Diallers Comeback

David Knell (Dave@netdialers.com) writes on his site: The adult internet entertainment industry in the US is currently coming under fire from the FTC, who have recently launched cases against a couple of significant players. The first of these is Verity International, who provided a Madagascar termination for use with diallers. This route cost users $3.99/minute to connect to adult content, and had been running for some time, firstly with the calls being routed through (and billed by) AT&T, and then by Sprint. Towards the end of September, Verity began to bill for the calls itself, via Integretel, who are a major player in telephone billing in the US. By the second week in October, the FTC had successfully persuaded a court to freeze their assets, on the grounds that their billing was illegal as a) the calls didn't go to Madagascar, but to the UK, and b) that, under US law, the people being billed had no obligation to pay Verity for the services received.

Was this action surprising? Personally, I don't think it was, and I'm surprised that it was so long in coming. Billing users at $3.99/min to download porn from the internet is certain to result in a large number of users having large bills - the average bill sent out by Verity was $220, according to the FTC - which, in turn, leads to large numbers of complaints which, inevitably, results in the authorities taking action.

More recently, the FTC have let fly at RJB Telecom. Their main complaint against RJB appears to be that they have fraudulently debited people's credit cards - people who had "never heard of RJB Telecom" were finding RJB bills on their credit card statements. Now, we know full well that: there is a large amount of credit card fraud perpetrated against webmasters -

people who sign up and then deny all knowledge when the bill arrives;

that there is a large amount of credit card fraud on the internet in general, from people using stolen or invented credit card numbers:

this isn't just an adult industry problem; that credit cards are inherently insecure - just flicking through recent receipts, they all carry the card number and expiry date, which are all that's needed for small-value purchases.

RJB's use of diallers is also part of the FTC's complaint, although this is on a rather smaller scale than their credit card problems. Again, the complaints relate to calls to Madagascar, but, this time, during a period when the route was being billed by AT&T. Users complained about receiving charges on their telephone bills which they'd not authorised - maybe this is true, but AT&T are hardly likely to be in cahoots with RJB to bill users for telephone calls which were never made. Nonetheless, AT&T have refunded 28.6% of the revenues billed as a result of consumer complaints.

What does all this tell us? Well, the following conclusions might reasonably be drawn:

If you overcharge for something, people will complain.

If you don't tell people how much something costs, and then bill them, they'll complain.

Credit card fraud on the internet is a problem which may threaten your business, possibly through no fault of your own.

So - should you offer surfers a dialler? We believe that you should, if they're from Europe, where we use legitimate domestic premium rate (1-900) numbers and comply with regulations issued by bodies whose role is just to regulate that industry. You can probably offer US surfers a dialler, provided they're not being charged a fortune: our UK route, for example, will be billed to them at 10c/min if they're on an AT&T calling plan, or 11c/min on MCI, and still pays an average of about 9c/min back to you. You should ensure that the dialler you're using requires them to agree that they are over 18, and that they pay the phone bill, or have permission from the responsible party. And don't forget to ensure that the dialler tells them how much the call is likely to cost.

Poor Craig Vasiloff

I was sitting here feeling sorry for myself, when I started thinking about others who have it worse. What about poor Craig Vasiloff, my former boss?

FTC Crackdown Cuts Into Luke's Pocket

Now I'm mad. The Federal Trade Commission can crack down on porners all its wants, but now they're hurting me. I've been writing a widely read and intellectually stimulating column of porn star gossip for the prestigious journal of thought www.strokemag.com.

COMMERCE

12. At all times material hereto, defendants have been engaged in the business of offering for sale, selling, and billing for, Internet-related services, including access to the Internet and other products, in or affecting commerce, as "commerce" is defined in Section 4 of the FTC Act, 15 U.S.C. § 44. DEFENDANTS' BUSINESS ACTIVITIES

13. Since at least January 1999, defendants have sold, via the U.S. mail, access to the Internet and other Internet-related services ("Internet service") to consumers and small businesses (collectively, "consumers"). Defendants charge consumers $19.95 or $29.95 per month for their Internet service. Defendants arrange for these charges to appear on consumers' local telephone bills.

14. Defendants mail checks for $3.50, and an invoice-like form attached to the check, to consumers throughout the country. Any consumer who deposits or cashes defendants' checks is automatically signed up by defendants for their Internet service. Defendants than charge consumers $19.95 or $29.95 per month.

