For those of you that don’t know Monica Foster real name ######## the web cam model, prostitute, accused Lenny Dykstra the all American baseball hero of hiring her to fuck her and then giving her a bad check right before the holiday’s.
She did this in a desperate attempted to get money right before Christmas because she read online that he was down on his luck and in a bad money situation. They also asked that she prove it and post a copy of the check which she didn’t have because it was all a lie. If it was true she wouldn’t have a problem posting the check!

How stupid can someone be to see a site that gets over 20k page views A DAY can only have one poster. I will say this one more time. My email address is donnylong AT XXXFILMJOBS.COM and that hotmail account had got hacked a while back but i got it back and have no control over what people set in there websites script to send email from .PHP on a return address. It could be set to look like it came from anywhere so you reply to that. ITS CALLED SPAM! DUMB ASS!

Page views are not counted based upon ip address visits. It can be the same ip repeatedly viewing forum or blog pages etc…the unique visitor is the important one and that counts new visitors to a site, not return visits which is counted as “hits” all it would take is for an image or something to be hotlinked on a site like facebook or myspace or twitter to boost a page view or hit count.

Actually Colonel I don’t think you can sue for privacy violation if that information is public knowledge. I’ll use myself as an example.
Lets say Cindy posts my real name and address on this blog. Unless she is posting some slanderous/libelous things to go with it, it isn’t illegal to post my information because it is public record.
For example-
The state I am currently in has a very large database of court records available online, everything from traffic tickets, DUI’s, felonies, divorces, civil suits, etc…Cindi could say she plugged in my name and saw that a got a traffic ticket in 2009 and on this particular database if you click on the defendants name, it will give you their name, dob, address, and sometimes a phone number.
The county I am living in has an assessors office that has a online records search. You can plug in my name and it will give you my street address and in a few clicks you will see a photo of my house, the value, the sales history, and I believe what I paid in property taxes. All public record.
The state I’m living in also has a online voter registration site where you can plug in a name and it will tell you their address, their voting district, how many times they voted, their political party, and when they registered to vote.
I have donated to a number of political candidates over the years. If you plug in my name (it’s an uncommon first and last name) you will be able to see the political donations I made, my home address, and what my occupation is.
A linkedin public profile will tell you my work history, current job and give you a link to my company’s website where there is a photo of me.
On a search engine (one of many) I plugged in my name and state and it came back my name,age, possible addresses, and possible relatives. The relatives included my parents, grandmother,siblings, adult age nephews and nieces, inlaws, aunts, uncles, and cousins.
Sometimes the first amendment can bite you in the ass. Ann Coulter and Michelle Malkin posted the names, personal phone numbers, and home addresses of some of their critics on their websites/blogs. In that case Wikipedia and IMDB are violating a number of performers civil rights since a there are a lot of pages that include a performers birth name in their biography. I’m going to go out on a limb and say most of those performers didn’t consent to having their legal names mixed in with their porn biography.

In case of mainstream movie actors’ names on their Wikipedia and IMDB profiles, most of those actors use their real names in movie credits, so Wikipedia and IMDB don’t do anything without their consent and knowledge. Besides, there’s a fine line between acting in mainstream movies and performing in porn scenes. A porn performer is more in danger of being harassed and stalked by delusional fanboys in compare to a movie actor; and that’s exactly what Donny Long in this particular situation is trying to do: He’s trying to expose performers’ real names and personal information and intimidate them. Since his career in the adult industry was a complete, utter failure, this is his way of getting revenge on an industry that threw him away and kicked him to the curb like the bag of rancid trash that he is. Here’s the way libel works. There are private figures and there are public figures. A public figure is someone who has knowingly put themselves in the public eye. As a porn star who is literally baring all for the public, Ms. Foster is a public figure. To win a libel suit she has to prove: that the things said about her are untrue; next she has to prove that the person making the statements knew that they were untrue, did so with reckless disregard for the truth and did so with the intent of causing her emotional and financial harm. Last, and this is crucial, she has to demonstrate economic damages as a result of what was said about her. It’s unlikely that she could sue simply over the fact that someone has posted private information about family members, like the names or other personal information about her parents or siblings, although that might bolster the fact that the person doing the posting wanted to cause her emotional harm. In theory, her family could do that, and since they are not public figures, the bar would be lower for them to prevail than for Monica. But they would have to demonstrate that their names, addresses, etc., are truly private. Given how much information about us is public these days, like voters registration, that’s tough. Now, if someone posted a statement that Monica has AIDS and if that someone knew or should have known that she did not have AIDS, well, that’s a pretty good grounds for filing a suit, since the suspicion that she has AIDS would be detrimental to her career. You could argue that the only reason someone would do that would be to cause her emotional and financial harm. But as a public figure, she still has to quantify the harm.
Teagan Presley had to recently go to court after her stalker showed up a her hotel room. Lizz Tayler recently said how she found a man looking through her kitchen window. Mason Wyler was raped and beaten at gunpoint in his home by a male “fan.” Ron Jeremy once said how after he first posed for Playgirl before he ever entered porn, his parents told him to change his name after fans of his showed up at their home looking for him. Digital Playground director Robby D wouldn’t even show his face on a porn documentary but bragged about sending his three-year-old daughter to private school. Traci Lords and one of her ex-husbands had to leave their home and flee their neighborhood after being harassed & threatened by neighbors after they found out the blonde next door was a former porn star. There are reasons why people in the adult industry don’t want their real names out there. It’s their right to not have their names out there next to their stage names. It’s their names, not yours. They didn’t give anyone permission to put their real names alongside their porn names. There are mainstream celebrities who don’t want anyone to know their real names. Did any of you dimwits ever think they’re trying to protect themselves from stalkers and protect their families from the paparazzi?
With real names, city, and birth dates out there, stalkers like Donny Long are finding out the porn star’s spouses’ names & their children’s names. He’s already said he’s contacted the family of many porn stars and sending them the porn tapes of their daughters telling the families what they do for a living. We already know what happened to Mark Spiegler after SOMEONE plastered his neighborhood with fliers calling him a pedophile.
It might not be just a porn star trying to protect themselves from stalkers, but also they’re trying to protect their family from small town politics. Families have been destroyed and torn apart after the town found out what someone’s daughter does for a living. The parents then have to either live in hell or move out of town.

