What's Going On At Cybererotica?

Various sources over the past few days told me that Cybererotica.com was headed for a bumpy ride. Monday morning, Cybererotica's owner Ron Levi told me that everything is fine at the company.

I've heard that Ron Levi, the owner of Cybererotica (CE) aka Voice Media, recently paid over one million dollars in credit card fines. I hear that some major players flew out to Los Angeles today to meet with Levi and company.

Ron Levi called me Monday at 10:15AM:

Ron: "Luke, it is amazing that you could not wait until talking to me. I do not check my email every day. We did not lose our merchant account. All webmasters payouts will go out as scheduled. Goodbye."

Levi hung up. He sounded angry with me.

I hear that there will be big meetings at Voice Media today, Tuesday and Wednesday before a dramatic announcement Thursday.

I've heard speculation that Levi may part ways with his business partner Paul Lesser, the former Hustler advertising manager.

I hear there's a battle on between Voice Media's principle players.

Ron Levi told two webmasters Monday morning that it is "BS" that Cybererotica is closing shop.

Until now, Ron Levi has avoided the problems that befell RJBTelcom and CEN, the two other biggest adult operations on the web. IGallery's parent company New Frontier (NOOF on Nasdaq) sustained a $25 million legal judgment last year. And Vivid Video is backing off its plans from the Spring of 2000 to go public.

Ron's peers have been full of talk that Levi's operation will eventually encounter the same obstacles that hit his competitors over the past few months. But so far, CE has not been sued by anybody significant, not the Federal Trade Commission nor AOL.

Most of l-keford.com's banner advertising goes to www.Cybererotica/money.html programs.

The most active webmaster posting board on the net, Netpond, is not up today. I hear they received attorneys' letters threatening them over anonymous posts. One such threat may have come from IGallery.

As you may know, dusty's board was a bit out of control with regards to anonymous posting, impersonations and false news reports. Both of the "never ending stories" were excessively personally abusive. While I and several of the other targets of those stories had discussed possible legal action, however we decided that much like any public figure we had placed ourselves in the spotlight and accordingly should expect to be attacked on a personal level.

NONE of the allegations represented on the former webmastersorg.com message board however are true whether personal or professional in nature. Additionally, neither myself nor Holly Moss of igallery ever posted on that disgusting board to my knowledge.

For myself and igallery the message board crossed the line between free speech and inciting libel when fake news releases were posted about igallery and when accusations of thievery and dishonesty abounded regarding conversioncash.com, our webmaster affiliate program (which by the way has been paying on time every week since it's launch.)

Our attorneys contacted the owner and let him know that we felt he was no longer just an innocent bystander, but that his actions and words were actually encouraging this libelous behavior. The same day as our attorney's contacted the former owner, he shut the board down. I believe that he felt that we were correct and that he did not feel like enduring a painful and expensive legal battle.

And yes... it is true... DGM Entertainment now owns webmastersorg.com which should be up later today via the domain name and is currently available at http://209.217.134.204/wmorg/index.php

I believe that the moral of the story is that we as a community are tolerant of a certain amount of name calling and finger pointing, but that when it crosses the personal line and begins infringing upon our business reputations we will no longer tolerate this utter lack of professionalism.

The other moral is "Don't f--- with people who have better attorney's and more money that you, because even if you win, you'll be broke in the end".

Bob Jones writes: Luke, with the warning about Cybererotica (I'm withholding a conclusion until more information is available) a question I've been asking a number of ways comes again to the foreground: How much money is there, really, in internet adult?

The common conception seems to be that this is a very high margin business. But the major players, the large webmaster payment rings, all seem to be in either legal or financial trouble. How high, really, are the margins in this industry after the credit card fines, legal bills, content fees, hosting fees, and advertising costs are added up? Is anyone, anyone at all, making high margins and high revenues for long periods of time and not in legal trouble? I've seen a lot of these folks brag about their incomes, but it appears to be mostly bulls---.

I think it would be really helpful for you audience if you could write an article running down the structure of the industry, its major players, and their status.

The impression I get is that the industry is structured into:

1) A small number of major payout programs;

2) A large number of free websites dependent on the major payout programs;

3) A large number of independent pay sites without payouts; and

4) Service providers, including Financial processors, content providers and hosting services.