15. Defendants' check and the invoice-like form represent that defendants have a prior or ongoing business relationship with the recipient of the mailing. The face of the check includes the consumer's name, and next to the "RE," the consumer's telephone number. The detachable invoice-like form includes numerous categories, two of which are "Account Number" and "Invoice Number." The face of the invoice-like form includes, under "Description", the letters "ISP-SUB." Nothing on the face of the check or the invoice-like form alerts the consumer that depositing or cashing the check signs the consumer up for defendants' Internet service at $19.95 or $29.95, plus taxes.

16. Many consumers process defendants' checks as they do all other checks they receive, and do not know that they are signing up for Internet access at a monthly fee.

17. Defendants claim that they send those who deposit or cash their check a compact disc ("CD") with software for using the Internet service. However, because many consumers do not know they have been signed up for Internet service, they have no recollection of receiving the CD.

18. At some point, consumers discover that defendants have signed them up for defendants' Internet service and are charging them monthly. In many instances, because of the unexpected placement of defendants' charges on their local telephone bills, many consumers discover they have inadvertently paid the charges for many months despite the fact that they never used defendants' Internet service.

19. When consumers do notice the charges, they contact defendant Olympic Telecommunications, whose telephone number often appears on their telephone bill next to the charge from defendant Cyberspace, to complain that the monthly charges are unauthorized. In many instances, a customer service representative from defendant Olympic refers the caller to defendant Cyberspace. However, the caller is often unable to reach defendant Cyberspace by telephone or otherwise to find out about the unauthorized charge. When they do reach defendant Cyberspace, consumers learn, usually for the first time, that they have been signed up for defendants' Internet service at a monthly charge of $19.95 or $29.95, plus taxes.

20. Defendants' policy is that consumers can cancel the Internet service at any time. However, consumers experience numerous difficulties in trying to cancel their account. Consumers try to cancel via defendants' automatic cancellation telephone system, where, in many instances, they experience difficulty and are unable to cancel. In other instances, defendants promise to cancel the account for the future, yet defendants' charges continue to appear on customers' subsequent telephone bills.

21. Defendants' policy is to provide a full refund if a subscriber cancels the account within 30 days of depositing or cashing the check. However, consumers are unable to cancel within the 30-day full refund period because defendants' charges first arrive well after the 30-day period has elapsed. Even when consumers are able to cancel within the 30-day period, in many instances defendants do not provide a full refund.

COUNT ONE

23. In numerous instances, defendants have represented, expressly or by implication, that consumers who receive defendants' charges on a bill are legally obligated to pay for those charges.

24. In truth and in fact, in numerous instances, consumers have not agreed to be charged and are not legally obligated to pay defendants' charges.

COUNT TWO

26. In numerous instances, defendants have represented, expressly or by implication, to consumers that defendants' solicitation check is a refund, rebate, receivable, or other payment for services based on a prior or ongoing business relationship.

27. In truth and in fact, the solicitation check is not a refund, rebate, receivable, or other payment for services based on a prior or ongoing business relationship; rather, it is a check which, when cashed or deposited, defendants use to initiate a business relationship by signing up the consumer for defendants' Internet service billed monthly on the consumer's local telephone bill.

COUNT THREE

29. In numerous instances, defendants have represented, expressly or by implication, that consumers who receive defendants' solicitation check for $3.50 may deposit or cash the check.

30. In truth and in fact, defendants have failed to disclose clearly and conspicuously the material conditions associated with depositing or cashing defendants' solicitation check, including, but not limited to, the conditions that upon depositing or cashing the check, defendants: (a) will sign up the consumer for defendants' Internet service; and (b) will place a monthly charge on the consumer's telephone bill for defendants' Internet service.

Gore Chastises Porn Industry On One Hand But Counts Campaign Cash With Other

From the 10/23/00 Insight magazine: With GOP presidential candidate George W. Bush narrowly taking the lead again in the topsy-turvy opinion polls, you would think that Vice President Al Gore would be careful not to spurn the backing of any voters, especially super-rich ones able to promote his candidacy to millions of people. But there is such a group - the nation's pornographers.

They don't fit into Gore's family-values vision of an America safe for family, home, apple pie and God. That's the public stance. And on the eve of the Democratic convention the vice president finally scotched an election fund-raiser from being held at Hugh Hefner's legendary Playboy Mansion.