Dude you need to know how the first amendment works, it is not against the law to post a porn performer’s legal name, that is a indisputable fact. You are correct that this is a libel case and not slander because it was published. To your first point, I don’t disagree that blogging that someone has AIDS when they don’t would be damaging to someone’s reputation, especially if they work in the adult industry. That said, if you’ve ever lived through a lawsuit, nothing is “easy.” There is still a process that involves discovery – affadavits, depositions, etc. Just filing a lawsuit that says someone said something about me that is provably false does not win the day, even if it’s easy to prove that it was false and you’re in the right.
To the second, sorry, but you’re confusing private figures with public figures. In a libel suit involving a private figure, you may be correct that damages are assumed.
However, there is a separate standard for a public figure because the First Amendment encourages vigorous public debate. It is purposely difficult for someone in the public eye – defined as someone who makes their living by being in the public or someone who has thrust themselves into the center of a public controvery – to bring a libel suit so as not to stifle public debate. A porn star would by definition be considered a public figure. In those instances, the bar is much higher, which is the reason that so few actors bring lawsuits against tabloids that write outrageous things about them. A public figure has to prove that:
the statements at issue were false
that the person making them knew, or should have known, that the statements were fault and made them with reckless disregard of the truth
that the person making them did so with the intent of causing emotional or financial harm …
the law refers to this as “actual malice.” There has to be an intent to cause harm.
and …. in a libel suit involving a public figure, the public figure has to demonstrate and quantify actual damages.
An entertainer – someone who makes their living by making themselves available to the public – is considered a public figure. So are athletes, musicians, artists, politicians, business executives and political and social commentators. This is the reason that the NY Jets coach can say that photos and videos involving his wife are a private matter and he won’t comment, but the newspapers and websites keep posting them. Second, by making public accusations about Mr. Dykstra, who is arguably a public figure as a former athlete and an individual involved in a public controversy, Ms. Foster doubly thrust herself into the public eye.
So … she has to meet the test outlined above, including actual damages. That’s the way it works.
Now, you may be correct that the statements about Ms. Foster are false. And if she were to bring a suit that survives motions to dismiss after discovery and depositions, she may be able to prove at trial that the statements were made with the intent to cause her emotional or financial harm, and she may be able to prove that she suffered a financial loss as a result of them. But, it will take her two years to get to that point if it ever gets to that point; it will be very expensive; and if she wins, she still has to collect.
Last, it’s tough to get a personal injury lawyer to bring a contingency case, especially one that will have to be litigated in Federal court since Ms. Foster lives in California and Mr. Long does not, unless the individual they are suing has deep pockets.
A lawyer might ask: Just how much is a used Jet Ski worth?

Almost 10 years ago, a columnist named Jeanette Walls wrote a story about Matt Drudge and the rumors about his homsexuality. Drudge posted Walls personal information on his website. Keep in mind Drudge gets millions of hits on his site daily. The people sending the harassing emails, letters, and phone calls could get in trouble but not Drudge himself. As I wrote earlier, Ann Coulter and Michelle Malkin did this to other columnists on their websites which like Drudge have millions of hits a day.

Mark I’m guessing that the people who got those photos found them on a public website, not facebook or myspace but a professional site where you click on a person’s bio and a picture comes up. If so, the photos came from a public and open website. Other then some kind of copyright infringement for republishing the photo w/out permission I’m not sure if that argument would hold water in court. A few years ago, a photography company sued Playboy for including a Playmate’s high school graduation photo in her datasheet w/out getting permission or paying them prior. They lost.

Again, this is where it gets tricky. If their contact info is listed on a business webpage, what can be done about it, I mean it’s already out there on the internet and there isn’t a law that says you can’t post it elsewhere. The majority of people who donated to Prop 8 were private citizens but their names and addresses are available to look at. If her dad has a listed number in the white pages w/an address it’s going to fall under the public knowledge category.

DSM-V, due in May 2013. They keep coming up with more disorders, although they’ve removed homosexuality, which they no longer consider a “disorder”.