It's obvious that there's a lot of money going into this industry, but where does it end up?

My theory:

Major Payout Programs --- Moderate margins, high revenues, low survivability. Linked networks of pay sites with a wide network of free sites, but also including the adultcheck-type structure.

Many provide own hosting, or branch into hosting for others. Content largely purchased.

Examples: Listing these is not worth the money to make their frivolous lawsuits go away.

Free Websites --- High margins, low revenues, low survivability. Advertising revenue from the pay sites or adultcheck structure. Pay for hosting. Content may be purchased, but is mostly provided by their advertiser or pilfered from newsgroups, other sites, etc.

Independent Sites --- Moderate margins, moderate revenues, moderate survivability. Individual (or closely related) pay sites that may advertise on free sites. Little content purchased, mostly self-generated or pilfered. Many provide own hosting, but pay high rates on connection fees. Examples: Independent specialty sites, video company/star sites, sites related to magazines or pre-internet providers with name recognition.

Service providers --- Low margins, high revenues, high survivability.

At bottom, is this industry anything besides multi-level marketing of entertainment, with legal problems thrown in?

Porn Welfare

Ian writes: Hi Luke. What a good idea from Michael, to establish some kind of welfare scheme for ex-porn performers down on their luck. In England, we have a 'Society for the relief of distressed gentlefolk' (!) as well as one for retired, impoverished actors and actresses (its name temporarily escapes me). These schemes must have seemed at first as strange as Michael's suggestion. His idea of website contributions (from site owners and surfers) sounds plausible, and might be supplemented by fundraising campaigns targeting sympathetic rich people (fundraising professionals would know how to do it) . Principal areas of difficulty would appear to be relate to who should organize the scheme, look after the funding, and decide on disbursements. The involvement of a large accounting firm sounds sensible, but more important would be finding blameless, disinterested and energetic organizers. As the industry's focus, AVN perhaps should get itself involved. Unfortunately, porn's bad reputation creates a difficulty with public acceptance, which would be valuable. It would probably be useful, initially, to research the history of the nearest-equivalent organisations abroad (including, for instance, the one mentioned above, for impoverished ex-actors and actresses). Perhaps some silicon billionaire might be persuaded to kickstart the scheme by financing a few rest homes for early beneficiaries.

Kevin and Darren Blatt Lose Friend

Kevin Blatt writes on YNOTmasters.com: I have just received some horrible news. My best friend in Cleveland was found dead on Sat. The cause of death I heard was a suicide, he hung himself. AOL Pursues CEN

From PCFormat.co.uk:

The company in question is Cyber Entertainment Network, one of the Internet's biggest porn site operators. AOL's lawsuit charges CEN and its affiliates with subjecting AOL subscribers - all 27 million of them - to a huge and ongoing spam campaign.

The key words in that last sentence, by the way, were "and its affiliates". This is the first time anyone has tried to hold an adult site operator responsible for the naughty behaviour of sites it does not own. CEN's affiliates are paid to channel traffic on to CEN's porn empire, and, inevitably, some of them resort to the unimaginative but cheap tactic of bulk e-mailing to drive up the numbers. It's this activity that AOL wants to attack, arguing that the HTML code CEN uses to credit these affiliates implicates it in their activities.

AOL's suit asks for an immediate injunction, and $25,000 for every day CEN's affiliates spammed AOL users - a figure which would rapidly climb into the millions. If successful, AOL's suit could have beneficial effects on the on-line porn business as a whole, forcing CEN's contemporaries to kick their own affiliate networks into line, and perhaps resulting in a lot less unwelcome e-mail for all of us.

Flynt Jettisons Parts of 'Cambria List'

Even as adult video companies warily eye George W. Bush and the Ashcroft Justice Department, Hustler honcho Larry Flynt has indicated to his staff that their film productions will maintain the same level of hard-core material as they did during the relatively freewheeling days of the Clinton Administration.

Flynt, along with several other porn-company owners, had been mulling a list of guidelines -- the so-called Cambria List, drafted by Hustler's legal advisor Paul J. Cambria Jr. -- that advised the industry to curb some of its most extreme offerings, mainly in the areas of female degradation (e.g., rape scenes) and bizarre sex acts (e.g., urination outside of a natural setting).