In September, Gore aides were less than enthusiastic when the vice president was endorsed by luminaries from the Internet adult- entertainment industry who were gathered in New Orleans for a trade bash sponsored by firms operating the Web sites Kara's Adult Playground and XXX Password. Gore representatives insist that the adult-entertainment folks are much mistaken if they think the vice president looks upon them any more favorably than the Republicans. That's in public.

In private, operators of several X-rated Internet sites have been promoting Gore's candidacy among features offering Teen-age Girls and We've Got What You Want. "That's nothing to do with us," says the Gore camp.

But while Democratic chiefs have given the thumbs down to the thumbs up from the adult-entertainment world, they have been pocketing campaign donations quietly from one of America's most infamous adult-shop owners. Denver-based Edward Wedelstedt, who runs more than 70 sex stores nationwide, has contributed more than $10,000 to Gore and the Democrats since 1996. One of his sex shops in Texas was raided last month by federal authorities.

Not much cash for a big porn honcho, you might say. True, but in most cases he gave the maximum allowed under election laws and, further, the Democrats have not returned any of the donations. Wedelstedt isn't alone among porn-industry figures in donating cash to the Democrats. Chicago businessman James Levin, who owns a string of strip clubs, has given $2,000 to Gore. He's also twice slept in the White House. "This really is a hypocrisy for Gore to be talking about cleaning up the entertainment industry in one breath and accepting their support in another," says Rep. Judy Biggert, R-Ill.

From AP: RJB Telcom of Scottsdale, Ariz., was sued along with its principals for offering a free "viewer" or "dialer" program to access free adult material. The government alleges that without consumers' knowledge, the program disconnected users' computers from their own Internet providers and made an international call--typically to the Caribbean--to another Internet provider. Without their knowledge, consumers racked up hefty long-distance charges, the government alleged. The company and its executives also are accused of billing credit-card holders for services that consumers say they never used.

FTC Charges Overseas Firm With Illegal Billing in Connection with Provision of Adult "Videotext" Services

FTC Press Release: The Federal Trade Commission has charged Verity International, Ltd. (VIL) and its principals with misusing the international telephone billing system to charge consumers for "videotext" services -- Internet-based "adult" entertainment -- that the consumers never purchased or authorized. Through the scheme, thousands of consumers have been billed an average of nearly $250 apiece for videotext services that they did not even know had been accessed through their phone lines. The charges for VIL's videotext services were represented as international telephone calls to Madagascar, an island nation off the east coast of Africa. The U.S. District Court for the Southern District of New York has issued a temporary restraining order halting the alleged law violations and freezing the defendants' assets.

The FTC's lawsuit stems from a dramatic influx of complaints against VIL that were received since September 18, 2000, through its Consumer Response Center (CRC) and logged in Consumer Sentinel, a database used by law enforcers around the world.

"The Commission's toll-free help line really empowers consumers," Bureau of Consumer Protection Director Jodie Bernstein said. "When so many consumers call about one issue in such a short period of time, we not only take notice, we take action." Consumer fraud complaints to the help line, 1-877-FTC-HELP, are entered into Consumer Sentinel.

The FTC's rapid-response investigation revealed that charges on consumers' phone lines were being initiated by "dialer" software downloaded from teaser "adult" web sites. Many line subscribers have no idea why they are receiving bills for these charges. Others have discovered that a minor in their household -- or another person who did not have the line subscriber's authorization -- accessed the Web sites and downloaded the VIL dialer software.

The dialer program allowed users to access the adult content without any means of verifying that the user was the line subscriber, or was authorized by the line subscriber to incur charges on the line for such videotext services. Once the dialer software was downloaded, it disconnected a consumer's computer modem from his usual Internet service provider, dialed an international phone number to Madagascar and reconnected the consumer's modem to the Internet from some overseas location, opening at an adult web site. Line subscribers -- the consumers responsible to pay phone charges on the telephone lines -- then began incurring charges on their phone lines for the remote connection to the Internet at the rate of $3.99 per minute.

In its complaint, the FTC alleges that although VIL's bills deceptively represented that the calls reconnecting consumers modems to the Internet terminated in Madagascar, in fact they were "short-stopped" in London or some other location. Thus, line subscribers were charged the rates to Madagascar at $3.99 per minute, compared to about $.08 per minute to London.

