Centurion Ltd, sued by Falcon Foto for copyright infringement, fights back

I got this PR release:

Should the matter proceed before the courts, Centurion will allege in its defence and counterclaim that Falcon Foto, Jason Tucker and their attorney Robert Apgood have been using the adult media to instill fear in the adult community with exaggerations and untruths. As an example, Falcon has announced that they have recovered almost a $3.2 million dollar judgment in their lawsuit against Porn Kings, and Falcon attorney Robert Apgood chose his words carefully when he is quoted as saying that the terms of the judgment “have been satisfied”. Falcon did not make the settlement terms public record, but has no problem with Apgood making statements abut the size of their settlement. Why hide the settlement agreement from the public record, but disclose what is supposedly in it to the press?

What can we discern from the Court records that are public. Firstly that Falcon sued 6 individuals and 3 corporate entities, and dismissed its action against all but one of the defendants. Secondly that Falcon likely did not collect almost $3.2 million at all but has acquired Porn Kings assets on undisclosed terms. Centurion Ltd will allege in its counterclaim and intends to prove at trial that Falcon, Tucker and its attorneys are not credible and are using the media to promote their unfair business practices and that Falcon did not really settle for $3.2 million as they suggest. That it is a fabricated settlement as can be seen from the documents on file with the Court where Lucas Bradfield, President of the company that runs Porn Kings, says “ With the understanding and agreement from the Plaintiffs that the Plaintiffs will contemporaneously file a Satisfaction of Judgment in the full amount, I authorize the entry of a judgment against Noble Developments in the amount of $3,173,650.00.”

Centurion’s conclusion, that Bradfield agreed to a judgment and did not care how much the judgment was for – because it was instantly satisfied. Centurion will further allege that adult news companies like AVNonline and XBiz have been manipulated into publishing these half-truths for Falcon’s benefit and to the detriment of the truth.

That Falcon is using this strategy and the media to sell the illusion of Falcon’s legal successes with the intent of frightening other adult operators that Falcon will go after to settle quickly in the hope of avoiding similarly huge judgments. Pr@Centurionltd.com
