There are lots of nasty and nefarious things you can do to a website -- crack it, hijack it, black it out -- but one thing you can't do, no matter how evil your intention, is steal its domain name.
Even if you take it without asking and never give it back.
That's the upshot of the latest ruling in the long-simmering legal dispute over the ownership of the sex.com domain name. On Monday, U.S. District Court Judge James Ware dismissed a theft claim -- technically called a "conversion" claim -- against the convicted felon accused of hijacking sex.com, ruling that Web domains aren't property, and therefore can't be stolen.
If there was a crime committed four years ago when Steven Cohen obtained sex.com by allegedly forging a bogus letter to Network Solutions authorizing the transfer of sex.com from its original owner, it wasn't theft, the judge found. Although sex.com's a solid enough piece of virtual real estate to support Cohen's now multi-million porn empire, legally, it's not real estate at all.
The judge acknowledged that it's not totally clear whether property law should or shouldn't apply to Web domains, but emphasized that the job of clarifying the law rests with the legislature, not the courts. Legal experts seconded his opinion.

Globiz writes on Netpond: Why would anyone think Serge would be in trouble with the FTC over this billing thing? Does he have some sort of secret ownership stake in one of these companies? If not, then it doesn't seem like he has anything to worry about. All he did was sell them clicks, just like Hotbot, Yahoo, and whoever else used them as a sponsor. What they did with them afterwards is between them and their customers and the courts. You may rail on Serge for using blind links or whatever to send traffic to these guys, but it's no worse than AV or Hotbot putting up all those text links for their "specially selected sites" at the top of the porn search results and doing the same thing. And I don't see anyone saying their boards of directors are going in the dock anytime soon. As for JoeE...I doubt that an organized campaign is going to get anyone to drop him as a sponsor. He pays weekly. His checks don't bounce. And people can convert his programs.
Raw Alex writes on Netpond: Globiz, Serge's ONLY real risk (different from the search engines) is closeness. If you read through the entire FTC document, they specifically mention "Ill gotten gains" - an indication that they intend to follow the money trail. Serge was the first (and possibily the biggest) source of traffic for their programs. When Serge's cash was in the top 100 (pcdata) was when there were up there as well. When Serge stopped moving them traffic, they really did sink from there. If the FTC finds that the association between Serge's Cash and Cresent was TOO close, then they might act to collect whatever Cresent paided out. HOWEVER, this would be a big jump. I did not see any "Does" listed in the FTC documents, nor did I see any references to third parties or traffic sources. Right now, only 2 officers and the corporate shells appear to be on the hook. However, I would suspect that a number of people and corporations have had their lawyers review the FTC documents...

CEN probably does NOT shave, and they do pay weekly, and indeed they have payed out millions to webmasters. However, the do support PASSWORD THEIVES ( publicly admiting it, yet the used to continuesly lie about it), they do support spammers, the are involved with risky credit card billing, and have major flaws in their business ethics. I believe their actions, as well as others have hurt this industry - and continue to. OF course they are only one in a large group of unsavory and questinable business practices.... they are hardly alone - or even leaders in it! All of you CEN apologists, you are more then welcome to send your traffic to CEN. Infact if that is where you maximize your profits, you probably should - I beleive someone said on here that ones business ethics only extend to as far as one can afford them... Personally I do not do business with CEN... and will not...

Perhaps Chaim is flashing back to his youth, when Mayor LaGuardia read the comics over the radio so the children of New York could keep up with Little Orphan Annie and those Katzenjammer Kids during the newspaper strike.
