Life is good in Los Angeles, or is it? In today’s crumbling adult market all we needed was another HIV outbreak leading to county and state official’s intervention.  The MILF story has gone mainstream. Here are excerpts from LA Times story. Let’s read on and connect the dots:

‘An actress who works in Southern California’s pornography industry has tested positive for HIV, renewing county and state health officials’ concerns that the adult entertainment industry lacks sufficient safety measures to prevent the spread of AIDS and other sexually transmitted diseases.’

‘Dr. Jonathan Fielding, health officer for Los Angeles County, said Wednesday that his office was launching an investigation.’

‘Officials from the state Division of Occupational Safety and Health also said they will look into the circumstances of the case, which is the first publicly confirmed HIV infection in Southern California’s porn industry since 2004, when an HIV outbreak shut down production for four weeks.’

‘At that time, a porn actor who had returned from working in Brazil spread the virus to three actresses who had performed with him. A transsexual performer unrelated to the other cases also tested positive.’

‘As the clinic downplayed the positive test, public health officials cited their ongoing battle with the porn industry over the use of condoms during filming. The two sides have been at odds for years, and despite the intense scrutiny, Fielding said he is concerned that condoms are still not being used.’

‘You wouldn’t send someone to work on a high-rise building without a hard-hat, so why are we allowing these performers to perform without condoms? Fielding said.’

‘Deborah Gold, a senior safety engineer with the state Occupational Safety and Health Division, said her agency repeatedly had attempted to crack down on unsafe workplaces in the adult entertainment industry, issuing several citations against employers, including a gay male production company that touted its condom-free filming.’

 Do you understand what this means for the adult industry? If the county and state officials take over monitoring the adult industry in Southern California, every performer must register as ‘sex worker’, and that without saying can and will have severe consequences and impact all aspects of their personal lives, from renting an apartment to getting a daily job, getting a line of credit, etc. Furthermore, if the usage of condoms becomes mandatory, that will put an end to many popular sub-genres in today’s porn from ass to mouth to cream pies, gang bangs, etc. This will be the perfect nail anti-porn movements from feminist organizations to religious nuts, white supremacists and crazy morons needed to seal our coffin. Just when you think things can’t get any worse.

For a long time, I’ve  spoken against the dangers which the reckless behavior s of a few can and will eventually pose on many, from inflicting physical and  psychological pain on women to working with foreigner performers specially transsexuals, homosexual activities, hiring intravenous drug addicts (IVDU), etc.  I’ve told the truth and for that I’ve been accused of being discriminative, hateful and narrow minded, among the other things. While all along the way my intention has always been to raise the awareness and prevent a disaster that, god forbid, if happens will drastically impact and devastate many people’s lives and livelihood.

 I ‘d like to end this article on a somewhat positive note, but I really don’t know what to say, except for I hope once again we swim rather than sink, and dodge this bullet, too.

    i hate to say so but if this is the only incident of an HIV transmitted performer since 2004 then statistically that is probably better than the average citizen, this considering there are upwards of 500 adult scenes produced in porn valley each day..

    I want to comment on the stupidity of the statements made. The AMERICAN transsexuals in the industry are AIM TESTED and we don’t NORMALLY DO SCENES WITH OUT CONDOMS. The straight industry are the one that practice this regularly, why because it sales. Some girls are even forced into doing so even if they wish against it. Why because if they won’t do it some other girl will so they lose out on me. An Aim test as many know is good for 30 days, thats 30 days to fuck some one night stand and catch a disease. You need to stop focusing on the Gay community and Transsexual community when the outbreaks keep being reported in the STRAIGHT PORN COMMUNITY. I think STARS need to be responsible and realize that their job is based on their cleanliness and not being affected. I also think it should be PRO-Choice if the performer in question would like to use a condom or not even if the performers are tested. Aids happen folks to everyone, focusing on a group is just dumb ass discriminatory on your part. Obviously you missed out on Health class where it says AIDS is not just for GAYS AND “TRANNIES”! And I have good reasons to believe there are eventually more transsexual related HIV tsunami on the way. As for the gay community, the evidence and numbers speak for themselves.     Secondly its irrelevant anyways, because the outbreaks has to deal with the industry not the world and the industry. If people would recognize their responsibility is to be clean before every scene there would be no cause for these issues. Also if every community took RESPONSIBILITY for their mishaps instead of blaming another community for their problems we’d be a lot better off.

