LOS ANGELES — In a shot that is sure to create a larger division between the two largest adult entertainment business publishers, Adult Video News has filed suit against XBIZ, claiming it misappropriated trade secrets when it hired a former AVN sales executive.
XBIZ and its sales executive, Sara Sazzman, on Tuesday were served with an eight-count complaint, seeking a jury trial and unspecified damages.
The suit, which includes breach of contract claims, misappropriation of trade secrets and unfair competition, among others, was filed Monday at Los Angeles Superior Court.
XBIZ attorneys said that the company plans to vigorously defend itself against the charges.
“Clearly AVN is trying to tarnish XBIZ’s reputation to stem the tide of its diminishing marketshare,” XBIZ counsel said.
This will end up being a battle to the death. One of these two companies is not going to make it. And I hate to profess doom & gloom. But I think the answer starts with A, not X.
TRADE SECRETS? You mean the “payoffs”. I have to get back to reading that line and laughing. AVN is making itself sound like it had the Colonel’s secret herbs and spices and that they were sold to XBIZ. I mean Mark Kernes does look like a fry cook, but trade secrets, too funny.
Those fuckers at AVN have finally lost their minds, though it’s interesting to know how Paul Fishbein and Co. can afford to pay the cost of a long, exhausting legal battle. Their business is going down the gutter, their magazine is shrinking every month, even gay companies don’t purchase ad spaces from them as much as they used to, and their website is a joke.
Probably this is their final dirty trick: filling a lawsuit against XBIZ in hope for a settlement. Unfortunately they don’t realize that alleged charges are so stupid any judge with half a brain will throw this case out of the court, and they’ll be left with their thumbs up their ass and a humongous attorney bill.
This is a funny one. AVN has definitely “jumped the shark”. AVN has become and has been for a long time nothing but a parasite. Look at the new issue it is a shell of what it was in it’s prime. All adds, nothing worthy as far as editorials or real news it looks like a fucking value coupon pack for fuck movies. Last year was the first year we did not exhibit at the adult expo. I can say that we will never do another one. The voodoo of “having” to do avn expo is no more. They had no new distributors to meet in fact all it has become is a fan boy flea market so they can get a free poster signed by some lame whore. This is after doing 13 of them. So why give Paul and company $3,000 for a full page? I can’t see any pay off what so ever. Why companies still pay him and run adds is beyond me.