According to the Commission's complaint, VIL, an off-shore corporation; Integretel, Inc. of San Jose, California; eBillit, a subsidiary of Integretel, located in San Jose, California; and Robert Green and Marilyn Shein, both citizens of the United Kingdom, violated the FTC Act by:

Misrepresenting that because a line subscriber's telephone was used to access videotext services, the line subscriber is legally obligated to pay for those services, whether or not the line subscriber actually accessed such services;

Billing and attempting to collect from line subscribers whose telephone lines may have been used to access videotext services, but who did not themselves access such services or authorize anyone else to do so;

and Misrepresenting that line subscribers owed money for a remote connection to the Internet through Madagascar, when in fact the connection was through a location with a much lower per-minute rate.

Integretel, a service bureau and billing aggregator, through its subsidiary eBillit, sent more than 67,000 invoices to consumers during the second week of September 2000. Another 44,000 bills were sent out the following week, the Commission contends.

Line subscribers who tried contacting VIL through its toll-free number found that it was nearly impossible to reach a customer service representative. Those who did reach a representative were not given an opportunity to dispute the charges or explain why they thought the billing was in error. In fact, Integretel representatives falsely insisted that, regardless of the explanation, line subscribers are responsible for the charges for videotext accessed over their telephone lines.

In all, the FTC received nearly 600 consumer complaints about VIL in just a matter of days, beginning September 18, 2000, resulting in the staff's investigation. Through the complaint announced today, the Commission is seeking injunctive and other ancillary relief, including consumer redress, disgorgement and restitution to prevent and remedy the violations alleged. This may include refunding money that consumers paid to the company and its principals and disgorgement of ill-gotten gains, along with any additional relief a court deems proper.

I respectfully disagree with the last part of Luke’s statement. I think women know exactly what they like in vids, the same way we know exactly what we like in bed. Sometimes it's hard to find the right video when there are so many of them on the market. Women shouldn’t be intimidated by the fact that the business is aimed at men. There are a lot of good videos out there, but you might have to wade through a lot of guck to find them, but that’s the point of writing this column.

And when someone talks about them for 30 minutes it just wastes my time. You should split the 2 hours and have a co host for each hour or something. I dont think you will keep listeners this way. Companies like RJB Telcom are the reason why! Anyway, some credit card issuers have come up with the following solution, to be available to cardholders soon: If you want to make a purchase with a credit card online or in a suspicious situation, you can get a new, unique credit card number that will be linked to your regular credit card number. Here's the catch: The new, unique credit card number can only be used ONCE. For example, if I wanted to try the "free sample" at RJB Telcom, I could use the unique number and be assured that I would only be charged the $2.95 fee. Any other attempts to charge the card would automatically be denied. In the future, if I wanted to continue doing business with RJB, I would simply give them my regular credit card number. This service is expected to be available soon, either for a percentage fee, flat fee, or free depending upon the card and your level of card (classic, gold, platinum, etc.) So in the end, the credit card companies are going to beat unethical online people at their game.

What's The Deal With Mike South?

R. Kleinman writes: I am the other documentary maker involved in the Nightmoves shoot, and prior to this episode I had absolutely no connection to the adult film industry nor had I ever heard of Mr. Mike South. However, after learning of the accusations Mr. South has made against my colleague, I would be remiss not to weigh in.

First off, no footage was ever taken without express oral permission. Since we were in Tampa precisely to tape face-to-face interviews, it would have been utterly pointless for it to be otherwise.

Second, my colleague is a reputable film maker who is the named editor of record for a legitimate feature film currently running in theaters. The fact that "Mr. South" was unable connect this person with "Mr. Scorbick" is actually rather laughable given that, as Mr. South should well know, the porn industry is understandably reliant on the use of pseudonyms. In other words, it's almost difficult not to titter at Mr. South's alarmingly non-deductive thought process on this particular point. I trust that he displays greater acumen in other aspects of his life.

Third, the use of varying microphone covers (everything from the BBC to a mouse-ears silhouette) was done both transparently and as an artistic element of the movie we were producing. When asked about the microphone covers, we were always forthright and truthful. If Mr. South was confused by the mouse ears, hammer and sickle, BBC or CNN symbols, I apologize that we inadvertently created a situation which proved to be so puzzling for him.