    THE FACTS ARE FACTS WE SHOULD USE PROTECTION AND PROMOTE IT REGUARDLESS IF WE ARE TESTED OR NOT so every performer is SAFE! However you can’t chronicle the history of HIV outbreak in the adult industry without mentioning transsexual related cases. Having said that, Miss Shore, if you were reading more carefully, you would have realized that:

    1. I emphasized on the risks of working with ‘foreigner’ performers including but not limited to transsexuals.

    2. I mentioned a variety of reckless behaviours of a few that cause trouble for many, again, including but not limited to transsexual activities.

    So next time if you wanted to express your opinion, choose your words and the subject of your discussion more carefully instead of trying to play dumb smart-ass and taking something out of the context.

I think everybody have seen it coming…the end of porn shooting in LA…at least,in full daylight.It’s what happen when you don’t police yourself.Here in Isla Vista,some peoples did start a party a few years ago call:Floatopia.For the last 2 years,it was pretty small and in order.Last Spring,it was just disgusting.There was close to 20,000 peoples on the beach and a huge amount of them left all their trash behind them…to pollute the beach for months to come.They were planning a new one(Floatopia)for early May.What do you think happen?The county did revoke the right to drink boose on the beach and that’s it.It’s over.

    What about the Heroin addicts for example?
    Remember when Sophia Lynn made the fake cancer story to hide her heroin addiction? When she tried to quit porn the first time, it was obvious in non porn forums that she was a heroin addict, outed by friends and family.   16. There’s no way California will shut down the porn industry with the state in economic shambles. Plus, if patient zero (A HORRIBLE NAME by the way) got infected outside of Porn and didn’t infect anyone INSIDE of Porn they certainly don’t have much of a case to shut it down.

    With hundreds of thousands of Americans being infected each year I think people can live with ONE or TWO Porn infections every FIVE years.     This current HIV outbreak, the way AIM is handling it and revealing previous HIV positive cases that were kep secret by AIM, it all paints a dark picture of our future. Even if they can’t shut down porn entirely, but the chances are they will force AIM out of the picture and pose harsh restrictions such as sex worker registration, mandatory workers’ compensation and probably mandatory usage of condoms. Just imagine what it’ll do to a financially bleeding industry. Forget about DVD sales, live events, tours, etc. People will no longer even watch American porn on VOD web sites, they’ll switch the channel to European hardcore flicks which with all their double anal, fisting and S & M actions are already doing better than lame, monotonous, factory assembled recycled American movies.

    If we reap what we sow, then we’ll be in a world of hurt.

    I know what I’m about to type is gonna get people pissed at me. I blame myself for posting. *sigh* If given a choice of blue pictures with or without condoms. I will pick the one without. I am not the only one. My friends are the same. The whole point is illusion – fantasy. Having a condom breaks that fiction. I’m not gonna apologize, it’s how I feel.

    Fine call me a bastard. I’ll go a step further, make myself an asshole. Last November I bought for myself an MP3 player (my first). It’s an RCA, I opted not to go with the ones that have rechargeable batteries. If they die, you need a new player. I hate that kind of proprietary crap. So I got one that uses a single AAA battery. I found one with a micro SD expansion slot. I’m getting a good deal for my money. So?

    I go through batteries in this sucker like crazy. While the more expensive AAAs would probably last longer. I’m not paying three bucks for two of them. I go to my local 99 Cents shop and pick up imported batteries, four for a dollar. These would be the ones that are made in sweat shops overseas. My music is powered by the suffering and deaths of others. I’m not blind to it. Hell, a lot my clothes are the same – three bucks for a shirt. Quantity over quality; my money can go farther this route. It’s true. Like it or not.

    I once got into a discussion with a seller of a Yahoo auction. He had a laser disc I wanted to buy. The thing has been listed for months, no bidders. I asked if he could reduce the price. No. Then gave me an analogy about his car. He drives or so he claimed, a luxury auto; rated high for impact survival. Why would you drive a car that wasn’t safe? Save your money buy the right car = save up and get this LD. I don’t think he ever sold that title. It was unrealistic. He wanted the then retail price for it. A dead format. In a perect world that would work. The same thing with banning guns. On paper it’s a winner. In life it’s a plan for disaster.

