before providing access to, and billing for, such services.

Mike Souths Gossips About Extreme

Mike South writes in his March column for AdultStarsMagazine.com: The biggest news this month all revolves around Extreme Associates. For starters, Adult Video News Magazine has served them with a lawsuit for failure to pay for their advertising. Open Directory Editors Change Rules To Discriminate Against Porners

Mel Kamins of GVA and attorney Lou Sirkin suggested I contact you regarding my legal problems. I opened my shop, Elyse's Passion, in October of 1999. I have recently been charged with obscenity and pandering. Please let me explain how a 15-year veteran Cincinnati court reporter got in this situation.

For years, before opening my shop, my area of keen interest and self-study was human sexuality. This led me into some wondrous realms, including philosophy and spirituality and their connection to sexuality. I wanted to do something with my life that I believed in and cared about -- sexual and political freedom. Over a period of time, having found a Feminism I could believe in, I became a Feminist for Free Speech.

Elyse’s Passion is a unique shop with a wide selection of serious sexually oriented books including Nadine Strossen's Defending Pornography, but also featuring sex toys and xxx films. I even have a parenting section with books like Joani Blank's "A Kid's First Book About Sex." It’s not a "sex in your face" shop, though I realize that some people prefer that. Through the customers who "get" my shop, I am rewarded greatly in spirit, though not big money.

The store opened just a few months after Larry and Jimmy Flynt reached a settlement agreement and pled guilty on obscenity charges regarding several videos offered for sale at their store here in Cincinnati, Hamilton County, Ohio. Our license is under “General Merchandise.” Advised by Louie Sirkin, I have carefully maintained a balance of 60 percent non-sexual to 40 percent sexually oriented merchandise.

I operated for 11 months with no problems from the city or the county (except two incidents over my sandwich board sign "blocking pedestrian traffic," resolved for $36 and attorney fees). Some friends have suggested that I wasn't bothered because my location was so terrible that most people didn't even know I existed. The authorities thought that by ignoring the "problem," it would go away.

In October of 2000, I moved my shop to a more visible location. My shop is tasteful, classy and upscale (my lease even has stipulations as to window displays). It is half-a-block from The School for Creative and Performing Arts. That has caused controversy and brought publicity. My landlord, who is an attorney, wrote to a local paper defending his decision to rent to me.

I feel that a thoughtful, serious approach to merchandise presentation in a store featuring some sexually oriented merchandise sends a healthy message to people. I certainly wasn't trying to "pollute" minds. Finding space to create such a store in Cincinnati has been very difficult.

Finding this space, with this supportive landlord, was a very positive thing. During the period prior to my move, the other shop in this county, Tip-Top Magazines, had a case on licensing issues pending in court and got many continuances over a long period of time.

Just after my move, the case was finally heard. Judge Winkler threw out the case against the store’s clerk (I believe the case against the owner is still pending). More importantly, he also threw out the sexually oriented business law as unconstitutional due to a lack of adequate appeals process. This ruling frustrated some members of our City Council and CCV.

Shortly after that decision, in what appears to have been an intentional maneuver, videos were ordered/purchased through my store by "someone," and I was charged with six counts of pandering and obscenity on three videos; three counts against Elyse's Passion and three counts against me personally. The movies were Jeff Stryker's “Underground,” Kitty Foxx's “Aged to Perfection 15,” and “Gangland 17.” Another store was also charged on the Stryker film, which had also been “special ordered.”

It turned out that the Stryker movie was one that Flynt had pled guilty to as part of the plea bargain in 1999. Neither my store nor the other store carried it in stock; in each case, someone came in and “special ordered” it.

I thought I was filling an order for a gay customer. At the time, I didn’t even know about the Stryker/ Flynt plea. I had been warned by GVA to stay away from Rocco videos, but this Stryker “special order” went through. The distributor recalls the order and is willing to testify it was a “special order” of an item I was not stocking.

Lou Sirkin has been very reasonable with his attorney fees for this upcoming trial, but he says he needs the "tools" to defend my case and the movies, meaning money for the expert witnesses. I don’t have this money. I survive on income from my shop, but that's about all. I am not a hypocrite--I have to make money, but I would have stopped a long time ago if the cash register was my only cause. I am not sure at this point whether the other shop owner is going to go through with his trial, but I know I do not want to back down. I won't feel good about myself if I have to give up. I am willing to go through this trial and whatever comes with that. I want to fight the good fight. I hope my fellow members at Free Speech Coalition will help me do just that.

Nonetheless, there is an issue, or more accurately a cause, in Cincinnati, Ohio which deserves the attention and support of any group dedicated to freedom of speech, expression, and ultimately thought itself.

The owner of a very small retail store has been targeted for having the nerve to offer adult oriented material to adults within the community with the insight to appreciate the untapped depth that exists in most relationships.

The store, named Elyse's Passion, and its owner are the embodiment of the principles which must certainly be the core concerns of any group focused on freedom of speech.

Unlike 99.9% of the adult store industry, this owner is on a personal crusade to educate society and to open minds to the range and potential of interpersonal relationships. The store (and the message of its owner) focus upon and seek to nurture both sexual and spiritual connections between consenting adults. Some consider variations of sexual behavior obscene and seek to smother the message, as well as the messenger. Regretfully, it's these closed minds that are targeting Elyse's Passion and seek to enforce censorship.

I encourage you to become familiar with this situation and support this independent woman whose devotion to a self-imposed mission and conviction to her ideals has lead her to stake her own freedom against a highly-rationalized warped sense of what is good for the community. Elyse's situation should become a rallying point for your organization. For too long she has fought a battle that proves free speech is not free. This woman needs and deserves your support.