Last week, however, Flynt circulated a revised version of the list, indicating with check marks which guidelines were to be followed and leaving the other items unmarked, thereby approving them.

According to Mark Kulkis, director of sales for Hustler Video, two of the filmed sexploits that Flynt said will continue are interracial scenes and ''facials.'' Most of the acts that Flynt declared off-limits -- among them, male-on-male penetration, intercourse involving transsexuals and two penises in or near the same mouth -- were already proscribed in the Hustler catalog.

Realist Closes

LOS ANGELES (Reuters) - In the days before shock jocks and cyberspace, when abortion was illegal and smoking in public places legal, an irreverent journal called The Realist made its debut, championing the concerns of an emerging counterculture. Now, after more than 40 years as granddaddy of the alternative press, it has ceased publication with an issue mailed out to subscribers last month labeled "Spring 2001."

Krassner's favorite piece in The Realist is also what critics say was the publication's most outrageous: "The Parts Left Out of the Kennedy Book," which appeared in 1967 at the journal's peak circulation of 100,000.

It claimed to be material removed from William Manchester's JFK biography, including a section describing Lyndon Johnson committing a sex act on the slain president's corpse.

"The Realist has had a tradition of never labeling an article as satire or journalism because I never wanted to deprive the reader of the satisfaction of discerning for themselves whether something was true or a satirical extension of the truth," Krassner said.

He co-founded the Yippies in 1967 and in the late 1970s served briefly as editor of Hustler magazine -- a job offer he says was too absurd to refuse.

And Krassner is working on two novels: one about a porn film made for senior citizens, the other involving a comedian who is tried for murder.

Rumdar writes: Luke.... I used to read The Realist in the late sixties (still have a couple of copies). Even marched in an anti war demonstration with Krassner, Phil Ochs, Allen Ginsberg and a cast of thousands. This is the umpteenth time the Realist has folded (and returned). While Krassner and The Realist were right for the sixties these days it seemed embarrassingly dated.

Titus Moody R.I.P.

Hank Rose writes: Luke: How could you have left out, skipped or overlooked news of the recent passing of loveable Titus Moody? Have you not turned your site over to the wolves to use as a stomping ground for their endless petty blood feuds? What happened to the real news? Titus was a real people aberration in this industry, but a legend in his own time nonetheless. He will be missed.

There are actually a small percentage of good people who populate this industry who deserve equal copy with the trendy malcontents and in vogue misanthropes on occasion. Titus was a man without a carnal country in a raunch realm where each erotic ego is an island in itself. He was a lost soul from nowhere who became a whimsical porn pioneer in Hollywood way before both average and beautiful people discovered it and either made it pedestrian or tainted it with their ugly personalities.

It is the end of an era. Porn has become fast food where it was once a rare delicacy in the Golden Age. It has lost it soul and traded in the heat of plot and characterization for the vanity of nude beauty pageants and robotic hardbody sex. No wonder why Paul Thomas is known as a snob. He has right to be. For if you were not a porn star back in the beginning, you are not larger than life and never will be.

Today you are sex TV and Internet streaming video. The movie screen of Titus Moody's life was 40 feet tall and larger than life. As each old school vet falls to pasture and by the wayside, it becomes more and more evident than all good taste and pop culture has died with the second millennium. What's new is not best. And what's old is missed. Titus never had the chance to grow old because of the same kind of cutthroat rogues and scoundrels you glorify on these pages. But now Titus belongs to the ages. And the ageless. May he rest in peace.

Lynne writes: I have always been socially marginalized, by my misfortune to have grown up in a dysfunctional family, by my intellect, by porn; you also, have been in similar positions, and you probably have a stronger craving for "normalcy" than both.

I don't recognize you as aberrant just because you are socially marginalized -- some of the most interesting people fall into that category, nor do I find it aberrant that you do not fit into a religious community, or that you disobey Jewish laws and teachings (as long you make an effort not to offend my ethical principles, which are far more exacting). I admire a man who sticks to his commitments in a destructive and dangerous environment far more than one who never exposes himself to temptation.