    If this rule comes true, I can see what The Colonel writes as fact; no more ATMs, gang bangs and cream pies. Hell, no more oral. I can envision companies doing what is required, rubbers for all and seeing their sales go further down. The answer is simple: leave California. Folks trekked across this country for chance to strike it rich – finding gold. People will move where the money is. And if it’s not California, time to relocate.

    Gay and bi-sexual men are at least half the equation, and who knows if they included transexuals in that category (the article was written in the People’s Republic of Southern California). Statistically, people in this group are much more likely to contract AIDS yet a handful of politically correct folks, currently outspoken trannies, are tearing into the Colonel as if he skewed the results somehow. Fuss at the CDC, WHO, or any other organization that tracks such data but don’t kill the messenger when he points out the elevated dangers of working with certain groups (IV drug users included).

    Mr. Shore can deny this truism all he wants, even argue statistical methodology or causality, but ultimately STDs are a reality for every sex worker and it behooves them to know what practices are more dangerous. They can then opt out of working with such people or charge a premium to do so but the mandatory condom suggestion is just another way to send jobs overseas. The closer you look at ANY government regulation, the more problems you will find. This is irregardless of political party or affiliation too, so don’t run so willingly to big brother to protect those poor workers when the likely results will be less than satisfactory.

    There is ONE reason why you never hear about HIV in the gay porn industry, and that is because they dont test and do not have any program like AIM. IF they did it would hsow that about 50% of all gay performers are HIV positive, and it would reveal that people are evtering that business HIV negative and leaving it HIV positive. They hide behind the ‘privace’ issue when asked why they dont have a testing program. They dont even test for the ‘lesser’ std’s because those results would be sent to the county as required by law.

    Some gay companies, or should I say gay talent, do test at AIM. A large number of those are the positives that are referred to in the above referenced article.

    As you can see, in a reletively short period of time that a small number of gay talent have been testing how high the positive rate is in that “side’ of the industry.

    Colonel, when it comes to this issue there is no room for our war of words, and I applaud your wellthought out and well articulated response.

    The truth is an HIV outbreak in the adult industry every few years, as terrible as it is, but it’s not any worse than what’s happening all across this country among the street walking prostitues, IV drug users and in prisons. But unfortunately it creates an opportunity for anti-porn movements of all sorts to hit the industry in it’s weak spot and unleash their dogs after us.

    I guarantee you if you go to a transsexual or gay club looking for a one night stand, which unfortunately certain performers in this industry do that regularly, you’ll be in a greater danger of getting exposed to HIV in compare to perfoming with a straight girl on a porn set. So regardless of how we come out of this crisis, as long as certain individuals in this industry prefer their personal deviant interests over the benefit of many, we will always be in grave danger.

    Straight industry has testing program and once every r=few years someone comes up positive. Gay industry uses condoms, yet 50 to 60% are HIV positive. Go figure.

    I don’t want to get into statistics with you or outspoken, politically correct chicks with dicks on this board; but the facts are the facts: the percentage of HIV infection among transsexual and gay people, regardless of their ethnicity and nationality, is higher than straight people. So in answer to your tongue in cheek statement, I don’t believe HIV is a gay disease, but based on the evidence and numbers, I believe transsexuals and gays are more likely to catch and/or transmit HIV.     rics, about half the guys in gay porn are poz. But that is a totally different situation and set of attitudes about HIV. The bareback studios assume that a performer has HIV when they come in. Then there are studios that are condom only. Hence, the protocol and expectations vary from place to place, whereas in hetero, there is an established set of guidelines that is supposed to be followed.

    It always comes down to one black sheep. In this case, the black sheep was the producer who shot the female performer with a pending HIV test. We can argue the male performers who worked with her were responsible, too. But ultimately it was the producer’s fuck-up; and I believe he’s the same guy who started romurs on GFY to blame everything on AIM and cover his own ass. Eventually the story breaks out in mainstream, and now everybody is knee deep in shit.

    I believe the names must be named and the producer must accept the responsibility. An entire industry cannot and should not pay for the misdeeds of one fucking idiot.