Finally, my colleague is an ethical professional who plays by the rules. As such, we were welcomed into the Nightmoves event with open arms and treated with kindness and respect. Mr. South's hostility was an aberration. Perhaps he is merely upset we never sought to interview him?

Documentaries My Ass

Mike South replies: OK Luke just to clear this up, let me go on record here and suggest that I HOPE these two morons release thier "documentary" as I suspect they will have major problems in doing so, from no maodel or material releases to the use of trademarks without permission. It should also be noted here that George Martin of GM Video OWNS the rights to that show, anything they release had better have his written permission or he too could decide to seek relief.

Ok Im done with these two morons I have better stuff to do, you guys go back to your rooms in mommies house and write some more stuff. In the meantime I have been working on a REAL mainstream documentary by what may turn out to be an academy award winner...we will know after this years nominations and awards.

Ian rejoinds: Surely hiding money from the IRS is tax evasion, not laundering. Money laundering is different, occurring when money which has been illegitimately obtained is transformed into money which can be freely disclosed for tax purposes because it appears to have been legitimately obtained. A criminal might arrange to get some kind of minor work in a film for which he bills the production company $100k, which he has no expectation of receiving and they have no intention of paying. As far as the IRS are concerned, his receipted bill legitimates $100,000 in his possession, which he can disclose for tax purposes. As far as the production company is concerned, the sum of money which it has pretended to pay the criminal for movie services rendered becomes a useful tax deduction.

Jamie Lisk writes on RAME: This was one of the most uncomfortable viewing experiences in my life. IMHO, the documentary was presented as an indictment of the porn industry despite what many Canadian reviewers say.

The filmmaker, Paul Cowan, seemed to prop up the all of the industry's horror stories and presented them as the norm. Weaved in amongst a soundtrack seemingly borrowed from the Exorcist is the Marc Wallace nightmare, Katie June and her mom and their disfunctional relationship, JD Ram's drug overdose-suicide, as well as, Luke F-rd, who seems to come off as a holier-than-thou messenger of the porn biz who is hated by everyone including himself.

Every business has it's horror stories, it's suicides, it's drug addicts. I liken the Marc Wallace scandal, to a madman running into a post office with a loaded gun and blowing away some of his co-workers. In the aftermath, one doesn't hold all the employees of the post office responsible for one man's psychosis. Yet, this documentary seemed to want to do this, it was absurd.

I felt like I had to take a shower after I watched this just to get the gook off. Someday I hope to see a documentary that focuses on the sexy side of the industry. The beautiful people, the money and the fun!!!! They do have fun sometimes don't they???????

John Doyle writes in the 10/27 The Globe and Mail: The Passionate Eye: Give Me Your Soul (Sunday, Newsworld, 10 p.m.). Several mainstream movies about the porn trade, especially Boogie Nights, created the impression of a family atmosphere in the places where they film cold, hard sex to peddle to the public. Give Me Your Soul, a rigidly non-judgmental National Film Board doc by Paul Cowan, finds something similar but lingers long enough over the family to find flaws and barely disguised despair. Cowan takes us from a porn-film convention to the grubby sets where the sex films are made. The star of Give Me Your Soul is Katie June Moon, an alarmingly enthusiastic wannabe from Tennessee. Accompanied by her mother, she poses for nudie pictures, does sex scenes with strangers and burbles about becoming a porn star. Watch to the end to read the epilogue about what happened to these sad, desperate people.

TORONTO (CP) -- Forget about The Sopranos. CBC Newsworld is up to here in bare breasts and the f-word in a pair of frank documentaries that look at both the porn industry and the plight of exotic dancers. First up on Sunday night's instalment of The Passionate Eye is Give Me Your Soul!, an unblinking look into the seamy, steamy world of hard-core moviemaking. While the subject is an easy one for an expose of the bleaker side of human nature, the National Film Board's Paul Cowan embellishes the obvious with some perceptive visions. Most dramatic is the profile of a woman who oversees her own daughter's XXX-rated movie career.

The following night, it's Live Nude Girls Unite! which affords ample opportunities to show nude women, but which also opens viewers' eyes to the odious working conditions of exotic dancers. Both documentaries will be visually censored with digital pixillation during their 10 p.m. broadcast, but will air uncut at 1 a.m.