    Producers must take every cautionary step possible to protect themselves legally, as well as to protect their talent from health safety hazards. I’m now counseling all of my current talent to be tested every 15 days, and I’ll refuse to work with those who have let their typical 30-day tests go till the very end. This only demonstrates that these performers are at-risk and have a laissez-faire attitude toward their own health. The additional cost of stepping-up your testing schedule is minimal, and shouldn’t even be an issue when you weigh the cost/benefit to your continued health.

    As performers and producers, we can’t afford to take chances anymore, with our health or our money.

    The legality of those waivers is very, very, very dubious, that is why in the few cases a performer has sued, the case has been settled out of court. Example, Kira Kenner vs Vivid. They paid her to go and shut her mouth lots off money.

    I would counter that it’s not “recommended” but required that the producer verifies all docs. The onus of legality lies with the hiring entity and its representatives, i.e. the studio/production company and director, even if performers are considered “work for hire” subcontractors, which they technically are, unless under proper contract (a particular liability). These subcontractors are working for you, in your “workplace,” and they’re covered under all applicable state labor laws. Do your research. The same applies to the legal responsibility to verify I.D.s if the authorities come knocking. You can be sure that any lawyer representing a plaintiff in any worker-safety case will name every single party in the chain of potential liability. If you’re in this business today, you better have solid legal representation, and you better cover your ass no matter how protected you think you are, sirecumalot.

    the whole point is exactly that the producer cannot take responsibility for those tests since the producer did not arrange the tests or warrant the accuracy of the tests..

Therefore the producer must draw the line to protect himself; and ultimatelly performers must be self aware and extremely concerned about their own safety and livehood. The following is an excerpt of the work for hire agreement which I require the performers to read, initial and sign along with 2257 form:

    Waiver of Liability: Performer hereby releases, discharges and agrees to hold harmless Producer, and all persons lawfully deriving authority from the Producer, including without limitation, Producer’s employees, agents, contractors, performers, service providers, affiliates, financiers, backers, and licensees, from any claims or liability resulting from any sexually transmitted disease, condition or ailment which Performer may contract which is caused by or aggravated by any sexual acts or physical contact of any kind (whether direct or indirect, deliberate or accidental) with any other performer, actor or model. Performer acknowledges that Performer is not required as a condition of employment by Producer to engage in any actual sexual conduct in the course of the performance, or otherwise, and that any such sexual conduct or contact between Performer and any other person or persons, if it should occur, is exclusively a result of Performer’s own exclusive and unfettered choice and decision. Performer further acknowledges that Producer has made no representations to Performer as to the health of any performer, or that any other performer or actor is free from any communicable or transmissible disease, including without limitation, sexually transmitted diseases.

Moore has directed several titles such as Transsexual Prostitutes 47 and Tranny Hunter 2 and also appeared as a performer in bisexual and shemale themed films.

    XBIZ has revealed that two male performers were exposed to the virus after working with the infected talent. One of the men is male talent based in Las Vegas. The male talent was tested at a Las Vegas draw center leading to the conclusion that he is based there. Given the shemale/gay porn connection of the director and the assumed first male talent exposed, perhaps it can be assumed that the Vegas male talent also worked in those genres? If so, for me, there is a particular talent from that area who does work often in that niche.

    Who is the female patient zero? Some feel that it is someone near and dear to Tom Moore himself. Otherwise, why would he take on the liability risk of shooting someone who did not have a test?

I recall that AVN never printed a follow-up story(?)

    Look my friends, We’ve already discussed the issue of insurance policies and worker’s comp in the adult industry a number of times; and there’s really nothing more to add. The authorities have been trying to force these regulations on the industry for sometimes; but the adult industry is so complex and the number of independent producers are so many that in actuality, even if they pass something as a law, they will have a very diffucult time enforcing those laws. It would be a nightmare for them, if not impossible.

    First of all, waiver of liability in work for hire agreement which most producers including myself require performers to sign, protects them against the majority of claims. Even if somebody gets severely injured or something goes seriously wrong, the producer and performer will settle things between themselves and keep it under the radar. Let me give you 2 examples:

    Kelly Wells, my good friend, was severely injured during a scene directed by Belladonna for Evil Angel, her jaw broke badly. But everything was settled behind closed doors, Kelly received a payment and never took any action against Evil Angel.

    Another example, Tiffany Holiday got seriously injured on a gang bang scene for Anabolic. Again, they settled everything between themselves, Tiffany received a payment which of course blew it on booze and drugs and bullshit, and that was the end of it. I can go on and give you more examples of familiar names, but I’m sure you already got the picture.

    So please stop with all these speculations regarding insurance policies and worker’s comp issues and let’s focus on the real subject(s).

    Here’s some interesting research I obtained from the CA Dept. of Industrial Relations, relating to the standing legal definition of an “independent contractor.” These decisions are very important to any adult producer, as they define our legal responsibility for providing workers’ compensation and other remuneration to not only talent, but to every worker involved in production. The case info is lengthy, so I’ll only give the links and you can read it for yourself. Ultimately, we could be imposed with significant legal and financial burdens should the State of CA begin enforcing these decisions.

    This references the case of JKH Enterprises, Inc. v. Dept. of Industrial Relations in the CA State Court of Appeal, Sixth Appellate Court. The decision was filed on 9/11/06. The following is a brief exerpt from the court’s decision:

    “Although some of the factors in this case can be indicative of the workers being independent contractors, the overriding factor is that the persons performing the work are not engaged in occupations or businesses distinct from that of [JKH]. Rather, their work is the basis for [JKH’s] business. [JKH] obtains the clients who are in need of delivery services and provides the workers who conduct the service on behalf of [JKH]. In addition, even though there is an absence of control over the details, an employee-employer relationship will be found if the [principal] retains pervasive control over the
    operation as a whole, the worker’s duties are an integral part of the operation, and the nature of the work makes detailed control unnecessary. (Yellow Cab Cooperative v. Workers Compensation Appeals Board (1991) 226 Cal.App.3d 1288). Therefore, the finding is that these workers are in fact employees of [JKH].”

    You will note the phrases, “their work is the basis for… business,” and, “the worker’s duties are an integral part of the operation.” This was a key point in the Brooke Ashley (Doe 43) case, to determine if she was considered an “employee” and therefore entitled to full worker’s compensation.

    I disagree for a variety of reasons that I explained in this thread. Increased regulations in Sothern California based adult industry have the potential to destroy the industry as we know it: with mandatory sex worker registration, less and less girls join the industry. The reason they do this now is because the door is open to anybody who can get in and either makes good money for a short period of time and gets on with her life, or stays in and makes a lifetime career out of it; doing all this and remaining anonymous, knowing when she tends to rent an apartment, apply for a part time secretary job or gets a new credit card, her porn career won’t interfere one way way or another. While many girls won’t take the risk to ‘brand’ themselves as sex worker for the rest of their lives for a porn career with a relatively short life span of about 2 yeas.

    Furthermore, today the porn consumers demands are much different from what it was a decade ago: they pay to see sloppy blow jobs, ass licking, ass to mouth, ass to pussy, cream pies, DP, gang bangs, etc. If the usage of condoms becomes mandatory, producing any scenes of such nature will be impossible; hence consumers switch the channel to where they can get what they want to see and not what we’re forced to provide. They’ll become loyal customers of European, Southern American, Asian or any porn that’s up to date and irregulated. So everything burns to the ground, it will no longer be surviver of the strongest in oppose to annihilation of the weak. It’ll be total annihilation of Suthern California based pornography as we know it.

    However, we did a decent job, we got to the bottom of this crisis and revealed the truth, and proved it was caused by mistake and misdeed of a homosexual director acting out of sheer selfishness and stupidity and without the knowledge and consent of the company he shot the controversial scene for. It was transsexuals and homosexuals who once again took us to the edge and put our lives, safety and livehood in grave danger. This crisis too was their fault, like other incidents in the past. It was not the result of the failure of the adult industry’s guidline and safety protocols; and everything is under control. Hence, blood thirsty anti-porn movements of left and right have been disarmed and stripped of their ammunition. They have no further reason or excuse to interfere and meddle in the adult industry. We won. Transsexuals and homosexuals lost and were rightfully exposed and disgraced. So now they can crawl under a rock, fuck themselves and exchange bodily fluids and HIV.

He did that to protect himself and cover up the fact that he was the one insisting on shooting a performer with a pending HIV test. Therefore he purposedly gave false, inaccurate discription of the female to further confuse and mislead people. From what I’m hearing from several sources, the female is younger thatn 42 with entirely different discriptions.

    The important thing is we know who was mainly responsible for creating this crisis. The identity of the female is of secondary importance, even though it’s just a matter of time untill we find out that, too.
